On August 1, 2012, the City filed its Voluntary Petition under Chapter 9 of

On August 9, 2012, the City filed its "Motion For Entry Of An Order (1)
6 Directing And Approving Form OfNotice; and (2) Setting Deadline For Filing Objections To 7 Petition; Memorandum Of Points And Authorities In Support Thereof," which was scheduled for 8 hearing on August 17, 2012.

On August 24, 2012, the Court entered an order setting October 24, 2012,
10 as the deadline for filing and serving objections to the City's Petition under Bankruptcy Code 11 921(d). 12

The City seeks to limit the number of objections to the Petition filed by
13 creditors, including the Firefighters. The Firefighters seek to preserve their right to present
14 evidence regarding the City's solvency in the context of future motions filed by the City directed 15 at the Firefighters.

The Firefighters agree that they will not object to the Petition; The City agrees that it will produce to the Firefighters, on the same terms
19 and conditions, documents produced by the City to other creditors relating to the City's 20 insolvency in connection with any litigation of the City's eligibility to be a Chapter 9 debtor in 21 this case, and the Firefighters agree that any documents produced by the City pursuant to this 22 paragraph shall be used by the Firefighters only in connection with proceedings of any future 23 motion described in paragraph 3 below; and 24 25

The Parties agree that the Firefighters will retain the right to present
