Secretary (Legal), IS-II Division, Ministry of Home Affairs, 9th Floor, Lok Nayak Bhawan, New Delhi- 110003 STATEMENT OF FACTS: In this matter a maintenance petition had been filed by Shikha goyal, herein referred as Petitioner against her husband Nitin Goyal, herein referred as Opposite party , their marriage was solemnised on 8-12-2003 according to Hindu rites and ceremonies. Applicants in-laws including opposite party continuously maltreated (beaten, abused, taunted, insulted, humiliated) her for and in connection with demand of dowry immediately after the marriage. The Opposite party maintained distance from Applicant, Later on when opposite party got good job in Mumbai he continued to remained separate from Applicant for long time than Applicant went to Mumbai on her own but the Opposite party again started same maltreatment and tried to get signed the documents of divorce and further forcefully send applicant at her maternal home. Applicants father is old and has no source/means to support the Applicant and her seven year old son. The Opposite party currently in London working on project in Capgemini U K. APPLICABLE LAWS: Section 125 Of Criminal Procedure Code, 1973 125. Order for maintenance of wives, children and parents (1) If any person having sufficient means neglects or refuses to maintain(a) his wife, unable to maintain herself, or (b) his legitimate or illegitimate minor child, whether married or not, unable to maintain itself, or (c) his legitimate or illegitimate child (not being a married daughter) who has attained majority, where such child is by reason of any physical or mental abnormality or injury unable to maintain itself, or (d) his father or mother, unable to maintain himself or herself, a Magistrate of the first class may, upon proof of such neglect or refusal, order such person to make a monthly allowance for the maintenance of his wife or such child, father or mother, at such monthly rate not exceeding five hundred rupees in the whole, as such Magistrate thinks fit, and to pay the same to such person as the Magistrate may from time to time direct:
