UPSTREAM OIL AND NATURAL GAS
BUSINESS ACTIVITIES

PRESIDENT OF THE REPUBLIC OF
INDONESIA,

Menimbang: Considering:
a. bahwa untuk menindaklanjuti Putusan
Mahkamah Konstitusi Nomor 36/PUU-X/2012
tanggal 13 November 2012, dan guna
menjamin kelangsungan kegiatan Usaha Hulu
Minyak dan Gas Bumi, perlu diatur pengalihan
tugas dan fungsi pengendalian dan
pengawasan kegiatan usaha hulu minyak dan
gas bumi;
a. that in furtherance of Decision of the
Constitutional Court Number 36/PUU-X/2012
dated November 13, 2012, and to guarantee
the course of Upstream Oil and Natural Gas
Business activities, it is necessary to regulate
the transfer of duties and functions of control
and supervision of upstream oil and natural
gas business activities;
b. bahwa berdasarkan pertimbangan sebagaimana
dimaksud dalam huruf a, perlu menetapkan
Peraturan Presiden tentang Pengalihan
Pelaksanaan Tugas dan Fungsi Kegiatan Hulu
Minyak dan Gas Bumi;
b. that in consideration of point (a), it is
necessary to issue Regulation of the President
concerning Transfer of Duties and Functions
of Upstream Oil and Natural Gas Business
Activities;
Mengingat: Bearing in Mind:
1. Pasal 4 ayat (1) Undang-Undang Dasar Negara
Republik Indonesia Tahun 1945;
1. Article 4 section (1) of the 1945 Constitution
of the Republic of Indonesia;

times, most recently amended by Regulation
of the Government Number 55 of 2009 (State
Gazette of the Republic of Indonesia Number
128 of 2009, Supplement to State Gazette of
the Republic of Indonesia Number 5047);

MEMUTUSKAN: HAS DECIDED:
PERATURAN PRESIDEN TENTANG
PENGALIHAN PELAKSANAAN TUGAS DAN
FUNGSI KEGIATAN USAHA HULU MINYAK
DAN GAS BUMI.

REGULATION OF THE PRESIDENT
CONCERNING TRANSFER OF DUTIES AND
FUNCTIONS OF UPSTREAM OIL AND
NATURAL GAS BUSINESS ACTIVITIES.
Pasal 1 Article 1
Pelaksanaan tugas, fungsi, dan organisasi Badan
Pelaksana Kegiatan Usaha Hulu Minyak dan Gas
Bumi dialihkan kepada menteri yang
menyelenggarakan urusan pemerintahan di bidang
minyak dan gas bumi, sampai dengan
diterbitkannya peraturan yang baru.

Performance of duties, functions and organization
of the Upstream Oil and Natural Gas Regulatory
Agency shall be transferred to the minister in
charge of the government affairs in the field of oil
and natural gas until new regulation is issued.
Pasal 2 Article 2
Segala Kontrak Kerja Sama yang ditandatangani
antara Badan Pelaksana Kegiatan Usaha Hulu
Minyak dan Gas Bumi dengan Badan Usaha atau
Bentuk Usaha Tetap, tetap berlaku sampai masa
berlakunya berakhir.

Any Cooperation Contract (Kontrak Kerja Sama)
signed between the Upstream Oil and Natural Gas
Regulatory Agency and Business Entities or
Permanent Establishments shall remain valid until
its expiration.
Pasal 3 Article 3
Seluruh proses pengelolaan kegiatan usaha hulu
minyak dan gas bumi yang sedang ditangani oleh
Badan Pelaksana Kegiatan Usaha Hulu Minyak
dan Gas Bumi, dilanjutkan oleh menteri yang
menyelenggarakan urusan pemerintahan di bidang
minyak dan gas bumi sesuai dengan ketentuan
peraturan perundang-undangan.

The entire processing of upstream oil and natural
gas activities managed by the Upstream Oil and
Natural Gas Regulatory Agency shall be continued
by the minister in charge of the government affairs
in the field of oil and natural gas in accordance
with the provisions of laws and regulations.
Pasal 4 Article 4
Peraturan Presiden ini mulai berlaku pada tanggal
diundangkan.
This Regulation of the President shall come into
effect on the date it is promulgated.
Agar setiap orang mengetahuinya, memerintahkan
pengundangan Peraturan Presiden ini dengan
penempatannya dalam Lembaran Negara Republik
Indonesia.

In order that every person may know of it, the
promulgation of this Regulation of the President is
ordered by placement in the State Gazette of the
Republic of Indonesia.
