Defendants hereby respectfully request that the Court grant this Ex Parte Application to enlarge the 25-page length limit set forth in Local Rule 11-6, to allow them to file an Opposition to the Bipartisan Legal Advisory Group of the House of Representatives (BLAG) Motion to Dismiss, ECF No. 36-37, that is no more than 35 pages in length. Defendants have made every effort to reduce the brief to minimize the need for additional pages, but have been unable to do so. Good cause exists for this request. BLAGs Motion to Dismiss advances legal arguments involving complex constitutional issues of equal protection and substantive due process. In addition, the motion to dismiss touches on technical immigration issues, which cannot be adequately addressed in a cursory manner. On October 5, 2012, Defendants Counsel Jesi Carlson conferred with Plaintiffs counsel, Peter Schey, as well as Intervenors Counsel, Mary Beth Walker, telephonically regarding this issue. Mr. Schey indicated that Plaintiffs take no position on Defendants request to exceed the page limit. Ms. Walker indicated (in an email subsequent to the telephone conference) that BLAG does not object to Defendants request.
