DEFENDANTS' CONSENTED-TO MOTION FOR ADDITIONAL TIME TO FILE, AND ADDITIONAL PAGES FOR, THEIR REPLY MEMORANDUM Defendants St. Marys Regional Medical Center (St. Marys or Hospital), St. Marys Health System (Health System), and Ira Shapiro, M.D. (Dr. Shapiro)(collectively, the Defendants) move the Court for an extension of time, until January 22, 2013, to file a reply memorandum in support of Defendants Motion to Dismiss Plaintiffs First Amended Complaint (Dkt. # 30), and for an additional three pages for said reply memorandum. 1. On Saturday, December 29, 2012, Dr. Murtagh filed his Response in Opposition

to Defendants Motion to Dismiss. (Dkt. # 35). Dr. Murtaghs Response is twenty-two pages in length and attaches and incorporates an eight-page affidavit containing many new facts. 2. According to the Courts Notice of Electronic Filing, Defendants Reply is due on

January 14, 2013. Defendants need a reasonable time to analyze the substantial material and new facts and to prepare a proper response. In addition, counsel for the Defendants have other intervening previously scheduled legal commitments prior to January 14, 2013.

Additionally, the substantial and new information contained in Plaintiffs twenty-

two page brief and accompanying eight-page affidavit will necessitate considerable analysis. Accordingly, the seven-page limit will likewise be very difficult with which to comply. 4. Plaintiffs counsel consents to the extension of time and the additional pages.

THEREFORE, the Defendants respectfully request an extension of time until January 22, 2013, to file a reply memorandum, and three additional pages for its reply memorandum or for such other relief as may be appropriate. Respectfully submitted, this 31st day of December 2012.
