Offer of Individual Employment Contract

Dear Michael12345,

We are pleased to offer you employment with Etihad Airways as Cabin Crew. Your employment will commence on
8th March 2009. Your contract of employment with the Company will be for an initial period of 2 years from the
above Commencement Date. On the expiry of this period, your employment contract will be automatically
renewed for similar periods provided that you are assessed to be suitable for flying duties at the time of the
renewal.

The terms and conditions of your employment with the Company are set out in this letter, in the Human
Resources Policies & Procedures and in various other manuals / guidelines which relate to your job and which will
be available to you when you report for duty.

This employment (including the Employee’s initial appointment and any subsequent one) will be governed by the
Company’s Human Resources Policies & Procedures which are applicable to this particular appointment. Such
regulations, as amended from time to time, are deemed incorporated into this agreement.

The terms & conditions of your employment with the company will be on Single Status employment and are
set below as follows:

PROBATION

During the first 6 months of your employment you will be on probation during which time the normal terms and
conditions (such as eligibility for sick leave, annual leave and annual leave travel) will not apply, but which will
then apply in the normal way after the expiry of the probationary period of service.

If you resign from employment with Etihad Airways before the completion of probation period (six
months), all the training related and accommodation expenses in Abu Dhabi must be reimbursed
(recovered on pro-rata basis calculated from Date of Joining to 6 months), and you must bear the
cost of the repatriation ticket.

BASIC SALARY

This position has been evaluated at Grade DF. During your training period as well as you probation period your
basic salary will be AED 2,500-/ per month and thereafter your basic salary will be AED 3,500-/ per month.

FLYING PAY

You will receive a Flying Pay at the rate of AED 44-/ per Duty Hour after the completion of basic training, and
when on the Duty Roster. Further you will receive Layover Allowance in accordance with the applicable policy.

HOURS OF WORK

You will be required to work such hours and on such days as directed by the Company, and as set out in the Duty
Roster. In addition to your Duty Roster, it may be necessary to occasionally work such reasonable additional
hours as the Company may direct, in accordance with the Company’s Flight Time Limitations which are published
in the Cabin Crew Emergency Manual.

The Company incorporates within your remuneration an element to compensate for duty rostered on UAE
Public/Religious Holidays; hence you will not be entitled to any additional pay when worked on these days.

SPONSORSHIP OF RESIDENCE

The Company will act as sponsor for your employment and residence in Abu Dhabi.

COMPANY ACCOMMODATION & TRANSPORTATION

The Company will provide you with temporary accommodation (Hotel / Guest House / Company Facilities) for the
duration of the training program. During the training period you may have to share all facilities including the
bedroom and shower/bathroom with other trainees of similar sex.

On completion of the training program or if available during training period, you will be provided with air-
conditioned furnished accommodation on a single status basis in Abu Dhabi. You will be required to share
accommodation with other Cabin Crew of the same sex on a one person per bedroom basis. The Company will
pay all relevant cooking gas, electricity and water charges for your accommodation. Alternatively, you may
choose to live outside on your own and claim a monthly Housing Allowance of AED 3,312-/ per month

If you are staying in the Etihad provided accommodation, then you will be provided with transportation pick-up
service between your residence and point of duty and vice versa. Incase if you are availing the housing allowance
you will have to arrange for your own transportation as the expenses for transport has been taken into account
while setting the Housing Allowance.

The Company has a policy of no "double provision" with regard to the above benefits. This means that if your
family members enjoy these benefits and you are living with them, then such benefits will not be provided
through this Contract of Employment.

If subsequent to joining, your circumstances should change with respect to the need for these benefits, you
should speak to your Human Resources representative who will explain the changes in your terms and conditions
of employment.

INSURANCE

Personal Accident Insurance


The Company will insure you under the Group Personal Accident Insurance Scheme and will pay the premium on
your behalf.

Medical
You will be covered under Group Medical Insurance Policy subject to the terms and conditions of the policy in
force.

Dental
You will receive up to AED 2,000 per year reimbursable on receipt of actual dental treatment claims. Treatment
can be taken at any local dental clinic in Abu Dhabi, the UAE, or in any other country if so preferred.

The Company’s policy on Insurance is detailed in the “Etihad Employee Handbook” which will be issued to you on
joining the Company. You will also be verbally briefed on the scheme’s details.

ABSENCE DUE TO SICKNESS/ACCIDENT OR INDUSTRIAL INJURY

Absences due to incapacity must be supported by a medical certificate which must give the reason for absence,
and be issued by a Company appointed doctor.
If absent from work due to sickness/accident whilst in the UAE, you must not leave the country unless travel is
authorized by your Manager after liaison with the Chief Medical Officer in relation to assisting your convalescence.

ANNUAL LEAVE

You are entitled to 30 calendar days leave per year, inclusive of Public Holidays. You are required to take the full
compliment of 30 days vacation leave per year, as any leave not utilized will not be encashed or rolled over. The
annual leave year for the purpose of calculation of annual leave utilization, is calculated pro rata from your date
of joining.

ANNUAL LEAVE DESTINATION (ALD)

Your annual leave destination could either be the International Airport in or nearest to your country of
citizenship/nationality or any destination on the EY network of your choosing. Further details can be obtained
from Human Resources.

ANNUAL LEAVE TRAVEL (ALT)

Annual leave travel tickets are provided by the Company, on Airlines and routes determined by the Company,
with maximum use of Etihad services. You may use the ALT to any destination on Etihad network. You are eligible
for one firm return annual leave travel ticket per annum commencing from your date of joining to its anniversary.

CLASS OF TRAVEL - LEAVE & DUTY

Your class will be “Economy” for annual leave and concessionary travel.

JOINING/REPATRIATION TICKET

Joining and repatriation tickets will be provided by the Company, on airlines and routes determined by the
Company, with maximum use of Etihad services.

On termination of contract of employment, the Company will provide you with a repatriation ticket Abu Dhabi -
Annual Leave Destination (ALD).

If the company decides to renew your contract, your repatriation ticket entitlement (as per this contract) will be
moved to the end of the renewed contract i.e. you will not be provided with another joining and repatriation
ticket.

BAGGAGE - ON JOINING AND REPATRIATION

All overseas recruits will be entitled to 60kgs of “accompanied baggage” upon joining the company and on
repatriation.

TRAINING

On joining the Company, you are required to undergo basic training for a period of six weeks prior to being
rostered for flying duties. The period of training may be curtailed or extended at the sole discretion of the
Company. There are examinations at the end of each stage of training and progress to the next stage is
conditional upon passing the examination at the previous stage

You are also required to undergo a mandatory annual Safety & Emergency Procedures (SEP) Refresher courses
and medical examinations. Failure to pass the basic training SEP Refresher course and/or medical examinations
could result in termination of employment.
Continued employment is dependent on your attendance at, and satisfactory completion of, any professionally
required training courses specified by the Company.

UNIFORM/LAUNDRY

Full uniform sets and related accessories will be supplied to you on loan, and replacements will be issued in
accordance with the Company’s policy

It is your responsibility to ensure that all items of uniform issued are clean, well pressed and ready for immediate
use. For this purpose, the Company has arranged uniform laundering services free of charge. Should you decide
to launder your uniforms elsewhere; no reimbursements will be made by the Company.

CONTRACTUAL NOTICE PERIODS

During probation, the period of notice to terminate your contract of employment is 7days given in writing by
either party to other. After probation, the period of notice is 30 days given in writing by either party to the other.

END OF SERVICE BENEFIT (EOSB)

On termination of service, provided you complete at least one year of continuous service with the Company, you
will be entitled to non contributory benefits comprising: -

25 days final basic salary for each of the first three years of service
30 days final basic salary for each of the next three years of service
35 days final basic salary for each year of service over six years

EOSB will be pro-rated in respect of part years of service after the first year. Final basic salary is defined as the
basic salary applicable on the date of termination of service.

ADVANCE PAYMENTS

Upon termination of employment, howsoever occasioned, any advance payment made to you or a third party on
your behalf, or with respect to benefits provided by the Company will be calculated where applicable on a pro
rata basis and will be deducted from your final settlement of dues.

MEDICAL EXAMINIATION

You will be required to periodically undertake and pass the Company’s standard medical and dental examinations,
the UAE Government standard medical examination and the GCAA medical examination, which includes testing
for abusive drugs, etc. Details will be given during your briefing on joining the Company. The cost of the pre-
employment medical examinations for Residence Visa in Abu Dhabi only, will be borne by the Company. If, for
any reason you do not pass the required medical examinations, this offer of employment will be considered
withdrawn or if you have commenced employment, your services will be terminated without notice.

PRE-CONDITIONS

This offer of employment is subject to the following conditions having been met:

Satisfactory completion of the necessary Medical Examinations as referred to above.


The Company being able to obtain and retain the Visa necessary for your employment in Abu Dhabi, as
required by the Government of UAE.
The employee being able to comply with any migration procedures required by their country of origin. The
Company will not bear any associated costs or any responsibility for non-compliance.
Satisfactory completion of security checks, and police clearance where required.
The Company being able to obtain the Airport/Civil Aviation Pass, if required for your employment.
Satisfactory references from your present/previous employers
Satisfactory proof being received by the Company, of your qualifications and experience, as given in the
correspondence/CV produced prior to this offer.
You joining the Company on or before the Commencement Date specified or such other dated agreed with
the Company.
Etihad being your sole employer.

OTHER CONDITIONS

This contract of employment shall be construed in all aspects under the laws of Abu Dhabi, United Arab
Emirates (UAE) and the Courts of Abu Dhabi shall have jurisdiction in all matters relating thereto.

Should any Cabin Crew become pregnant whilst in employment, the GCAA will automatically revoke the
license and thus the Cabin Crew will be required to submit her resignation immediately.
RESPONSE

Should you wish to accept our offer of employment, please sign the “Declaration” at the end of this contract, and
return it to the undersigned. We will require one original copy of this contract of employment signed by you on
each page, on the day you report for duty. A “Check-List of Required Documents” is enclosed for your ready
reference.

Irrespective of your written acceptance, this offer is conditional on your being able to satisfy all of the conditions
set out in the paragraph on Pre-Conditions. The Company accepts no liability for any losses and costs incurred by
you (except as specified in the paragraph on Medical Examination) in you meeting these conditions.

If you are unable to adhere to the Commencement Date given in the opening paragraph, please advise
immediately, in which event the Company may agree to consider modifying this date.

On receipt of your acceptance and documentation, arrangements for your travel and entry into Abu Dhabi will be
made and advised to you as soon as possible.

DECLARATION

Confidentiality and Non-Disclosure

I hereby agree that I will not disclose, reveal to anyone outside the Company or use, other than for the purpose
of carrying out my duties for the Company, or by as required by applicable law any information which I know or
should know from my relationship with the Company, or the context in which the information was imparted to me
constitutes confidential, privileged, proprietary or restricted information of or in any manner relating to the
Company, without first obtaining the express and specific written permission of the Company.

Acceptance of Contract

I confirm my acceptance of the offer and terms set out above, and will commence duty on 8th of March 2009.

Assignment of Right

I, the undersigned __________MICHAEL BARNES____________ expressly agree, understand and declare that in
the event that I leave any or all of my personal effects in the Company apartment after my last day of service
with the Company after resignation or termination for whatsoever reason, the Company has the right under this
assignment to sell or dispose of these items, unless I notify the concerned department in advance and I obtain
approval from them to extend the period to collect my personal effects.

In consideration of the above, I, fully discharge all liability against all claims, and further admit that I am fully
indemnify and hold harmless the Company, subsidiaries, independent contractors and their respective directors,
officers, employees and agents, from any and all claims, cost, demands, proceedings, liabilities, application,
losses, action, suits, disbursement and expenses (including legal fees, costs and related expenses) arising from
or connected with the disposal of my personal effects left in the Company apartment.
