The Supreme Court now has all five justices, with the appointment of Tashi Chhozom as the countrys first woman justice in the countrys highest appellate authority. Im humbled to be elevated to such a post at such a young age, justice Tashi Chhozom, who joined the judiciary in 1995, said. I will live up to the trust and faith reposed in me by the Bhutanese system. According to the Constitution, the justices of the Supreme Court shall be appointed from among the drangpons of high court, or from eminent jurists, by the Druk Gyalpo in consultation with the National Judicial Commission. The chief justice of Bhutan, the senior most drangpon of the Supreme Court, the chairperson of the legislative committee of the National Assembly, and the attorney general comprise the national judicial commission.

JUDICIARY
On the recommendation of the national judicial commission, His Majesty the King on August 3 appointed high courts justice Tashi Chhozom as an SC justice, in accordance with article 21 of the Constitution. At 42 years, justice Tashi Chhozom is the youngest among the SC justices. Supreme Court chief justice Sonam Tobgye, who became the first chief justice on February 21, 2010 is 62 years; while, among the three other associate justices, Dasho Rinzin Gyaltshen is also 62, whereas Tshering Wangchuk and Rinzin Penjor are both 48. They were administered the oath of office and secrecy on the same day. According to the Constitution, the term of office of the chief justice of Bhutan is five years, or until attaining the age of sixty-five years, whichever is earlier. The associate justices will serve for ten years, or until attaining the age of sixty-five years, whichever is earlier.

Following discussions on the policy of zero tolerance to indiscipline in schools, the education ministry has reviewed, discussed and revised its earlier criteria for expulsion of a student from school. The revised guidelines states that offenses of criminal nature shall be dealt with as per the law of the land. The student, if proven guilty of the crime, by verdict of the court, may be expelled, depending on the nature of the crime, the guidelines states. According to the earlier guidelines, a court verdict would determine if a child should remain in school or be expelled. The child, if proven guilty of the crime by verdict of the court, both bailable and non-bailable, is automatically expelled, it had stated. Commenting on how only two lines, the expulsion aspect, of the 14-page policy has caught everyones, including the medias attention, the education secretary Sangay Zam in a press conference yesterday said that there is a lot of misunderstanding with expulsion hijacking other preventive and corrective provisions of the policy. There seem to be a perception that were going to be merrily expelling children, the secretary said. Id like to make very clear that the education ministrys mandate is to nurture and help children realise their full potential, and that were not here to punish. The change in the expulsion criteria means that conviction may not necessarily result in expulsion but would depend on the nature of crime, the secretary said.

Expulsion: the last resort


From Pg. 1 Definitely, zero tolerance would be for violent crimes like murder and stabbing, but if its substance abuse, wed recommend that the child go for rehabilitation first, and come back to school, she said. You wont see a child with substance abuse problem being expelled. On if a student should be given a second chance to schooling after expulsion, the secretary pointed out that expulsion comes after many chances. We also believe that children should stay in school, thats why we arent allowed to expel children below 14 years, she said. While the ministry wanted students and parents to believe that conviction for drug abuse would also result in expulsion, it would not happen in reality, the secretary said. However, if a student is below 18 years, convicted for a violent crime, they are sent to the rehabilitation center in Tsimasham, where they can continue their schooling. But if youve crossed 18 years, served a sentence and come out, then we have the continuing education facility, where they can pay and continue their studies if they if theyre still interested, secretary Sangay Zam said. Royal education council member and honorary consul of Bhutan to the UK, Michael Rutland in an email interview said it is a basic principle of Buddhism that all thoughts and actions have inevitable consequences the principle of cause and effect. The education system and individual schools need to articulate this principle very clearly, so that students from the youngest age understand and accept that intolerable behaviour cannot and will not be tolerated by school or society, he said. All thoughts and actions, he said, inevitably result in consequences and zero tolerance is , saying the same thing in different words all behaviour, both good and bad, inevitably brings consequences. The problem is to ensure that the consequences are appropriate to the behaviour, Michael Ruthland said. What exactly are the appropriate consequences when dealing with young people? This question can only be answered after careful thought. Remember the old legal saying hard cases make bad law And remember . too the well-known principle of unintended consequences, whereby the zero tolerance policy might create through its too hasty application problems, which are greater than those it is intended to deal with. Ministry officials reiterated that expulsion, which was incorporated in the policy to instill fear among students and parents, is the last resort that the school would take for those involved in violent crimes, and who would affect the safety of other children. While the schools discipline committee is empowered to impose other sanctions, the school management board would decide on expulsion. Schools should have a record of the childs disciplinary history. Schools will go through all the processes of trying to reform, counsel, use preventive measures, then corrective measures and, if all has failed, there are still other measures like suspension, as long as the child is not convicted of a crime, the secretary explained. From Pg. 1 The Supreme Court is the highest appellate authority to entertain appeals against the judgments, orders, or decisions of the high court in all matters, which has the power to review its judgments and orders. At present, the Supreme Court is temporarily housed in the Kuengachholing state guest house. Its new structure is under construction at Hejo. The high court, meanwhile, is short of five justices, and could remain like that for the next two years. This is because, according to a member of the national judicial commission, the serving district court judges, who are supposed to be elevated to the high court from lower courts, must have served at least 20 years in the judiciary. That means high court will have to function with only four justices, including the act-

ing chief justice for the next two years or so, he said. The Entitlement and Service Conditions Act for holders, members and commissioners of constitutional offices, which Parliament passed in June 2010, states no person shall hold a constitutional office, unless the person is in the government or public service of 20 years for members and commissioners, and 25 years for heads of constitutional offices. As of now, high court has two benches with two drangpons dealing with appeal cases, and an appellate division, larger bench, which is presided over by acing chief justice and four justices. With the appointment of Tashi Chhozom as the Supreme Court justice, one bench will have only one judge. Well have to re-schedule the hearing of cases, acting chief justice Sangay Khandu said. As of now, we have 173 pending cases.

feels that a child with disciplinary problems may improve in a new environment or school, the school may advise the parents to take the child to another school. Removal from school in such cases is not expulsion, the secretary said. During the consultation process for the policy, many schools raised concerns on expulsion, ministry officials said. Its sad that you have to put fear in people for them to behave in a certain manner, but the reality is that you have to have fear of consequences, because they know we cant beat them. Chief human resource officer Sonam Wangyel said the ministry has already recruited 12 full time counsellors to help schools with indiscipline problems. It will recruit 75 more. Michael Rutland said the zero tolerance policy comes under the stick category that an education system develops to inculcate the highest standards of behaviour and morality in students. Theres surely no doubt that there is some behaviour which is literally intolerable , Michael Rutland said. And its this category of behaviour, which rightly justifies a zero tolerance policy. It could also be argued that behaviour, which seriously harms the community, is also intolerable but here there is the difficult question of who decides the degree of community harm done, and also when young people are involved, how great is the degree of intentionality; the dividing line can be exceedingly fuzzy!

The businesswoman also ran a bar in her shop. Police said she had a bar license. Captain Thuji said that two of the five women charged with prostitution are married. He also said that four of the five charged with prostitution are unemployed. One of the women works as a labourer. He added that all of the five charged with prostitution, and the businesswoman charged with promotion of prostitution have between one to three children each. He claimed that the shop was under surveillance for at least three months. He added that it was observed that people visiting the shop came from various backgrounds and occupations, including school students, monks, and labourers, among others. Captain Thuji said that police were not aware of any other establishments, where prostitution may be occurring. The 46-year-old businesswoman, charged with promotion of prostitution, is a repeat offender. In 2009, she was charged with both promotion of prostitution and illegal sale of controlled substances. She was acquitted of the former charge, because of lack of evidence, but served six months for sale of controlled substances. Prostitution and promotion of prostitution are misdemeanours as per the penal code, requiring prison sentences between one and less than three years. Having in possession tobacco and tobacco products beyond permissible limits is punishable with a minimum sentence of felony of the fourth degree as per the tobacco control act 2010. The prison sentence is between three to less than five years. All offences are enhanced if it concerns a convicted repeat offender.

About four years ago, police chief Brigadier Kipchu Namgyel announced the removal of the orderly system in the police, which, following the vote last month, has cast it on a balance. Home and cultural affairs minister Minjur Dorji said there were more yes votes that both superintendents and officer-in-command cast during a meeting last month. But the yes votes were more by only one, he said. Lyonpo Minjur Dorji said the decision on whether to retain or do away with the orderlies would be based on proposals the police service board put forth. Ministry will discuss with the finance ministry and see if theres any budget implications, he said. Well then put it up to the Cabinet. He explained there were three options on the issue. The government might retain them or institute a support administrative cadre system to support the officers, he said. Or it might make monetary payments to the officers to compensate for orderlies. Lyonpo Minjur Dorji also said, if the government decided on retaining the orderly, strict rules and regulations, including the dos and donts , would be framed for officers using orderlies. The orderly system in the armed forces came under criti-

cism around mid 2000, when the chimis (peoples representatives) accused senior officials of the armed forces misusing their constables and lowerranked soldiers. The police chief, while presenting the Police Bill to the National Council in December 2008, said the ata system had to be done away with, as it was counter-productive. To be recruited after class X and trained for a year only to land up with senior officers as orderlies, it affected their morale. The orderly system, police officials said, was emulated from the British system, where the orderlies are assigned as personal servants to the officers, to cook for them, maintain their uniform and convey orders. But in Bhutan, orderlies are made to do household chores, help officers wives run errands, drop school-going children and work in farms and gardens. Removing the orderly, home minister, said was difficult, as it has been there for a long time, and it was needed for officers without families. They do most of the work and there has to be someone, who will cook and wash their clothes, he said. Removing the orderly might affect their performances. Police, however, say they are ready to do away with the orderly system. Police media spokesperson said they had submitted their proposal to the ministry last month and explained the votes they took was but a study, and not to take decisions on whether the wished to keep it or not. Were waiting for the ministrys instructions, he said. Police has decided to do away with the orderly system.

Four more women have been arrested by police in connection with prostitution in Tshongdue, Paro, bringing the total number of arrests to seven people.

CRIME
Police arrested two women on Saturday, and two more yesterday. The ages of the arrested women are 28, 30, 31, and 32. All are being charged with prostitution, said captain Thuji, officer-in-charge of the women and child protection unit, Paro division. The police made their first arrests in connection with prostitution in Tshongdue, early last week. On a tip-off, police raided a shop located in the centre of town. There, they arrested a 26-year-old woman for prostitution, and a 20-year-old Indian national for patronising a prostitute. They also arrested a 46-year-old businesswoman for promoting prostitution. The businesswoman maintained a room located at the back of her garment shop for prostitution, according to police officials.

he British, they say, has taught the nations of the world many a thing in government, literature and sport. But some are traditions that verges more on servitude that we continue to have, particularly within the armed forces. The strong prevalence of the orderly system is too glaring an example to miss, of tradition our officers within the military continue to revel in. This was an issue discussed among parliamentarians much before the first democratically elected members took office and the subject continues to excite a heel-clicking debate, at least among the elite members of the society. They do not see the orderly system as a service to ones superior but a form of enslavement. The main idea of having orderlies was initially for upkeep of their officers uniforms, weapons and other apparels and cook for them. While this is certainly indisputable, it is equally true that orderlies are grossly misused. Orderlies in both the army and the police have been seen walking dogs, dropping and picking children of their superiors to and from schools, guarding orchards, going door to door selling milk and cheese, helping at construction sites to even washing clothes sometimes. These are the list of jobs that expanded over the years from what was earlier expected of them, which is why today, officers in armed forces are envied by mothers, both working and those at home, for whom finding a maid has become as difficult as trying to feel for a pin on the floor blindfolded. The police, following its chiefs decision, had initially decided on removal of such a system, but today there seems to be some sort of confusion between officials within the police and its parent ministry. While police officials claim they decided to make do without the orderlies, home minister feels absence of such a system would compromise the officers performance. The matter, it is said, would have to be discussed with the finance ministry officials and work out the cost of having or absence of orderlies. Well what about the cost of the loss or lowering of an armed personnels self-esteem from their employment for any demeaning and humiliating task. The relationship between an officer and his or her orderly is supposed to symbolise trust, respect and interdependence, the foundations of relations between the leaders and the led. That will perhaps only be realised during most testing of times.

A monetary and psychological problem


Economists believe that the root causes of inflation are monetary in particular when the government permits an excessive growth of supply of money in circulation beyond what is needed to finance the volume of transactions produced in the economy. That is exactly what happened in our economy over the past four years, in an economy that hardly produces anything that it consumes. The government promised to launch Bhutan into hyperdevelopment and jumped into the 20,00MW hydropower development programme that uses 10 times more money than our entire GDP. They introduced three private banks whose only goal was to compete with each other like cheap retailers vying for the most clients by offering the easiest loans. One of them gave loans without collateral and not checking where the money was actually going (cars mostly.) The central bank woke up after the crisis and then threw out a bunch of panicky measures that only made the rupee crunch worse. During the past 5 years, financial analysts have been simply shocked at the amount of money dished out as loans. It seems that if you had a plot of land then you had a right to a loan and the banks had no obligation to study the overall economy before giving out more. Until a few months before the financial crisis, the banks were still arguing that there is demand for more loans so why not give it. This is retail logic that any central banker should have shut down with a power point presentation that proved why it was idiotic logic. Not everything is financial of course when it comes to money. A lot of it is psychological and based on changing mindsets. In Thimphu, when the structure plan was made, the planners did not want to pay any compensation to farmers. So they simply stopped all farmers from growing anything on their land while they finalised the structure plan and local area plans. And then they took about 10 years to finalise the plans while the farmers were expected to survive without a means to livelihood. The farmers were flooded by people with money and civil servants with confidential information to buy their land at rates they couldnt imagine. So the mindsets began to change from being a hardworking subsistence farmer to becoming a malik a building owner , using the free flowing credit from the banks. With this the expectations and aspirations of the Bhutanese people began to rise. And with the free credit from the banks, all aspirations could be met. From the building owner who wants a certain amount as rent, to the shop keeper who wants to add a certain amount as profit margin, to the consumer who wants to have such and such luxury or consumption item without negotiating or bargaining. It has created an upward spiral that is simply not sustainable. Kuenselonline

Exporters beset by a trio of problems

Despite some of the buyers from Bangladesh agreeing to a hike in the price of the fruit that prevented Bhutanese exporters from selling their apples last week, this time, it was the quality of the fruit that has impeded the transaction from taking off.

Most exporters said the apples were not ripe enough to meet the standard Bhutan agriculture and food regulatory authority (BAFRA) has set. The authority had said the apple should be fully ripened, one of the specifications being the fruit should be red in colour. Exporters said most apples the farmers sold to them were not. They also said some of the clients from Bangladesh, who objected to hike in floor price of apple from USD 700 to USD 750, were willing to import, because of a major demand back home, fueled by the ongoing Eid festival. export quality remained low, it would be difficult to sell the fruit, once the festival ended on August 18. One of the exporters, Nim Tshering, said he has requested his client to buy at a new rate for now, and would consider once the festival ended. He plans to manage with good apples they have received so far, and start exporting in a day or two. Meanwhile, a few exporters said, with financial institutions discontinuing export packaging credit (EPC), a type of loan availed to help buy apples from the farmers, their business would be hampered. Gaugay Dorji, an exporter, said, without the loan, they would be unable to cover the credit or pay advance to the farmers. I have resources enough to export only two truckloads of apples, another exporter said. My business ends after that. However, the Bhutan Export association (BEA) general secretary Yeshi Tshering said they were trying to find every possible way to solve

the issue. Financial institutions informed that they had to cancel the loan because of liquidity crunch theyre facing, he said. Looks like only government intervention will keep the export business going. Records with BEA show an amount of USD 17.7M was generated from export of apples between 2001 to 2011. Last year alone, with the export of about 3285.76 metric tonnes of apples, USD 2.4M was earned.

Woman charged for possession of hashish


Samdrupjongkhar police charged to court a 36-year-old women of Khospey village, Khaling, Trashigang on July 31 in possession of a controlled substance. She was arrested at the Samdrupjongkhar border gate, while entering from Assam on the afternoon of July 24. The 36-year-old woman was in possession of 80 grams of hashish, a tar-like extract of the cannabis plant, people normally smoked with tobacco. She was also in possession of six pieces of Flake cigarettes. In her statement to police the woman had said she visited the Mela bazar to buy cigarettes and that she had brought the marijuana from her village in Khaling. She came to Samdrupjongkhar on July 23 to sell 50 bags of potato at the auction yard, Samdrupjongkhar police officials said. The women was sent on bail yesterday.

A single mother faces lifes challenges with her chin up

In a home in Changshingpeg, about half a kilometre from Mongar town, is a small makeshift house, home to a family of seven, including two special children.

DISABILITY
The house, constructed on a slope, is a line of small rooms with smoke-blackened bamboo mats, tarpaulin and flattened tar drums as walls and roof. Last Saturday, during lunchtime, Drupthop Tashi, 19, emerged from the hut dragging himself with his right hand. His other limbs were dysfunctional. At his heels was his 16-year old sister, Dawa Dema, who suffered a more severe disability than him. The two were coming out to wait for their sister, who was studying in Class X, and who cooked for them and cleaned them. Except for an occasional vehicle roaring by, and flies buzzing around, the home was quiet.

Their mother, Tashi Pema from Dremitse, had left for work, doing odd jobs for businessmen and a recycling agent. During weekends she sells vegetables in Mongar market. The two special children get Nu 800 each from Tarayana foundation. The mother earns about Nu 4,000 a month, but has loan with a financial institution. Drupthob Tashi can speak and understand, while Dawa Dema cannot. Both have been disabled since birth. But she has a keen listening sense, and its her mothers voice, which gets her excited. She can hear me from the road, and is usually waiting for me, Tashi Pema, 40, the mother of the special children, said. When the other three siblings, all students, are out including their mother, Drupthop looks after his sister.

In the first four years of the 10th plan only 33.18km of monsoon restoration works were carried out and for the financial year 2011-12, 19.31km road was restored in Sarpang and Wangduephodrang. Road officials said of the proposed road budget for every financial year, more than 40 percent was slashed. For instance, a road official said, just for road maintenance in 2011-12, the fund required was Nu 180M of which the government approved only about Nu 120M. Weve to manage everything from the insufficient budget despite increases in labour wage, cost of materials and other construction materials, a road official said. Last year labour ministry revised wage rates for the national workforce, which increased between 60 and 65 percent. Workers are entitled to Nu 600 a month if posted to worksites at altitudes above 2,400 metres, an allowance for having to work under extreme weather conditions and absence of nearby health and education facilities. Roads departments chief engineer Tshering Wangdi said they had to prioritise works depending on, which were the most critical, with preference to spill over works from previous financial years. Everything is tight, he said. When roads are neglected for long because of budget shortage then by the time the budget is through, forget maintenance, it requires reconstruction. Within the 10th plan, contrary to their target of restoring 1,000km road in the country, roads officials, as of June 2012, through their eight field divisions of Thimphu, Trongsa, Trashigang, Sarpang, Lobesa, Lingmithang, Zhemgang and Phuentsholing have been able to reinstate 675km. During the first four years of the 10th plan, 607.99km road resurfacing works were carried out. For the 2011-2012 financial year, Nu 3.4B has been set aside for road budget (10 percent of national budget). Of that about Nu 0.6B was for road resurfacing, improvement and maintenance. Road construction was provided about Nu 0.2B and Nu 0.6B for construction of bridges. For general financing of roads, the road Act states that in addition to the annual national budget, construction, repair and maintenance of roads and bridges may be funded by specific sources of revenue the government may designate. They may also mobilise international and domestic loans, grants and aids for funding of road projects.
