lic church called Robredo “a
beacon of hope for the nation,”
and Robredo’s grieving wife,
Leonora, said they were dev-
astated by his death but “he is
home now, and the cheers we
heard from the streets were
enough to show that his efforts
made their mark.”

and a father. The country lost
a faithful servant and leader.
I have lost a brother in my of-
ficial family, and a true friend,”

day promised to distribute the
4,915.75-hectare Hacienda Lu-
isita to 6,296 farmer-beneficia-
ries in May 2013.

farm workers after the comple-
tion of a final master list, a land
survey by licensed geodetic
engineers, an audit of books of
Hacienda Luisita Inc. and Cen-

Pump prices up again
THE oil companies on Tuesday
raised pump prices by as much as
P0.75 per liter to reflect the higher
oil prices in the world market as a
result of the tensions in the Middle
East, expectations of Europe’s re-
covery from its debt crisis, and high
demand in Asia.
It was the fourth upward price
adjustment this month.

He praised Robredo for be-
ing “a trailblazer” and said “he
has proven that one can suc-
ceed in politics without becom-
ing a traditional politician.”

politics, but Jesse showed good
manners in dealing with people
who have shown him ill will,”
Aquino said. “With him what
you see is what you get.”
As Robredo was laid to rest
at the Eternal Garden cemetery,
fire stations all over the country
sounded their sirens and about
60 coast guard ships moored in
various stations across the land
blew their horns to pay tribute
to the late Secretary.
After the 19-gun salute at the
Basilica, a band played the nation-
al anthem as Robredo’s remains
were brought out and the funeral
cortege proceeded to the Funeraria
Imperial for cremation.
Aquino, together with Ro-
bredo’s family and members of
he Cabinet, followed the hearse
for the 40-minute walk to the
crematorium. A three-volley
salute was rendered by the Phil-
ippine National Police, while a
bugler played the taps.
President Aquino then pre-
sented a folded national flag to
Robredo’s wife Leonora and
three daughters Aika, Janine
and Jillian.
As the fire stations blew their
sirens, Bureau of Fire Protection
chief Ruben Bearis told reporters
in Manila: “We will keep him in
our hearts. We will emulate his
works and ideals ... for the best
interest of public service.”

and was described in the results as

Asked about Cavite Rep. Joseph
Emilio Abaya, who is being pushed
by some sectors to assume Ro-
bredo’s post, Enrile said he did not
know him.
“But I know Senator Lacson
quite well enough,” he said.
“I think if they will tap Senator
Lacson to head that department,
he will do very well because he is
from the Judiciary or not, they have
to deal with the new chief justice,”
he added.
Lacierda said the best person to
defend Sereno from any further
criticism would be sthe spokesman
of the Supreme Court, not Mala-
canang.
But he also appealed to critics to
give Sereno a chance.
“Let’s give Chief Justice Sereno a
chance to prove herself. We’re opti-
mistic that she will be up to the job
in implementing and institutionaliz-
ing reforms in the Judiciary,” Laci-
erda said.
Lacierda said.
“I think the critics would have a
better way of channeling their frus-
tration instead of criticizing anony-
mously Chief Justice Sereno. The
best thing they can do is to work
towards helping Chief Justice
Sereno implement the reforms
that are badly needed in the Judi-
ciary,” he added.
A Palace ally in the Senate, Sena-
tor Franklin Drilon, also came to the
chief justice’s defense, saying disen-
chantment among the other justices
who were bypassed for the position

Recent reports said a wit-
ness, who was identified only
as “Honeybee,” had executed an
affidavit claiming that Rustom
Puro, a ranking member of the
RPA-ABB and the husband of
her cousin, told her that he and
Marvin Salve were contracted
by the group of vice governor
Genaro Alvarez, his son Ilog
Mayor John Paul Alvarez and
Tabujara, to assassinate Arles.
The oil firms last week raised
pump prices by P1.50 per liter
of kerosene, P1.40 per liter of
diesel, P1.30 per liter of regular
gasoline, and P1.20 per liter of
unleaded and premium gasoline.
On August 7, the oil firms
raised prices by P0.80 per liter
of premium, unleaded and regu-
lar gasoline, diesel by P0.40 and
kerosene by P0.30.
The oil firms were supposed to
raise prices a week after Aug. 7,
but decided to freeze prices for
one week in the areas flooded by
monsoon rain.

laws and conditions of this country.”

he did not think the President
had made any decision yet on
who to appoint to Robredo’s post
because they were still grieving
over his death.
“But I believe that the vacancy
should immediately be filled and
the President should be able to
make his decision in the next two

Drilon also echoed the Pal-
ace view that Sereno would have
enough time – as much as 18 years
until her retirement at 70 – to carry

be turned around slowly, because an
abrupt change may cause the Judi-
cial ship to capsize,” Drilon said
“This is a golden opportunity
presented by the President by
making this game-changing ap-
pointment to enable the head
of the judiciary to institute re-
forms,” he added.
Senate President Juan Ponce En-
rile, on the other hand, said he hoped
Sereno would improve the adminis-
tration of justice.
In the House, Zambales Rep. Mila-
gros Magsaysay said she believed
that Sereno will restore the faith of
the public in the Supreme Court, after
the impeachment of her predecessor,
Chief Justice Renato Corona.

Tupas, who led the House pros-
ecution team in the Corona trial
added: “Of course we will seriously
pursue judicial reforms. Otherwise,
everything we fought for during
the impeachment would be put to
waste.”

need a lot of “emotional quotient”
to withstand the pressure of being
the chief justice.

pretation.”
“Wisdom seeks me to return the
Supreme Court to its days of digni-
fied silence--when its justices were
heard when read thru their writings,
and when [the] actions of the Court
were best seen in their collective
resolutions,” Sereno said.
The “judiciary is not a political
branch of government.”

justices was crucial for the Court to
deliver its mandate “to be deliber-
ate, accurate, sober and carefully
balanced before arriving at its deci-
sions and in the presentation of such
decisions.”

status of both funds, and how
these were spent.
Sereno said she intended to just
meet various units in the high court
to address the concerns of the me-
dia and the public regarding infor-
mation from the high court.
“We will seek ways on how to
best respond to the needs of media
for accurate and timely informa-
tion,” she said.
Her predecessor Corona had
been visible in the media during his
appointment in 2010 and before he
was removed from office in May.
He visited radio and TV stations
to explain his “midnight appoint-
ment” when he assumed his post
and during his impeachment trial.
The SC has a spokesperson that
is tasked to deal with the media and
who is co-terminus with the chief
justice. Sereno has yet to name a
new spokesperson as she extended

A TECHNOLOGY official on Tues-

day defended his department’s P10-
billion proposed allocation for 2013,
saying that a portion of the budget will
be used to bankroll the compensation
package of weather bureau personnel.
Undersecretary Fortunato dela Pena said the compensation pack-
age would amount to P700 million, thus prompting Rep. Neri Col-
menares to suggest taking the fund from the conditional cash trans-
fer, the poverty alleviation fund.
Dela Pena said the agency needed that much to comply with the
employee-benefits program of the Pag-ASA under the Magna Carta
for Scientists, Engineers, Researchers and other Science and Tech-
nology Personnel in Government. It would defeat the purpose of the
law if the package was not released on time, he said. He also com-
plained that the benefits of the DOTC employees are often delayed
or not given at all because the Budget department would want the
agency to source the funds from savings.
Colmenares, during the House committee hearing conducted
by the House committee on appropriations, said much is expected
from DOST.
“We always have typhoons and you are demanded to give weath-
er reports by the hour, respond to disasters, among others. Why
are these benefits up to DBM’s discretion when it is provided by
law? It was made into law so that these benefits will be automati-
cally provided,” Colmenares told the panel with Rep. Mel Senen
Sarmiento presiding.
Colmenares sad that instead of forcing the agency to sub-
sidize its employees’ benefits from its savings, Congress
should realign the funding for the agency’s funding needs. He
pointed to the Aquino administration’s dole out program as a
possible source of fund.
“Savings should not be used for the benefits,” he said.

RH bill cannot be contested until enacted, says Lagman IN BRIEF

PROPONENTS of the controversial
reproductive health bill on Tuesday
said that the measure cannot be con-
tested until approved by Congress.
Albay Rep. Edcel Lagman, principal
author of House Bill 4244, or the Re-
sponsible Parenthood or Reproductive
Health, said there could be no judicial
scrutiny by the Supreme Court of the
constitutionality of the RH bill until it
is enacted into law.
“If the bishops and their lay allies are
determined to challenge the constitution-
ality of the controversial measure, then
they should stop hindering the bill from
becoming a statute,” Lagman said.
“Once the RH bill becomes a law,
the RH advocates welcome any ques-
tion on its constitutionality.”
Meanwhile, the Catholic church
again called on the faithful to reject the
RH bill, saying that the family planning
bill is “a form of moral corruption.”
In a pastoral letter, the Catholic Bish-
ops Conference of the Philippines said
that it was almost 20 years ago that the
church made a prophetic moral judg-
ment on political leadership.
“With this prophetic declaration we
believe that we somehow significantly
helped open the door for EDSA I and a
window of political integrity.”
Today we come to a new national
crossroads and we now have to make a
similar moral choice. Our President ral-
lied the country with the election cry,
“Kung walang corrupt walang mahirap.”
As religious leaders we believe that there
is a greater form of corruption, namely,
moral corruption which is really the root
of all corruption. On the present issue, it
would be morally corrupt to disregard
the moral implications of the RH bill.
As religious leaders, we have unani-
mously made the moral judgment—to
reject the RH agenda and to choose life.
”We call for a fundamental transfor-
mation of our attitudes and behavior to-
wards all human life especially the most
defenseless, namely, human life being
formed or being conceived. The cheap-
ness with which many seem to consider
human life is a great bane to our reli-
gious-oriented nation” the letter said.
“We are pro-life. We must defend
human life from the moment of con-
ception or fertilization up to its natural
end,” the CBCP said.
Lagman, however, said he is certain that
the measure would be able to pass the test
of constitutionality, such as the constitu-
tional provision for the State to protect “the
life of the unborn from conception.”
This provision, Lagman said, is in-
tended to prevent both the Congress
and the Supreme Court from legalizing
abortion.
Lagman also maintained that the RH
bill is against abortion as it provides that
abortion is illegal and punishable. He
also stressed that the bill does not en-
dorse any method of family planning.
“The function of contraceptives is to
avoid pregnancy, either by preventing a
woman from ovulating or the sperm from
reaching the egg, which in either case there
is no fertilization and no fetus to abort.
“It is for this reason that contracep-
tives like pills, condoms, injectables
and the IUD are medically certified as
non-abortive or not abortifacients and
are approved by the Food and Drug
Administration,” Lagman added.
He said neither the Constitution nor
any law prohibits the manufacture, dis-
tribution and use of contraceptives.
Lagman said the RH bill is anti-abortion
as “the proper and regular use of medically
safe, legal and effective contraceptives re-
duces the incidence of abortion by as much
as 85 percent according to credible scien-
tific and empirical studies.”
According to Lagman, the proposal
in the Constitutional Commission to
include in the Bill of Rights a provi-
sion that “the right to life extends to the
fertilized ovum” was not approved.
“This original proposal was not
constitutionalized because it is clear
that the fertilized ovum has no vi-
able life until it is implanted in the
woman’s uterus, which is the start of
conception or pregnancy,” Lagman

EVEN a cursory examination
of the members of Congress
who gained their seats as party-
list representatives will reveal
how absurd, ineffectual and
politically bankrupt our system
is in guaranteeing minority
representation.
The party-list system was put in
place by the framers of the 1987
Constitution, who envisioned
it as a mechanism by which the
voiceless, under-represented
and marginalized groups such
as the poor, laborers, peasants
and cultural minorities would be
guaranteed a voice in Congress.
Toward this goal, the
Constitution set aside 20 percent
Party-list abuse
of the seats in the House of
Representatives to these so-called
marginalized groups and made it
easier for them to win election.
The clash between theory and
reality, however, soon became
apparent as politicians, television
evangelists and other unsavory
characters abused the party-list
system as a quick and dirty way to
gain a congressional seat. A perfect
example of this abuse was the
election of former Pampanga Rep.
Juan Miguel Arroyo, the son of the
former President Gloria Arroyo, as
a representative of tricycle drivers
and security guards.
Earlier this month, the anti-
fraud group Kontra Daya urged

to purge 30 of the 54 incumbent
party-list groups and 10 new
applicants disqualified for
having done nothing for their

loves a great funeral. And why
wouldn’t he, when death has brought
his family such great fortune?
As Jesse Robredo’s wife herself
said, upon witnessing the pomp and
pageantry orchestrated by the Aquino
administration for the burial of her
husband: “Sobra-sobra na ito.” Indeed,
Leni Robredo plaintively remarked
that the late Cabinet secretary would
probably be the first to shun the
honors so lavishly bestowed upon him
by the President and
his officials—the
same people who,
ironically, never It’s as if Aquino

which is why, his grieving spokesmen
say, he cannot be bothered to appoint
a replacement for Robredo. (He
could, however, name his schoolmate,
Maria Lourdes Sereno, chief justice
of the Supreme Court while deep in
bereavement.)
The entire Cabinet had followed
suit. And like many of them did when
they were still serving in the Arroyo
Cabinet, they burst into song in honor
of Robredo, belting out a karaoke
version of “Betcha By Golly Wow”
beside their dead comrade’s coffin.
There was the conferment of the
Legion of Honor, the 19-gun salute,
the water cannons, the policemen
lining either side of Roxas Boulevard,
the burial at Libingan ng mga Bayani
(thankfully declined by Robredo’s
family). There was the non-stop
serial eulogizing by practically every
Cabinet member, whose words of
comfort were—I’m not making this
up—posted verbatim, separately and
in full by a fawning big-media outlet.
Guilt feelings on the part of Aquino
(who sent Robredo on the fateful
errand that led to his death in a plane
crash, hours after he gave a speech
that Aquino had agreed to deliver)
cannot adequately explain the mega-
production. It was as if, as one wag
said, the Aquino administration would
not stop until it had renamed the
Philippines the “Republic of Robredo”
in order to fully honor the man.

This, then, is why the overdone
official efforts to sanctify Robredo hit
a sour note, a note that was sustained
until it became a fugue of state-
sanctioned sanctimoniousness: unlike
previous funerals that had swept
Aquino and his mother Cory before
him into power, the posthumous
grieving over the late, great son of
Naga City did not come from the
ground up, rising from the unnamed
masses until those in power could no
longer ignore it.
The assassination of Ninoy Aquino
and the cancer-caused passing
of his wife Cory became popular
and ultimately
unstoppable
expressions of
national mourning
that were not
instigated, funded
or fueled by the
government.
And whether one
believed in what
Ninoy and Cory
stood for or not,
the people did—
and the people, not
the
mourned
government,
their
deaths.
It was as if Noynoy Aquino
reenacted the funerals of his parents
using Robredo as a substitute because
he could not trust the people to show
enough grief that would sufficiently
give honor to the dead man. And so he
had to use all the powers and resources
at his command to ensure that Robredo
became the first canonized saint of his
administration.
(It is laughable to expect Aquino to
call for the same state honors given to
Gloria Macapagal Arroyo, for instance,
if she dies because this administration
will not allow her to go abroad for
treatment. Even if Aquino can also
conceivably feel guilty if Arroyo dies
because he let it happen—just like
he could deservedly be blamed for
Robredo’s death—the most that anyone
can reasonably expect is a perfunctory
statement of meaningless official
“grief” from his interchangeable palace
spokesmen if Arroyo dies.)
Meanwhile, as many have noted,
who’s minding the store while all this
is going on? Who’s watching while
the oil companies keep raising their
prices, to cite just one example of
opportunistic oppression of the people
that Robredo loved while all this
mourning is going on?
But Aquino cannot be dissuaded
from mourning Robredo, nearly two
weeks since his unloved (by his boss
and his colleagues) subordinate was
reported missing. And the President
has to repeatedly—and belatedly—
extol the virtues of a man whom he
never trusted enough to head up an
entire department when he was alive.
If he were alive today, Robredo
would probably be tempted to apply
his slippers on the faces of his official
mourners. Except that, because he
was such a great and humble man, he
probably never would.
Which shall perish and which shall live?

FIRST THINGS FIRST
WITHOUT doubt, Senate Majority
Leader Vicente Sotto III scored high
in his turno en contra speech against
the reproductive health bill. But his
opponents struck back quickly by
talking about him rather than about the
bill. They scoffed at his story about
the doctor blaming the death of his five-
month-old son on the contraceptive
pill which had failed to prevent his
wife’s pregnancy, and accused him of
plagiarizing a paragraph in his speech
from an American blogger.
Soon enough, public attention was no
longer on the fundamentally flawed bill
but rather on Sotto’s alleged plagiarism.
The debate shifted from the facts of the
case to the senator’s alleged personal
flaws. From argumentum ad rem to
argumentum ad hominem.
However, a cursory reading of Sotto’s
speech will show that every paragraph
that quotes any research study or opinion
is properly attributed to its source. The
purportedly plagiarized text, downloaded
from the Internet, is attributed. But it
is attributed to Dr. Natasha Campbell-
McBride, MD, the original source of the
material, rather than to the blogger, who
says the material is not a direct quote
from McBride, but her own paraphrase of
what McBride says.
It is a simple case of erroneous
attribution. There was no attempt on
Sotto’s part to pass it off as his own.
Hector A. Villacorta, Sotto’s chief of
staff, says that as soon as he realized the
misattribution, he emailed the blogger
to acknowledge and explain the error.
He thought all along she was also
against the bill. But she turned out to be
a big RH supporter. That was the real
mistake, the real crime.
But there is no plagiarism at all.
Talking of plagiarism, the entire RH
idea is more than a plagiary. The original
coinage is from the global population
control lobby, which includes the most
powerful foreign governments, the
UN Fund for Population Activities,
International Planned Parenthood
Federation, the world’s biggest supplier
of abortion. Minted by the lobby, it was
simply passed on to its “authors,” who
were more than eager to adopt it as their
own.
Its ultimate purpose, never openly
admitted, is not just to create a
permanent market for contraceptives
and sterilization agents and prevent the
poor from breeding. It is to create a
secular, extremely individualistic, and
hedonistic world in which the natural
family, religion and morality have all
been outlawed; where sexual pleasure
has become the central purpose of
human life, and adultery, fornication,
sodomy, and other forms of sexual
perversion have become the norm.
In a less permissive age, it would have
been characterized as a crime against
humanity, not just against Filipinos.
But President Aquino thinks it could
be packaged and sold as “responsible
parenthood.” It is not even an original
construct. It is merely paganism redux.
In my friend Allan Carlson’s
highly illuminating book, “Godly
Seed,” we see that pervasive sexual
disorder preceded the rise of Christian
civilization. In the swollen city of
Rome, writes Carlson, homosexuality
emerged as an open practice. Same-sex
marriage might have occurred, although
never taken seriously in law; infanticide
and abortion were regularly practiced.
All this caused the Roman birth
rate to plummet. In 18 B.C. Caesar
Augustus enacted laws to punish
adultery, penalize childlessness, and
confer benefits on families with three or
more children. These “Augustan Laws”
were said to have slowed the Empire’s
demoralization for at least a hundred
years. Thereafter, the old trend returned,
Carlson writes.
Early Christianity saw the rise of
the Gnostics. The Gnostics claimed
to have a special “gnosis,” a “secret
knowledge” denied to ordinary
Christians. They rejected marriage as
a child-centered institution; and they
scorned procreation.
This is what the RH bill is all about.
Fast forward to the 19th century. From
1871 to1887, Prussia’s Iron Chancellor
Otto von Bismarck instituted “reforms”
against the Catholic Church and the
family. Kulturkampf, the scientist-social
reformer Rudolph Virchow called it.

In 1871, Bismarck abolished the
Catholic bureau of worship, and put
Protestants in charge of government-
Church relations. Then he passed the
Pulpit Law which severely penalized
criticism of the government by the
clergy. In 1872, he placed all schools
under state control. The Jesuits (and later
other religious orders) were expelled or
interned. Then he broke off diplomatic
relations with the Vatican.
In 1873, Bismarck tried to finally
crush the hierarchy and subject the
Church to total state control. He tried
to organize his own Catholic group to
try to replace the hierarchy. In 1875,
he suspended all grants to dioceses, and
dissolved all religious orders, except
those involved in nursing and social
work. He confiscated Church properties
and made civil marriage obligatory.
Bismarck is dead, but the Church lives.
What we are seeing today may be no
different from what is now part of our long
history. We have all the little Bismarcks
trying to establish their own kulturkampfs.
But as the deepening twilight descends upon
the big imperial powers that once dominated
the Western world, we can more or less say
which institutions will stay, and which will
wither away.

I get this text from friends and
acquaintances who say they have had
enough of all the paeans, accolades and
honors heaped upon the late Interior
and Local Government Secretary
Jesse Robredo.
There is no doubt that the DILG
Secretary deserves every tribute made
to him. But including his life story in
the curriculum of public schools?
Some sectors are even making a
joke out of the tragedy by suggesting
that Leni Robredo, the late secretary’s
wife, run for the Senate and become the
Cory Aquino of the next generation.
Good thing Mrs. Robredo just laughed
this suggestion off.
The only accolade now missing is
a monument. In this connection, my
colleague from another newspaper,

height of hypocrisy. We all know that
Robredo was not even made a full-
fledged secretary until recently. My
gulay, he was not even in charge of the
Philippine National Police!

All of us acknowledge that newly
appointed Chief Justice Ma. Lourdes
Sereno must be given the chance to
prove her independence. She must
show that she is not just another
lackey of the President. She must
also know that she faces the great
task of restoring the public’s faith and
confidence in the Judiciary.
Ask any justice of the Supreme
Court and he or she will tell you that
it would take at least three years to
grasp all the facets of the law and have
a working knowledge of the Judiciary.
This is why traditionally, the most
senior associate justice in named chief
justice. This is the biggest setback of
Sereno.
The most immediate test of her
leadership is asserting the fiscal
autonomy of the Supreme Court.
Malacañang and Congress imposed
stringent conditions on the high court
for it to use its budget to hire employees
for 5,167 positions including about
500 judges. What the Supreme Court
saves would revert to the national
treasury. Such is clearly a violation of
judicial independence.
Another test would be the release
of the Statements of Assets, Liabilities
and Net Worth of all members of the
Supreme Court. Sereno herself has

IT IS hard to find rhyme and reason
when a good man leaves us—in a tragic
circumstance no less.
I myself was so affected that I was
left shocked and was in denial these past
few days. These are times when you are
tempted to question God’s motives for
removing from the Aquino administration
the one good man who is most honest and
committed to do good in areas of reform
and honesty in governance.
Then it dawned on me that God must
have precisely wanted to end Interior
Secretary Jesse M. Robredo’s life in
a blaze of glory in the watery deep of
Masbate in order to make Filipinos realize
the kind of people we are inside and can
be. The kind of people we DESERVE to
have in government!
The Supreme Being, in His wondrous
ways, may have wanted to show us
that there are still people like Secretary
Robredo who can remain long in office
and not enrich himself and his family; that

Sometime in February this year,
I commented on the move of the
Commission on Higher Education
to close two flagship courses of the
Philippine Maritime Institute, the
pioneering and oldest maritime school
in the country.
School officials pointed out that
the order affecting the courses of
Bachelor of Science in Maritime
Engineering and Bachelor of Science
in Marine Engineering in the middle
of the school year was contrary to the
CHED’s own Manual of Regulations
of Private Higher Educational
Institutions. PMI also stressed that at
the time the closure order was issued,
the school had already addressed the
concerns raised during inspections by
CHED.
PMA has filed before the Regional
Trial Court of Quezon City a petition
for annulment with prayer for a
TRO or Preliminary Injunction. This
was subsequently granted. With
this development, CHED field a
Petition for Certiorari with prayer
for a Temporary Restraining Order
and injunction
with the Court
of Appeals,
alleging that
Judge Rena

committed
grave abuse
of discretion
in issuing the
injunction.
After several
hearings, which
kept being reset
on motions submitted by CHED, PMI
filed this month a motion to declare the
commission in default for failure to
file an answer within the time allowed
by the Court.
In effect, until such time that the
Appellate Court makes a ruling on
PMI’s motion, the TRO or Preliminary
Injunction earlier approved by the
Court of Appeals on CHED’s closure
order remains in effect. My gulay, that
should be clear enough even to non-
lawyers!
Despite this, however, there are
reports that some CHED personnel
continue to insist that PMI’s flagship
courses have been ordered closed.
This is the reply supposedly given to
queries by students and their parents
about the status of the closure order.
The question remains: What, really,
is CHED’s beef with PMI that it
seems determined to bear down on the
pioneer and largest maritime school
in the country? Judging by its moves,
the commission appears fixated about
running the school down the found.

In connection with the ongoing
controversy between the Bases
Conversion Development Authority
and Camp John Hay Development
Corp., lessee of 247 hectares of Camp
John Hay in Baguio City, which is
now under arbitration by the courts, it
would do well for President Aquino to
have BCDA President Arnel Casanova
replaced by Chairman Tong Payumo.
Payumo is the rightful BCDA president
under the law since Casanova is just a
usurper.
The law is clear in this respect,
and if Casanova gets replaced under
the law, all his actions past and
present would be deemed illegal and
without basis.
Let us elect Jesse Robredos in the May 2013 elections
government officials are servants who ride
bicycles, ride public buses to go home
and personally sweep the streets; that
government officials can be lowest among
us; and that people can occupy high posts
in government without letting power get
into their heads or affect their love and
loyalty to their spouses and their families.
We would not have known all these
and admired Secretary Robredo for these
traits had he been kicked out from office
or had he left government following non-
confirmation by Congress or through
political infightings. The whole country
would not have known the sterling qualities
of this public servant had he died in his
sleep or in old age.
I myself who had not gotten the honor
of meeting Sec. Robredo, only knew
him for his good work for Naga City
and which won him the coveted Ramon
Magsaysay Awards in 2000. It is only after
his tragic end did I get to know and was
blown away by his humility and his being
truly a man for the little people, much like
the late President Ramon Magsaysay or

CHASING HAPPY
IN 2010, UNAIDS published a report
saying that new infections of HIV and
AIDS have been declining globally. There
are, however, seven countries which
are an aberration. They observed an
incidence increase of more than 25 percent
compared to their 2001 levels. These
seven countries are Armenia, Bangladesh,
Georgia, Kazakhstan, Kyrgyzstan,
Tajikistan—and the Philippines.
Data from the Philippine National
AIDS Council support this. In fact, in
the month of June 2012 alone, there
were 295 new HIV cases recorded, a
66-percent increase from the number
recorded in June 2011. This brings to
1,600 the number of new cases reported
in the first six months of this year.
Ninety-six percent of those infected
this year were male, with a median age
of 28 years.
Since the first case was documented
here in the Philippines in 1984, there
have been 9,964 individuals diagnosed
with HIV. Ninety-two percent were
infected through sexual contact, 4
percent through needle-sharing among
injecting drug users. The balance stands
for mother-to-child transmissions and
absence of information.
The PNAC report adds that
from 2007, there has been a shift
in the predominant trend of sexual
transmission from heterosexual contact
(20 percent) to males having sex with
other males, or MSM (80 percent).
Some may argue that the number of
HIV-infected Filipinos comprises a very
small portion of the total population,
and that there are many other pressing
health problems—or other problems for
that matter—that must first be addressed
before this.
But anything that spreads this fast is
Libor’s trillion-dollar question

The global investigation into the
manipulation of Libor has so far done
a good job of exposing how bankers
corrupted one of the world’s most
important financial indicators. Now
authorities need to take a giant step
further: Make banks release the data
needed to determine how much damage
was done and who should bear the most
responsibility.
For those still not familiar with the
London interbank offered rate, it’s an array
of benchmarks designed to provide an
objective assessment of banks’ borrowing
costs—information that is used to set
the payments on hundreds of trillions of
dollars in loans, securities and derivatives
worldwide. The rates are calculated by
asking banks, every workday morning
in London, how much they would pay to
borrow money in 10 currencies and at 15
time periods, from overnight to a year.
Investigators are focusing on two
kinds of manipulation. In one, bankers
submitted false data to push Libor in a
direction that would benefit their own
traders. In the other, bankers intentionally
lowered the reported rates, which are
published daily, to make their institutions’
financial positions look better than they
really were. In June, for example, Barclays
Plc paid about $450 million in fines after
confessing that, during the 2008 financial
crisis, it lowered its quotes below its true
borrowing rates to keep them in line with
those of other banks, which Barclays
thought were fudging even more.
Measuring shortfall
How long the lying went on, and how
systematic it was, matters a lot. If, for
example, underreporting caused Libor to
be artificially depressed by 0.1 percentage
point for only a few months, payments
on more than $300 trillion in mortgages,
corporate bonds and derivatives tied to
Zamboanga’s Mayor Cesar C. Climaco.
It is for this reason that his family is
so at peace with his kind of death and is
not blaming anyone for it. In his lifetime,
Secretary Robredo had accomplished
thrice more than his contemporaries in
local government or in the Cabinet who
may live for a hundred but may never
gain the respect, love and admiration now
showered on Robredo. Dying a violent
death is just an icing in the cake. A bonus.
It is perfect ending for a perfect brand
of public service.
In his tragic and dramatic death, Secretary
Robredo had thus thrown us the challenge to
raise the bar of public service. To give justice
to his death, we are called upon to look for
his traits and brand of public service in all
politicians who are running for office in the
2013 elections. Having seen that we CAN
still have officials like Sec. Jesse serving us,
why should we settle for the dishonest, the
corrupt, the lazy, the arrogant, the abusive,
the unqualified and the stupid?
Ano tayo, cheap (Are we cheap)?
Sec. Jesse has already shown us how true

cause for alarm. In 2000, the Philippines
along with 192 other nations, signed
up for the Millennium Development
Goals, a set of eight time-bound goals
that sought to eradicate poverty. MDG
6 deals with the reversal of the spread
of HIV and AIDS and the achievement
of universal access to treatment by
the year 2015 (the other aspect is the
containment of malaria).
That reckoning date is three years
away and there has been evidence that the
Philippines has been making progress in
the other goals. For MDG 6, however,
performance has been bad. Not only has
the country not been able to decrease the
number of new cases, or slow the growth
of new ones. The number of new cases
has been getting bigger than ever, with
certain at-risk populations becoming
more vulnerable than before.

How, then, to respond?
Philip Castro, programme officer
for HIV and AIDS of the United
Nations Development Programme,
says his agency has teamed up with
the Local Government Academy of
the Department of the Interior and
Local Government to localize the
government’s response to the menace.
There are of course laws that mandate
a national effort especially for education
and information for prevention of HIV
and AIDS. The AIDS Law of 1998,
which also established the PNAC,
highlighted that issue needed to be seen
as a multi-sectoral issue.
Practically speaking, however,
the central government is hardly in
a position to oversee initiatives at
the grassroots level in all parts of the
country. No less than the late Secretary
of the Interior and Local Government,
Jesse Robredo, in his Message for the
publication “Localizing the HIV and
AIDS response,” acknowledged the
“explosion of the epidemic in recent
years” and said that the problems were
made worse by competing priorities and
lack of capacity.
the benchmark might have fallen short
by about $75 billion or so. If the problem
lasted a few years, the shortfall could be
close to $1 trillion.
Such manipulation would represent
a big gift to payers of Libor, such as
financially stretched US homeowners
whose interest costs on floating-rate
mortgages would have been lower. But
for bond investors, municipalities, hedge
funds and others on the receiving end of
Libor, it would mean major losses. Many
are already trying to recoup suspected
underpayments through litigation.
How much Libor was off, then, could
be a trillion-dollar question. So far,
researchers have managed only partial
estimates. A 2008 Wall Street Journal
analysis suggested that three-month and
six-month US dollar Libor —two of the
most widely used rates —were understated
by an average of about a quarter
percentage point in the first four months
of 2008. A separate study by economists at
the New York Federal Reserve used 2007
to 2009 data on interbank loans made
through the Fed’s wire-transfer system.
It found a smaller average discrepancy,
but estimated that dollar Libor rates could
have been understated by more than 0.2
percentage point in the two weeks after
the bankruptcy of Lehman Brothers
Holdings Inc. in September 2008.
It’s worth noting that the pressures
on banks to understate their borrowing
rates didn’t end with the darkest days
of the financial crisis. Concerns about
their creditworthiness flared up with the
European debt crisis in 2010 and 2011.
In June, Moody’s Investors Service
downgraded a number of banks that
report Libor rates on the grounds that
their trading activities could threaten
their solvency. Big financial institutions
typically borrow $10 or more for every
dollar in equity provided by shareholders,
so managing the market’s perceptions
public service should be like, why should
we settle for less?
Thus, as we mull on the untimely death
of Secretary Robredo, let us not be content
in merely talking about how good he was
and how saddening it is for us to have lost
a public servant like that.
We must all rise up to the occasion and
wake up the Jesse Robredos in each of
us. Like Jesse, we can all be true heroes
and martyrs without running for office or
riding on Piper Seneca planes that plunge
to the Masbate seas at sundown.
Let us use this inherent Robredo potential
to be heroes to help our fellowman regardless
how lofty or lowly our circumstance in life
might be. More importantly, let us wake
up from slumber the Robredo within us
and convert this into a VOTE POWER to
ensure that politicians who don’t possess
the life-giving qualities of Sec. Robredo will
never enter the hallowed halls of the Senate,
Congress and the city and provincial and
municipal halls in the country.

glimpse of the kind of public service we

to treat, and capacity to prevent.
To this day, there is no cure for HIV-
AIDS. Once diagnosed with the virus,
especially if the CD4 level dips below
acceptable limits, a patient must take anti-
retroviral medicines every day for the rest
of his or her life. Treatment, according to
Castro, costs anywhere between P30,000
and P70,000 per person per year—a costly
exercise, and given the increasing number
of infected Filipinos, treatment funds
may sooner than later dry up. Treatment
is mainly provided to patients through
international aid.
A good, parallel approach addresses
prevention, not just as an issue of health
but one of behavior and governance.
Communities need to get past the denial
and discriminatory stage—believing
that only the promiscuous are at risk
and that the disease is a punishment for
their lifestyle. Prevention also does not
begin and end with making condoms
available, for instance. A more crucial
component is education for behavioral
change, because it is a person’s behavior
that allows him or her to place himself
or herself in risky situations.
To effectively respond, Castro
elaborates, an LGU has to have a local
policy (an ordinance), a coordinating
body, a local AIDS plan, a budget,
and active partnership with other
government agencies, civil society
organizations and the community itself.
It would be good to find out how
seriously different local government
units are taking up the challenge to
build capacity in improving their
communities’ fighting chance by
keeping their citizens informed. HIV-
AIDS threatens the most productive
and most promising sectors of our
population. We must not allow faux
conservatism, or plain apathy, to
lead our people to make choices with
irreversible consequences.

Complete picture
To give a more complete picture of the
misbehavior, and to establish what share
of the compensation burden each Libor-
reporting bank should bear, researchers
need access to better data on actual
borrowing costs. If they could get records
of observable transactions, they could
produce an independent estimate of how
much the banks’ Libor quotes were off
on any given day. Such an authoritative
benchmark would have many benefits:
Plaintiffs, for example, could use it to
reach settlements with banks, avoiding
legal wrangling that could weigh on the
financial sector for years.
Good data, though, are hard to find.
The Fed hasn’t made information from
its wire-transfer system public. The Libor
panel banks, for their part, closely guard
information on the interest rates they pay
on actual short-term loans. This is an
odd habit, given that they are supposedly
publishing their borrowing rates in
great detail every day for the purpose of
calculating Libor. If they’re not lying, there
should be no news in the transactions.
It’s up to the authorities investigating
Libor to break the information blockade.
In the US, for example, the Office of
Financial Research, set up by the Dodd-
Frank financial reform act, has the
subpoena power needed to get the data
and the brain power required to crunch
the numbers. Ideally, it would also make
the data public, so independent academics
and journalists could check its work.
Shedding light on the extent of Libor
manipulation is essential to restoring the
market’s integrity. The point of justice,
after all, isn’t only to punish the guilty.
It’s also to establish the truth, so we can
draw the right conclusions, fix what needs
fixing and move on.

Tuesday an ordinance ordering the so-
called “Big Three” oil companies—Chevron
Philippines Inc., Petron Corp. and Pilipinas
Shell Petroleum Corp.—to vacate their premises
in Pandacan district before January 2016.
The council’s spokesman Councilor
Jong Isip said said all the 30 council-
ors, including minority aldermen, who
were present in the session presided by
Vice Mayor Isko Moreno approved Or-
dinance No. 7461.
The ordinance, “An Ordinance
Amending Section 2 Of Ordinance No.
8187,” provides that “owners or op-

Auditors assail Customs’ refunds

P26 billion in 2011, double the

of Representatives’ hearing on
the P8.34-billion budget she is
seeking for her agency.

ted to killing Atty. Ernesto Salunat on
July 22, 2010. The convict claimed
he was paid P100,000 by a former
court judge to do the job,” said Chief
Inspector Andree Camhol in a state-
ment, but withheld the identity of the
judge pending an ongoing investiga-
tion.
Camhol said Laciste revealed that
before he killed Salunat he was de-
tained at the Isabela provincial jail,
but was released by a jailguard, whom
he identified as Judy Celestino, so he
could implement the assassination
plan.
Laciste had been convicted of
killling assistant parole and proba-
tion officer Concepcion Lumanglas in
Isabela and was serving his sentemce
at the New Bilibid Prison when he
supposedly escaped on the same day

A PHYSICIAN and his wife, both
officials of a school based in Rizal
province, were arrested by the
National Bureau of Investigation for
their alleged role in the fatal hazing of
a 16-year old student in 2003.
The couple, Dr. Charlie Crescini and
wife Dr. Eugenia C. Crescini, last resid-
ed at 19 Daniel St., Centerville Homes,
Tandang Sora, Quezon City and were
school officials of Heavenward Chris-
tian School in Rodriguez, Rizal.
The two physicians were held re-
sponsible for the death of Bien Francis
Selva, a 16-year-old male high school
senior who died after he slammed
onto a tree stump during what was
described as an initiation for prospec-
tive counselors of the school.
Five other school officials were
also held liable for Selva’s death: Eliz-
abeth B. Belen, Engr. David C. Calpe,
Clarinda C. Calpe, and Norberto Bon-
doc and Marxlennin B. Belen.
All of the seven suspects were at
large before the Crescini couple were
arrested at their hideout in Bulacan.

NEW YORK—Despite some of the
heartbreak he’s suffered here the last few
years, Roger Federer has always loved
these trips to New York.

“The US Open, for me, was
always, I don’t want to say easy,

for a win that took only 1 hour,
34 minutes.
“It’s a place that brings out the
best in me,’’ Federer said.
With his Wimbledon title and the

this summer, Federer returned to No.
1 for the first time in 25 months.
His first career match against
Young was a predictable affair,
with Young trying to force the
issue by coming to the net and
Federer taking advantage of his
younger competitor’s impatience.
He finished with 27 winners and
24 unforced errors, compared to
17 and 30 for Young.
Young fell to 3-22 on the sea-
son, including a 17-match losing
streak earlier this year.
“It’s a lot of pressure because ob-
viously, I’m going into this match as
a big favorite,’’ Federer said. ‘’But
Donald put up a great fight. He’s had
a rough year and I’m glad to see he’s
playing better.’’
“And for me,’’ Federer said, “it
continues.’’
There were times when it seemed
as if it would never end, most nota-
bly in 2008, when Federer won his
fifth consecutive US Open.
A year later, he was two points
away from No. 6 but Juan Martin
del Potro rallied for a five-set vic-
tory. The last two years, Federer
had a pair of match points against
Novak Djokovic in the semifinals,
but was unable to convert them.
Federer said he re-dedicated him-
self after the last loss. This year, he
comes in as the top seed, but he
considers Djokovic, the defending
champion, to be the favorite.
“It’s where he feels most com-
fortable,’’ Federer said of Djoko-
vic, the No. 2 seed.
Not to say Federer isn’t com-
fortable on the hard courts in
New York, too.
“The distractions are a chal-
lenge—the wind, the humidity,
the early matches, the really late,
late matches,’’ he said. “That takes
some getting used to. But experi-

into battle when they turn 3YO.
That’s the beauty of the system—
horses are run only when they are phys-
ical and mentally ready (at least, this is
what is ideal).

Industry leaders were invited by
Manila Jockey Club chairman and
CEO lawyer Alfonso R. Reyno Jr. to
a multi-sectoral meeting last August
11 at San Lazaro Leisure Park. It was
well-attended and various issues affect-
ing the sport and the business of racing
were discussed.
In addition to the weekly multi-
sectoral meetings held at the Philip-
pine Racing Commission, stakehold-
ers have a multiplicity of venues to
air their opinions, air grievances
and complaints, and talk about mat-
ters that affect their specific interest
groups.
An interesting and timely develop-
ment is the greater cooperation among
horseowners as they seek to obtain the
collective consensus of their members
on different concerns and lobby these
as a united front to Philracom and the
racing clubs.
This was evident at a meeting last
month of the three horseowners’ orga-
nizations—Metropolitan Association
of Race Horse Owners (MARHO),
Philippine Thoroughbred Owners and
Breeders Organization (Philtobo), and
Klub don Juan de Manila (KDJM).
The unified group or “tri-org” (for
want of a better monicker at this
time) has met before, but last month’s
meeting was historic in the level of
rapport and camaraderie among the
gentlemen present.

I should be telling you about George
Young Stribling, a transplanted Ameri-
can, who arrived in the early ‘80s when
he was in his 60s and never returned to
the land of his birth, dying here on Aug.
14 at the age of 95.
He contributed much to the sport,
in particular its conduct, raising it to
higher standards than when he found it.
He meant a lot to us in the racing
community, especially among the jock-
ey colony. I can’t write about him yet,
it’s still too sad.

Eton jumps 29%

the trading of Eton shares after
the company failed to submit the
2011 annual financial statement.
The share price of Eton at that
time closed at P3.53 per share.
The PSE ordered the lifting
of trading suspension after
Eton submitted its 2011 annual
financial statement as well as the
first and second quarter financial
reports.
The jump in the share price of
Eton followed the brisk trading
on the stocks of Tanduay
Holdings Inc., which will
become the mother company of
the property unit.
Tanduay closed at P12.80
Tuesday, after jumping in
early August after the largest

own and hold the assets of its
owner billionaire Lucio Tan.
Tanduay said it was investing

$7-b aircraft deal

PHILIPPINE Airlines and Airbus signed
Tuesday a three-year contract for the de-
livery of 54 aircraft worth $7 billion at list
prices, a deal touted as the biggest in the
country’s aviation history.

were expected to be delivered in
the next three years beginning
2013.
“We hope we should be able
to get these aircraft delivered in
the next three years. Today, we
are buying 54 aircraft and we
are still in talks to buy more.
Our intention is to buy up to
100 aircraft, 26 of those to fly
long-haul. We are buying. It’s
not lease,” Ang told reporters in
a news briefing at the Century
Park Hotel in Manila.
The country’s biggest aircraft
order includes 34 of Airbus’
existing A321 model, 10 of its in-
development A321neo aircraft
and 10 wide-body A330-300s.
PAL plans to use the A330s
to fly to the Middle East and
Australia. “With these aircraft
we will be able to offer more
passengers the best the industry
has to offer across our Asia-
Pacific network. At the same
time, we will benefit from the
low operating costs associated
with new generation aircraft
and the reduced impact on the
environment,” he said.
Deliveries of the aircraft, some
of which will be used by low-
cost affiliate Air Philippines, will
start as early as January. Airlines
usually pay less than the list price
for new planes.
Ang said the deal included
options for more aircraft and talks
were still under way with Boeing
Co. as PAL works on plans to buy
100 planes. Billionaire Lucio Tan
and San Miguel, the carrier’s two
main shareholders, will provide
$1 billion to help fund the fleet
plan, he said earlier.
PAL Holdings Inc., Philippine
Air’s parent, rose 0.7 percent to
P7.15 Tuesday, the highest level
since Aug. 8. The stock gained
17 percent in the past year.
San Miguel, the nation’s largest
company by revenue, agreed to
buy a 49-percent stake in PAL
for $500 million earlier this year,
supporting its goal to increase
sales to P1 trillion by 2016.

June imports accelerated 13.3%

IMPORTS in June rose 13.3 percent
year-on-year, the fastest in 10 months, on
the back of increased purchases of aircraft
by the Philippine Airlines and a rebound in
electronic product orders.
Data from the National
Statistics Office on Tuesday
showed total merchandise
imports reached $5.10 billion
in June, up from $4.50 billion
recorded a year ago. Inbound
shipments fell 5.3 percent month-
on-month from $5.39 billion in
May.
The rise in June shipments
was the highest monthly growth
since August 2011 when imports
expanded 13.8 percent.
The June import figures
brought the first-half tally to
$30.76 billion, up 0.4 percent
from $30.65 billion in the same
period last year.
Orders of electronic
products sharply rose 27.1
percent to $1.46 billion in
June from $1.15 billion on
year and were higher than
$1.44 billion in May.
The major electronics input,
semiconductors, increased 33
percent to $1.14 billion from
$856.5 million.
Transport equipment posted
the highest year-on-year gain
among the top 10 imported
items, rising 200 percent to
$639.48 million from $213.03
million a year ago.
“The expansion was brought
about by the aircraft importation
and higher import purchases of
motor vehicles and its parts and
accessories,” the NSO report
read.
The delivery of Boeing jets
to PAL, the country’s first
flag carrier, during the month
pushed the growth in transport
equipment. PAL earlier said
the first of the three 370-seater
Boeing 777-300ER it ordered for
flights to Vancouver, Australia,

Other imported items that
contributed to the growth in June
included iron and steel, 33.5
percent; industrial machinery
and equipment, 30 percent; and

percent from $460.02 million a
year ago.
Imports from Japan rose 46
percent year-on-year to $608.9
million, while those from China
increased 16 percent to $545.76
million.

central bank said inflation
may have accelerated this
month as floods disrupted
food supplies.

is obsolete

miscommunication.
Adages and idiomatic
expressions of old are not being
used today. Therefore, it follows
that grandparents, parents
and teachers don’t always
comprehend what kids are
saying, and vice versa.
For the professors of Beloit
College in the United States, it
doesn’t have to be that way. They
devised “The Mindset List,”
a compilation of references to
better understand the youth’s
“language” so that teachers can
adjust their teaching methods
accordingly. Every year since
1998, the “world view” of
incoming freshmen is reflected
in the list. For example, members
of the Class of 2016 (who were
mostly born in 1994) don’t
associate the word “twilight”
with “The Twilight Zone” as
older folks might. Instead, they
think of vampires.
But the most interesting
insight in this year’s 75-item list
is that, in the mind of 18-year-
olds, a lot of things that used to
be necessary, basic, normal and
maybe even irreplaceable are
now obsolete. Consider this an
obituary:
Luggage without rollers
– Since everything is going
digital, it makes sense that most
of today’s kids haven’t seen an
actual airplane ticket. But it’s
surprising that, according to
the list, they also “can’t picture
people actually carrying luggage
through airports rather than
rolling it.”
TV – Most teenagers watch
TV, as older generations always
have. The difference is, today,
many of us don’t watch on
television sets. The list says that
YouTube is this generation’s
alternative, as well as devices
that can play television content.
Radio—The list declares that
those born in 1994 “really have
no use for radio at all.” They also
“never listen to music on the car
radio” because they grew up with
music being available digitally.

there really is no need for printed
encyclopedias. According to the
list, parents of today’s teenagers
have stopped purchasing new
sets. This development coincides
with Encyclopaedia Britannica

Kids “have had to incessantly
remind” them that the term
is outdated, as are the objects
(video and cassette tapes) it used
to originally refer to.
Print textbooks—Textbook
sales are on a decline because
college students check the
availability of their e-book
editions before purchasing
the paper versions. Printed
yearbooks are also considered
obsolete.
Simple toys—
Straightforward playthings no
longer cut it because “having
made the acquaintance of
Furby at an early age, they have
expected their toy friends to do
ever more unpredictable things.”
(Furby was the must-have toy
from holiday 1998 to 2000, with
over 40 million units sold.)

As expected, kids of the digital
