Annexure A Tender for Civil and Structural works Sub & Super structure, Water Proofing, Stone Cladding, External Glazing, Landscaping COMMERCIAL CLARIFICATIONS SR. NO. 1. As per Tender Earnest Money Deposit: As per tender Clause No. 2.1(h), Amount of EMD = Rs.50,00,000/-.(Rupees Fifty Lac Only) QUERY / REQUEST BY BIDDERS Earnest Money Deposit: 1. Can give Rs. 5 Lacs Bank Guarantee. 2. We request you to reduce the amount of EMD to be deposited. 3. We feel that the amount of EMD mentioned in the document is on the higher side. Kindly reconfirm the same. 4. We will submit Corporate Guarantee towards EMD, please confirm. Mobilization advance We request you to pay 15% of the value of contract as Mobilization advance along with the Letter of Intent against the corporate guarantee. Space for site establishment & Labour 1. Labour accommodation shall be provided to us free of cost. 2. The necessary space for setting-up Batching plants, Site office and other establishments including Labour colony to be provided to us at work site. CLARIFICAT IONS

Mobilization advance As per tender Clause No. 4.3.3: Mobilization Advance = 10 % of Contract Value (in two equal installments) against Bank Guarantee of equivalent value in Form IV.

Space for site establishment & Labour As per tender Clause No. 5.14.3 & 5.14.4:The Employer shall allow at his own discretion and convenience land for the construction of the Contractor's site office, god owns, and workshop assembly yard near the site. The Contractor shall construct and maintain at his cost, all these temporary works. As per tender Clause No. 5.20: The Contractor shall not use any portion of the Site for purpose not connected with the works without the prior written approval of the PMC. As per tender Clause No. 5.23: No Labour accommodation shall be permitted within the site.

As per Tender As per tender Clause No.3.8.1 The whole work may be split between two or more Contractors or accepted in part and not entirely, if considered expedient by VIPL.

Completion Time As per Clause 4.2.4 : Time for Completion is 9 months from the date of issue of Work Order Security Deposit / Retention Money As per clause 5.3.1: The Contractor shall deposit Security Deposit and Retention Money for proper fulfillment of the terms of the Contract as under: (a) 2.5 % as Security deposit in the form of DD or Bank Guarantee as per Form - III on award of work by the date as stipulated in the work order. The Bank Guarantees shall remain valid for 12 months from the date of issue of Work Order unless extended further in writing. 2.5 % as Retention Money in the form of DD or Bank Guarantee as per Form - III on award of work by the date as stipulated in the work order. The bank guarantees shall remain valid for 24 months from the date of issue of work order unless extended further in writing. 2.5 % as Retention Money shall be deducted at the rate of 3 % of the value of the work done from the running bills till 2.5 % of the contract value is made up.

Completion Time It should be 12 months instead of 9 months, mentioned in tender. Security Money 1. Deposit / Retention

(a)

One Bank Guarantee of 5% of Contract Value shall be submitted for Retention & Performance. 50% of Bank Guarantee shall be released on virtual completion & Balance after D.L.P. 2. We request you to consider Bank Guarantee for retention money equal to 5% of contract value in two parts (2.5 % of contract value valid till virtual completion period and remaining 2.5 % will be valid till defect liability period) and no cash to be deducted from our bills.

As per Tender Period of Honoring R.A. Bills As per clause 4.3.10, 15 days from the date of receipt of PMCs Certificate for first 75% and 15 days from the date of receipt of PMCs Certificate for balance 25%. PMC will certify within 10 days of receipt of the bill for first 75% and 25 days of receipt of the bill for balance 25%.

QUERY / REQUEST BY BIDDERS Period of Honoring R.A. Bills 1. 75% Bill payment shall be made with in 7 days on submission of bill & balance with in further 7 days. 2. We request you to pay 85% of RA Bill Value as adhoc payment with in 7 days of submission of bill on quick check basis and balance amount within 7 days thereafter.

Final Bill On completion of the entire Work, the Contractor shall submit his final bill within time specified in Annexure - II. PMC will certify the bill within 90 days. The Employer shall arrange to make admissible payments within 30 days of the issue of certificate by PMC. Payment of this bill shall not be considered conclusive evidence as to the sufficiency of any work or materials to which it relates, nor shall it relieve the Contractor from his liabilities arising from any defects noticed till the completion of the maintenance period.

Final Bill Submission with in 30 days. Certification with in 45 days & payment with in 15 days after certification by PMC.

Valuation of Variation & Extra Item As per clause no.4.3.14 a). The direct cost of labour including indirect charges thereon. The labour cost shall be derived from standard documents as agreed by PMC. (b) The Material cost inclusive of taxes, levies, etc. as delivered to the site. The material cost should be accompanied with invoices. The Material cost shall be as per existing market rates (inclusive of dealer discounts if available). (c) In addition the Contractor shall be entitled towards operational cost of plants and equipment, overheads, IT, WCT, all taxes and profit. This shall be 15 % of (a)+(b) as above.

Valuation of Variation & Extra Item 1. 2. 15% for T &P, Over heads, IT. All other taxes shall be extra. Our quoted rates shall be valid for total contract price as quoted +/-15% of the contract value. Variation beyond these limits, the rate shall be subject to upward revision as mutually agreed.

As per Tender As per clause no. 5.4.4 All additional items at variance from those given in BOQ and accepted by the PMC shall be treated as extra items. These shall be expressly ordered by the PMC in writing with prior approval of the Employer prior to start of work by the Contractor. The Contractor shall be paid as per similar item of BOQ. In absence, actual rate analysis shall be prepared considering market rates of labour and materials with the Contractor's profit as 15% added to such cost thus arrived. The Contractor shall have to produce vouchers to support the rate analysis. The PMC reserves the right to call additional quotations for material, labour / workmanship if felt necessary and rates approved by the PMC / Employer shall be final. The PMC's decision shall be final.

QUERY / REQUEST BY BIDDERS i) For additional items of work of which rates are not available, the same shall be derived from the quoted rates wherever applicable. For additional items of work where rate cannot be derived from quoted rates, the same shall be computed on the following basis:

As per Tender Basic Rates As per clause no.4.3.16 Basic rates indicated against item nos. 6.12,7.01,8.06,8.11,8.12,8.13,8.14,8. 15, 9.13a, 10.12, 10.13, 10.14, 11.12,11.15, 12.10, 12.11, 12.12, 12.13, 12.21 etc. will mean landed cost at site including all taxes, cartage, handling etc. but excluding wastage. The bidders shall source the material in such a way that the landed material cost shall not exceed the basic rates. In case the landed material cost is less than the given basic rates, the contractor shall pass on the savings to the client. Contractor shall submit the samples of the materials for which the basic rates are given along with the bid. However, before procuring these items, the bidders would be required to get the samples and the basic rates approved by the Architect / PMC. At the time of procurement of materials, any downward change in basic rate of materials approved for these items shall be adjusted subject to submission of all quotations, invoices, vouchers, and accounts or receipts in connection with the expenditures.

QUERY / REQUEST BY BIDDERS Basic Rates 1. Any variation (Plus or Minus) in the Basic rates shall be in client's account. 2. We request you to furnish the base rate of cement, reinforcement steel and structural steel (MS Steel & Tor Steel) 3. The present market trend is quite inflationary and uncertain. It is very difficult to adopt a fix rate of key construction material like Cement & Steel at this stage. It is requested that the basic rate of Cement & Steel should be specified.

As per Tender Secured Advance As per Clause 4.3.6 (b), A secured advance @ 75% of the cost of Cement, Reinforcement & Structural Steel, Stones, aluminum sections or 75% of cost based on the basic rates of these items whichever is less will be paid along with R.A bill subject to physical verification by PMC. For the material rates contractors has to furnish the document in support of the rates. This secured advance shall be recovered from the running R.A bill to the extent the material is incorporated in the work. 75% of secured advance against material delivery will be released. Balance payment would be released only on completion of erection work (no separate payment for fabrication works will be released).

QUERY / REQUEST BY BIDDERS Secured Advance We shall be paid Secured Advance equivalent to 90% of material value for Cement & Reinforcement Steel and 75% of material value for other materials brought to site for incorporation in the works and the same shall be recovered from our RA Bills on pro-rata basis.

12.

Escalation As per clause no.4.3.17, The rates quoted / accepted by the Contractor shall be firm for the entire duration of the contract inclusive of items listed under Schedule A and no price escalation shall be paid for any variation in the rates of any or all items.

Escalation We request you to consider the Escalation for completing the work beyond the scheduled time of completion if the reasons of extension are not attributable to us.

SR. NO. 13.

As per Tender Taxes and Duties: As per clause no.5.4.3, The rates quoted in the tender shall include all charges for tools, plants, temporary water and electric connections (if any), overhead reservoirs, sheds for material (of the Contractor and as issued by the Employer), hire charges, if any, maintenance of all services and equipment clearing the site, etc., for the execution of the works. It shall also include all taxes such as sales tax, Works contract tax, development tax, entry tax, turnover tax, services tax, octroi duty, excise, or any other duties of any public body or corporation (duly authorised to collect). However, additional monetary burden not considered in the rate on account of taxes / duties which were not in existence during bidding will be paid extra. The monetary claims with regard to the variation in the existing statutory duties, taxes, levies, etc. shall not be entertained

QUERY / REQUEST BY BIDDERS Taxes and Duties: Our quoted rates shall be based on prevailing rates of taxes and duties. Please note any variation in the existing taxes and duties and introducing if any new taxes, duties and cess after date of submission of our offer due to upcoming budget of Central or State Government, the same shall be reimbursed to us against proof of payment.

14.

Liquidated Damage: As per clause no. 4.2.8 If the Contractor shall fail to complete the work within the time stipulated in Annexure - II or extended time, then the Contractor shall pay the Employer a sum equal to 0.5% of the contract value of works by way of Liquidated Damages for such defaults and not as a penalty for every week or part thereof of delay which shall elapse between the time prescribed above or extended time, as the case may be and the date of completion of the works and subject to a ceiling of 5 % of the contract value.

Liquidated Damage: Liquidated damages shall only be recovered for the reasons attributable to contractor for noncompletion within stipulated / extended time at 0.1% of contract value per week beyond the stipulated / extended date the work remains incomplete subject to a ceiling of 2.5% value of work.

QUERY / REQUEST BY BIDDERS Date of Bid Submission: i) We would like to inform you that we are in the process of contacting with various specialized agencies and vendors for bringing the tender in very competitively. They will need some more time to give us the good rates. Hence, we request you to extend the tender submission date by 2 weeks. We would request you to please extend the last date & time for receipt of technical bid and price bid by 20 days in view of the fact to arrive at most competitive bidding which requires more time as most of the time has been consumed by festivals.
