EX PARTE MOTION TO SHORTEN TIME FOR HEARING ON HONIGMAN MILLER SCHWARTZ AND COHN LLPS MOTION FOR REASSIGNMENT OF PREFERENCE CASE MEDIATIONS FROM PEPPER HAMILTON LLP TO ALTERNATE MEDIATORS FOR CAUSE Honigman Miller Schwartz and Cohn LLP (Honigman) states as follows for its Ex Parte Motion To Shorten Time For Hearing: 1. Honigman has recently developed a conflict of interest with the Pepper Hamilton

LLP (Pepper) law firm in connection with the Steel Parts Case,1 as described in the Motion. 2. Under the Mediation Order, Pepper was assigned to mediate twelve Adversary

Proceedings in which a Honigman client is a defendant. 3. The Motion seeks assignment of mediations of the Adversary Proceedings

from Pepper to alternate mediators. 4. It is necessary that the Motion be heard on an expedited basis because Pepper

is scheduled to mediate Adversary Proceedings on May 7, 13, and 21, 2008. 5. This Court has authority to shorten time for hearing on the Motion under Fed.

R. Bank. P. 9006 and L.B.R. 9006-1(b).

Capitalized terms used but not defined herein have the meanings given them in Honigmans Motion For Reassignment Of Preference Case Mediations From Pepper Hamilton LLP To Alternate Mediators For Cause (Motion).

Honigman requested by email on April 25, 2007 at approximately 9:45 a.m.

that Pepper and counsel for the Trust consent to shortening time on the Motion, but did not obtain concurrence. 7. Honigman has served, or will promptly serve by email, this Ex Parte Motion

and the Motion on Pepper and on counsel for the Trust. Honigman will serve those parties entitled to notice who do not receive notice via the Courts ECF system by U.S. Mail within 24 hours of entry of the Order granting this Ex Parte Motion. 8. Attached as Exhibit A is a proposed Order Shortening Time For Hearing.
