EX-PARTE TEMPORARY RESTRAINING ORDER

day of August, 2012, came on to be heard the application of Plaintiffs
Judge Timoteo F. Gonzalez, Judge David C. Indorf, Judge Ruth C. Logan and Judge Cheryl D.
Williams ("Plaintiffs") for an Ex-Parte Temporary Restraining Order against Mayor Mike
Rawl ings and the Members of the Dallas City Council ("Defendants" or "Dallas City Council");
Pl aintiffs appeared before the Court by and through their attorney of record;
Defendant s did not appear befor e the Court.
The Court considered the Plaint iffs' Application for Ex-Parte Temporary Restraining
Order. From the facts set forth in the App lication, it appears to the Court that Plaintiffs are
enti tled to an Ex-Parte Temporar y Restraining Order, in that the Judges will suffer a probable,
imminent and irrep arable injury if, as they reasonably anticipate, the Defendants publish the

results of the vote taken by the City Council Defendants on August 22, 2012, or take any further
action in furtherance of the vote taken on August 22,2012, including but not limited to the
swearing in of the proposed nominees voted on by Defendants on August 22,2012. Based on
information and belief, the Judges believe the publication of the vote will take place imminently,
thereby causing irreparable harm because the ultra vires acts of the City Council Defendants.
This Ex-Parte Temporary Restraining Order is necessary to avoid any further attempts by
Defendants to continue to violate the law.
Based on the foregoing findings, IT IS THEREFORE ORDERED that:
The City Council Defendants, and others in active concert with them, will be restrained
from taking any action to publish the results of the vote taken by the City Council Defendants on
August 22, 2012, including but not limited to the swearing in of the proposed nominees voted in
illegally on August 22, 2012.

IT IS FURTHER ORDERED that Plaintiffs application for temporary injunction be heard
before this Court on l D ,2012 at -L: 00 o'clock -f2-.m. in the

courtroom of Dallas County, Texas floor, 600 Commerce
Street, Dallas, Texas 75202.
The Clerk of the above entitled Court shall forthwith, on the filing by Plaintiffs of the
hereafter required bond, and on approving the same, according to the law, issue a Temporary
Restraining Order in conformity with the law and terms of this Order.
THIS ORDER shall not be effective until Plaintiffs execute and file with the clerk a bond
in conformity with the law, in the amount of S ;;( 00. 00
