This TRAVESTY of Justice began on 9/28/2005 when a Mortgage was recorded. Chevy Chase Bank FSB/MERS/ Fannie Freddi Uniform Docs.
Assignment #1: Recorded 5/28/2010. More than 4 years later. Said Assignment assigns the MORTGAGE and NOTE to US Bank NA as Trustee for CCB Libor Series 2005-4. It is acknowledged by Monica Hadley of Capitol One , US Bank, DHI, and MERS fame. She signs for all. Notary by Harry Truong. See the post on Hamlet, for the property in Truro MA, where the assignment was acknowledged in MA, and notarized in Texas., for signature compares. REMIC FAIL. Invalid etc....
Order of Notice #1: Recorded: 8/25/2010. US Bank, as Trustee for CCB Libor Series 2005-4 prosecuting. Judgement filed 5/27/2010. Foreclosing by entry and possession, and exercise of power of sale. There was about 4 months to reply(object), That's an unusual amount of time by MA standards....Look very closely at this document. Do you notice anything weird??!
Assignment #2: Recorded on 5/25/2011 (almost a year after the Order of Notice).... FUN TIME!! This is a CORRECTIVE ASSIGNMENT. I love these!! This assignment states that is being "recorded due to an incomplete assignee on the Assignment of Mortgage recorded with the Barnstable County Registry of Deeds at Book 24582 Page 153. This assignment is assigning the MORTGAGE only ( not with the NOTE like the first one.... does that qualify as an incomplete assignee??) I don't think so. Also, as claimed under oath.. OOOOPS!! The wrong Trust was put on the assignment. In fact, the Trust used for the first assignment DOESN'T EVEN EXIST. WHAT??!! How did this go? "Sorry Chief Justice Karyn F. Scheier, we put a non existent Trust on the Assignment, recorded it, etc." This is sworn to in another document here, which I will get to. The "REAL" Trust is US Bank NA as Trustee relating to (relating to? ) the Chevy Chase Funding LLC Mortgage Backed Certificates Series 2005-4, c/o Capitol One.
I think there's alot more wrong here other than the "Imcomplete Assignee". Ya think??
It takes alot of people to create, sign, and record an Assignment with a NON EXISTENT trust. Does anyone have a problem with this? Again, acknowledged by Monica Hadley, Notarizing by Harry Truong. I feel like I am introducing a band here....
Order of Notice#2 Recorded: 9/20/2011. I guess Harmon waited 4 months to see if anyone noticed the FRAUD assignments before recording this. Filed 5/26/2011. Homeowner's had until 10/31/2011 to reply(object) to the Servicemember's Civil Relief Act ( MA law... which is where the fraudclosure's start)....
SO, while on the subject... I would like to thank all the fine Men and Women who serve this Country. You have more class in your pinkie finger's than Harmon Law will have in a lifetime.
The Judgment for this was issued on 11/1/2011. HOUSTON we have a problem. The Notice of Sale was being advertised in the Cape Cod Times on the dates of 10/19/2011, 10/26/2011, and 11/2/2011. BUT WAIT you say!! How can this be? How can a Notice of Sale be advertised before the Judgement is issued by Chief Justice Karyn F. Scheier??!! That's a really GOOD freaking question. It also doesn't fit into the "strict adherence" to MA GL 244.
