voting record cause for alarm

Concerns are emerging in some circles of the LGBT
community now most notably from gay Rep. Barney Frank
(D-Mass.) over the potential nomination of former Sen.
Chuck Hagel as defense secretary, despite the apology he
issued days ago regarding anti-gay remarks made in 1998.
A handful of advocates who spoke to the Washington
Blade are seeking more details over how Hagel would
address remaining issues for LGBT service members
such as additional partner benets for gay troops and the
implementation of openly transgender service beyond
what was offered in the statement in which Hagel apologized
and said he would be committed to LGBT military families.
Richard Socarides, a gay New York-based Democratic
advocate, is among those saying Hagel should present more
specic plans for addressing outstanding LGBT issues at the
Pentagon.
I think that if he is nominated as Defense Secretary, before
we as a community agreed to support him, as some groups
have already done, it would be important to hear from him
what his plan is on implementing Dont Ask, Dont Tell
repeal and on issues like transgender service, Socarides
said. These kinds of questions would be appropriate for any
defense secretary nominee, but they would be particularly
appropriate were the nominee Sen. Hagel, who because of
his comments would have some convincing to do.

to tie the knot Jan. 1

TILGHMAN, Md. Gay couples across Maryland
immediately took advantage of the states same-sex
marriage law once it took effect at midnight Tuesday.
Sabrina Pettis, a member of the Maryland National
Guard, married her ance Natasha at an Annapolis
church at 12:01 a.m. on New Years Day. Ellicott City
residents Dale Knight and Jeff Arney tied the knot
at a friends Howard County home at the same time,
while at least four same-sex couples were expected to
exchange vows in Cumberland just after midnight.
Long-time Baltimore mayoral aide James Scales
and his partner, William Tasker, were among the
seven same-sex couples who included South Carolina
Equality Executive Director Ryan Wilson, who grew up
in Fallston in Harford County, and his partner, Shehan
Welihindha, at Baltimore City Hall once the building
opened at 12:30 a.m. on New Years Day. Mayor

attributes shuttering to
changing gay social scene

A few more details emerged this week
about the closing of long-time Dupont
Circle-based gay bar Omega, although
specics of who purchased the property
remain undisclosed.
Perry Morehouse, who started there
as a bartender 35 years ago and was its
general manager for about the last 20
years, said this week he doesnt know
specics other than that it was sold to two
guys that are gonna make it their private
residence. As for the sudden closing,
he said it was explained to him that the
business, which opened as The Fraternity
House on Sept. 1, 1976 according to Mark
Meinke of Rainbow History Project, had to
be dissolved and moved out by years end.
Morehouse concurs it is unfortunate
that such a long-time staple of D.C. gay
nightlife didnt get to have a closing night
party as other former D.C. gay bars and
clubs have done, but said the decision was
beyond his control.
I wasnt involved in the decision at all,
Morehouse said. I think with the people
involved, it had to be closed before the
end of the year. Its just a guess, but it may
have been a tax issue, Im not sure.
Morehouse said the building/business
had been for sale since May. It was located at
the rear of 2122 P Street, NW, the address it
used in its promotions, though the technical
address was 2123 Twining Court, NW.
We just always used that in our
advertising and such because nobody knew
where Twining Court was, but everybody
knows P Street, Morehouse said.
He also said owner Glen Thompson, a
Delaware resident who also owned the
nearby gay bar/club Apex (now closed)
and former Rehoboth Beach, Del.,-based
gay club Renegade, declined to answer
questions about the business or why it was
sold. Morehouse declined to comment
on the degree to which Thompson was
involved in the business.
Morehouse did, however, offer his own
thoughts. He said business had been a
lot slower in recent years.
I attribute it to a couple things, he told
the Blade. One, the gay demographic
has moved farther east it got to where
it was hard to get people to cross over to
the west side of the Circle. Second, we
were mainly a cruise bar and in the advent
of the internet, it really hurt some of that.
Suddenly you can go online and pull up
a thousand people in D.C., Maryland and
Virginia all looking for a date. They all
used to be at the bar.
Morehouse said while certain specials
like their shirtless men drink free nights
on Wednesdays remained popular, its
untenable to run such specials all the time.
You cant give the bar away every
night, he said. People go where
the specials are. We were popular on
Wednesdays. Green Lantern had theirs
on Thursdays. JR.s is popular on Sunday
afternoons. The bears go to Bear Happy
Hour, but most of them dont go out other
nights. Its just the way things are with
demographics now.
He also said gay assimilation into
mainstream society has taken a toll on
traditional gay watering holes and hang-
out spots.
Twenty years ago, gay people went
to gay bars to hang out with other gay
people and I dont think you have that
as much anymore, Morehouse said.
People used to go to Annies because
you could be with your own kind. Now,
ve gay men can go have dinner together
anywhere and not feel out of place. Ive
even seen two guys out on the dance oor
at a straight bar and hardly anyone looks
sideways, especially in D.C. People dont
feel uncomfortable out like they used to.
They feel they can let their hair down just
about anywhere now.

Lawsuit says supervisor
called him fag,
bone sucker

A gay auditor at the D.C.-based Air
Transport Association of America led a
lawsuit in September charging the group
with paying him a substantially lower
salary than others with similar job duties
because of his sexual orientation.
Arlington, Va., resident Stephen Farina,
who has worked for the association
since 1992, charges in the lawsuit that
the association, also known as Airlines
for America or A4A, retaliated against
him after he led a sexual orientation
discrimination complaint against the
group over the salary issue before the
D.C. Ofce of Human Rights in May.
During plaintiffs employment, plaintiffs
supervisor made derogatory comments
about plaintiffs sexual orientation when
he stated on several occasions that he
opposed gay rights and gay marriage [and]
referred to plaintiff as a fag and a bonade
bone sucker to plaintiffs subordinate, the
lawsuit charges.
It says the same supervisor, who is
not identied in the lawsuit, made
disparaging comments towards another
gay employee under his supervision.
Victoria Day, a spokesperson for the
association, responded to a request by
the Washington Blade for a comment on
the lawsuit with a one sentence statement:
A4A does not tolerate discrimination in
any form and intends to vigorously dispute
these allegations.
D.C. Superior Court Judge Anthony
Epstein, who is presiding over the case,
issued a ruling on Dec. 13 denying a
motion by A4A calling for the dismissal of
the case based on procedural grounds.
Epstein ordered the two parties to
participate in a court required mediation
process while setting a timetable for pre-
trial information gathering and pre-trial
motions if the mediation is unsuccessful.
Farina told the Blade he spent nearly
four years attempting without success to
address with A4As upper management
what he calls A4As discriminatory
employment practices toward him
regarding his salary.
His lawsuit says he began work with
the A4A in 1992 as a staff auditor at a
salary of $28,000. It says A4A ofcials had
knowledge that plaintiff is gay throughout
most of his tenure with the organization.
According to the lawsuit, in August
2001, Farina was promoted to manager
of audits with an annual salary of $61,000.
Around February 2008 his title changed to
director of industry audits, which brought
a raise to $68,000.
Farina told the Blade that authoritative
studies of the industry show that people
holding similar jobs with other employers
and others with similar job duties at A4A
make between $100,000 and $160,000.
Plaintiffs principal role is to provide
guidance and oversight for vendors
hired to operate 60 of the largest jet fuel
storage and distribution systems in the
United States and Canada, the lawsuit
says. On information and belief, other
similarly situated non-gay directors are
paid substantially more than plaintiff.
The lawsuit calls for $1 million or more
in damages to be determined at trial to
compensate for lost pay, front pay, lost
benets, pain and suffering, emotional distress,
mental anguish, interest [and] reasonable
attorneys fees, among other things.
Farina said he dropped his Human
Rights Ofce complaint and led the
lawsuit at the advice of his attorney
after determining a lawsuit would be a
more effective means of addressing his
discrimination complaint.
Farinas lawsuit was led three months
before the Human Rights Campaign
released its 2012 Corporate Equality Index
ratings of U.S. corporations on personnel
policies pertaining to LGBT employees.
Most of the major U.S. airline companies
received ratings of between 90 and 100,
the highest score given to companies that
ban employment discrimination based
on sexual orientation and gender identity.
According to the HRC Corporate Equality
Index, companies receiving high ratings,
like the airline companies, provide domestic
partner benets and adopt other supportive
policies toward LGBT employees.

Law went into effect

Two men from Portland on Saturday
became the rst gay couple to legally
marry in Maine once the states same-sex
marriage law took effect.
Michael Snell, 53, and Steven Bridges,
42, exchanged vows inside Portland City
Hall shortly after midnight as Snells two
daughters, Mayor Michael Brennan and
several reporters watched. Hundreds
of people who had gathered outside in
sub-freezing temperatures cheered the
men as they left the building they even
sang the Beatles song All You Need Is
Love as Snell and Bridges and about a
dozen other same-sex couples who either
exchanged vows or obtained marriage
licenses walked down the stairs.
It means equality, Snell told
documentarians with the Knack Factory
moments after he and Bridges exchanged
vows. It means that our relationship, our
marriage is equal to everybody elses.
The Portland City Clerks ofce remained
open to any same-sex couple who wanted
to apply for a marriage license or tie the
knot until 3 a.m. The town clerks ofce in
nearby Falmouth also opened at midnight
for gays and lesbians who had already
made appointments to get married.
The Portland-Press Herald reported
South Portland City Clerk Susan Mooney
issued marriage licenses to eight same-
sex couples once her ofce three of
them tied the knot there opened at
8 a.m. The Brunswick Town Clerks ofce
also issued marriage licenses to gays and
lesbians Saturday.
Chris Kast and Byron Bartlett were among
the same-sex couples who married at
Portland City Hall after the law took effect.
They had a commitment ceremony two
and a half years ago, but Kast told the
Washington Blade earlier Saturday that
their choice to get married after midnight
was a matter of fact decision on our part
to go do it and be part of what was an
amazing evening.
It felt incredible, he said. The energy
was just all positive and joyful. It was
amazing.
Maines same-sex marriage law took
effect after voters on Election Day
approved it by a 52-48 percent margin.
They repealed an identical statute in
2009 that then-Gov. John Baldacci signed
earlier that year.
Same-sex marriage referenda in
Maryland and Washington also passed on
Nov. 6. Minnesotans on Election Day struck
down a proposed state constitutional
amendment that would have dened
marriage as between a man and a woman.
All the politics is done; now its just
about actual couples and the people who
have been together wanting to make
it ofcial, Matt McTighe, campaign
manager of Mainers United for Marriage,
the group that supported the same-sex
marriage referendum, told the Blade. He
was among those who gathered outside
Portland City Hall to celebrate the states
rst legal gay nuptials. The energy was
amazing. It was just nothing but happiness
take the best parts of every wedding
youve ever been too and multiply it by
a hundred and thats what it was like for
these people.
Sue Estler and Paula Johnson, who
have been together for 24 years, married
in their Orono home on Saturday. The
couple plans to have a larger celebration
next summer, but Estler told the Blade just
before she and Johnson exchanged vows
they decided to marry on the rst day
same-sex couples in Maine can legally do
so because weve waited so long.
Its historic in Maine, she said. Weve
had so many ups and downs and so forth.
Our commitment has been long-term,
and this formalizes it.
Donna Galluzzo, who married her
partner of three years, Lisa Gorney, at
Portland City Hall earlier on Saturday,
echoed Estler.
We had a feeling the vote was going
to pass this year, Galluzzo told the Blade.
After the vote happened and once it was
all signed into law and knew what day City
Hall was going to open, we looked at each
other and said, Lets do it. It was a historic
day and was important for us to be a part
of history.
Kast agreed, describing the scene
outside Portland City Hall after he and
Bartlett exchanged vows as surreal.
It has taken us so long to get here,
to get to a place where everybodys the
same, Kast said. It was such a struggle
and how no one should have to do that,
no one should have to ght, no one should
have to give money or knock on doors just
to have the legal right to marry the person
with whom they choose to spend the rest
of their life with. But that aside, it was
ippin amazing. It really was.

Commonwealth Universitys diversity
ofce has determined that a decision in
November to re the gay coach of the
womens volleyball team was made in
compliance with VCUs employment
policies, according to a statement by VCU
President Michael Rao.
Coach James Finely, 52, who led his team
to a 25-6 winning record in 2012, has accused
the schools recently appointed athletics
director of declining to renew his contract
because of Finelys sexual orientation.
The Ofce of Institutional Equitys
exhaustive investigation conrmed that
the employment decision was made in
accordance with VCU policies and not as
the result of any discriminatory action by our
athletic director, Rao said in his statement.
The investigation included fact-nding
interviews with 16 individuals and a review
of applicable personnel records, the
university said in the statement. The
investigation concluded that allegations of
discrimination based on sexual orientation
were unsubstantiated.
It added, The details of the report
cannot be released publicly by VCU
without the consent of the complainant
because they include condential
personnel information.
Athletic director Ed McLaughlin has
said his reason for not renewing Finleys
contract was based on plans to take
the volleyball program in a different
direction and had nothing to do with the
coachs sexual orientation.
But Finley has said volleyball players on
the team told him McLaughlin told them
the university wants a coach who would
represent the university well, a comment
Finley interprets to mean a gay coach
cannot represent the school favorably.
In his own statement responding to
VCUs decision to uphold his ring, Finley
said he would review his options for
challenging the universitys action with
legal counsel.
Im obviously disappointed in the
outcome of VCUs initial investigation into
my discrimination complaint, he said. I
am dismayed by the poor quality of the
investigative procedures followed and by
numerous factual inaccuracies included in
the report that appear to provide the basis
for the conclusion reached, he said.
Finley said he was especially troubled
that procedures followed by the Ofce
of Institutional Equity provided me with
no opportunity to respond to any of the
erroneous information brought forward in
the investigation to justify the action taken.
Finley, who issued his statement
through the LGBT advocacy group Get
Equal, didnt immediately say whether he
would release the investigative report that
VCU says was condential.

Chicago Archbishop calls gay bill legal ction
CHICAGO Cardinal Francis George, the Archbishop of Chicago, last week
issued a letter to parishes denouncing as a legal ction a proposed bill to
legalize same-sex nuptials in the Prairie State.
The letter, obtained by the Windy City Times alleges that because the human
species comes in two complementary sexes, marriage is established by nature,
not the church or the state, and therefore, the State (sic) cannot change natural
marriage, the Cardinal writes.
It is unfortunate for Cardinal George that he has chosen not to join the growing
number of religious leaders and faithful laypeople across Illinois including many
devout Catholics, read a statement by Rick Garcia, senior policy adviser to Illinois

L.A. LGBT weekly co-owner dies
LOS ANGELES Mark Hundahl, the straight co-owner of LGBT weekly, Frontiers
L.A., died of cancer on Dec. 27 at the age of 61.
According to the publication, he had been involved there since 1983. In the
early 1980s Hundahl had become co-owner of popular Hollywood gay disco
Probe, when he was approached by Frontiers founders Greg Carmack and
Jerry Hyde about making their advocacy publication protable. In 1997, he and
business partner David Stern teamed up with the publication to create a lighter
fare counterpart to Frontiers called IN LA magazine. In 2007, Sterns and Hundahl
bought Frontiers, merging it with IN LA.
Those who knew us well and experienced how we worked together called us
the odd couple, said Stern, Frontiers publisher and Hundahls business partner
in a remembrance.

ring of gay employee

The United States Attorney for the
District of Columbia led court papers
on Dec. 17 arguing that a gay man, who
sued the Library of Congress for ring him
because of his sexual orientation, failed
to show hes entitled to protection under
Title VII of the U.S. Civil Rights Act of 1964.
The court ling by U.S. Attorney Ronald
C. Machen Jr., who was appointed by
President Obama, places the Obama
administration in the awkward position
of opposing a gay discrimination claim
under Title VII.
In a lawsuit led against the Library
of Congress in August 2012, former
management analyst Peter TerVeer, 30,
says he was red from his job after being
harassed and humiliated for more than
a year by a supervisor who repeatedly
quoted biblical passages condemning
homosexuality.
The lawsuit charges that although
TerVeer was targeted because hes gay, he
suffered employment discrimination and
harassment based on his gender, gender
stereotyping and his religious beliefs,
which he says didnt conform to those of
supervisor John Mech.
Title VII of the famed 1964 Civil Rights
Act bans discrimination based on race,
religion, ethnicity, gender and, according
to recent court rulings, gender identity,
but not sexual orientation by itself.
According to the lawsuit, TerVeer and
Mech had a cordial working relationship
from the time TerVeer was hired in
February 2008 as a management analyst
in the librarys Auditing Division. It says
TerVeer received high performance
ratings and two promotions between 2008
and 2010.
The lawsuit says Mech allegedly
became hostile and unfairly critical of
TerVeers work performance and created
an unbearably hostile work environment
after Mech learned TerVeer was gay.
The governments ling of a motion to
dismiss the case on legal and procedural
grounds comes at a time when gay rights
attorneys are seeking to persuade courts
to treat anti-gay discrimination as a form
of sex discrimination protected under
Title VII.
We believe that the allegations in the
complaint are insufcient to substantiate
a Title VII claim, said Charles Miller, a
spokesperson for the Justice Departments
Civil Division.
Miller pointed to an April 2012 ruling
by the Library of Congresss in-house
equal employment opportunity division,
which investigated TerVeers allegations
of discrimination and harassment and
dismissed an in-house complaint he led
in September 2011 on grounds that the
allegations could not be substantiated.
The Executive Branch is of course
opposed to discrimination on the basis of
sexual orientation, and this ling does not
reect any contrary policy, Miller told the
Blade.
But Christopher Brown of the D.C.
law rm Ackerman Brown, which
is representing TerVeer, said the
governments motion to dismiss the case
relies on legal precedent that excludes
LGBT employees from protection under
Title VII.
Brown declined to comment further
on the governments arguments, saying
TerVeers legal team prefers not to
comment in detail on pending litigation.
Greg Nevins, supervising attorney for
the gay litigation group Lambda Legal
Defense and Education Fund, which is
monitoring the TerVeer case, said the
governments motion to dismiss appears
to be arguing that TerVeer did not present
sufcient evidence to show that his
supervisor targeted him for discrimination
because TerVeer displayed mannerisms or
behavior of a stereotypical gay man, which
some might view as being effeminate.
I think what the U.S. Attorney is saying
here is a masculine gay man or a feminine
lesbian would not be covered under Title
VII, Nevins said. Some court rulings have
essentially said Title VII does not apply to
sexual orientation.
In a landmark ruling last April, the
U.S. Equal Employment Opportunity
Commission declared that transgender
people are protected against job
discrimination under Title VII because bias
against their gender identity is equivalent
to sex discrimination. The EEOC ruling
followed several appeals court decisions
holding that transgender people were
protected under Title VII.
Lambda Legal and other LGBT advocacy
organizations say they hope to persuade
courts that gay men and lesbians enjoy
Title VII protections. They argue that
sexual orientation discrimination is also
linked to gender role stereotyping and
bias, regardless of whether the victim is
perceived as masculine or feminine.
TerVeers lawsuit says he also was
targeted for retaliation after he led his
discrimination complaint with the librarys
in-house EEO ofce, which is known as the
Ofce of Opportunity, Inclusiveness and
Compliance.

Hagel is having his name oated for
the role at a time when LGBT rights
supporters are pushing the Pentagon to
grant additional partner benets to gay
service members such as joint duty
assignments, issuance of military IDs, use
of the commissary and family housing
through administrative changes as well
as the implementation of open service
by transgender people. Since the time
Dont Ask, Dont Tell was lifted in
September 2011, the Pentagon has said
that it was looking into the benets issue,
but no action so far has been taken.
Jim Burroway, editor of Tucson, Ariz.-
based blog Box Turtle Bulletin, also said on
Sunday the LGBT community should know
more about Hagels evolution on these
issues before rushing to embrace him.
I do think there has been an unseemly
rush to accept his apology, considering he
apologized for being insensitive but not
quite for being wrong, Burroway said.
A lot of other Republicans who changed
their minds have found opportunities
to articulate their new positions. Im still
waiting for Hagel to do the same.
Prior to his apology, the concern over
Hagel among LGBT advocates was
largely over a 1998 quote attributed to
him in the Omaha World-Herald where he
called then-nominee for U.S. ambassador
to Luxembourg, Jim Hormel, openly
aggressively gay.
On Dec. 14, Hagel issued an apology
to media outlets saying the remarks were
insensitive and hes fully supportive
of open service and committed to
LGBT military families. At the time,
LGBT groups such as the Human Rights
Campaign and OutServe-SLDN accepted
Hagels apology.
But Hagel also has an anti-gay record
while serving in Congress. From 2001
to 2006, Hagel consistently scored
zero on the Human Rights Campaigns
scorecards. Hagel voted for the Federal
Marriage Amendment in 2004, but didnt
cast a vote on the measure in 2006.
On Monday, gay Rep. Barney Frank
announced he was outright opposed to
the Hagel nomination on the grounds
that the former senators 1998 anti-gay
remarks and his congressional record on
LGBT issues demonstrated aggressively
bigoted opposition and that Hagel
voted consistently against fairness for
LGBT people.
Speaking to the Blade, Frank said
he waited to put out the statement on
Monday because he had been on vacation
during the previous week, but had been
meaning to make known his opposition to
the nomination for some time.
It is important that gay liberals and
Democrats not appear to be giving our
side a pass, Frank said. Theres no doubt
Obamas been very good on LGBT issues.
Its also the case that I dont think he knew
of this statement. A lot of people didnt; it
came out later. But now that its out there,
I think we have to hold rm. That really was
an awful statement.
Frank said he thought the Hormel
apology was very unpersuasive and he
was surprised groups like HRC would
have accepted the apology on the day it
was issued.
The fact that he would call Jim Hormel
aggressively gay seems to me an
indication of the depth of his dislike of us,
Frank said. If he said I was aggressively
gay, I would have said, Well maybe. But
HRC, I was surprised. I dont know why
they would do that.
Socarides, an adviser to former
President Clinton on LGBT issues at the
time Hormel was seeking conrmation,
also took issue with the apology and is
skeptical of the regret Hagel intended to
convey in his statement.
He did not call Ambassador Hormel or
even try to communicate directly with him
by email or letter, Socarides said. The
apology did not address in any specic
way why he made the original comments.
As I recall, it was fairly clear to us at the time
that the Hagel statement was as a result
of pressure on him by right-wing groups
who were demanding that Republican
Senators oppose the nomination. Had he
provided some context in the apology it
might have been more persuasive.
Socarides added the apology was
clearly written by someone else, probably
by a White House staffer and seemed
contrived and lacked the kind of context it
would need to connote genuine regret.
The White House didnt respond to a
request to comment on whether it had
a role in crafting the Hagel apology or
to provide any assurances that the next
secretary will address the outstanding
issues for LGBT service members in the
wake of Dont Ask, Dont Tell repeal.
Over the weekend, President Obama
addressed the potential nomination
of Hagel during an interview on NBCs
Meet the Press, saying that nothing in
Hagels record including his anti-gay
remarks disqualify from the role of
defense secretary and that his apology
reects positive change in the way the
country sees LGBT issues.
And I think its a testimony to what
has been a positive change over the last
decade in terms of peoples attitudes
about gays and lesbians serving our
country, the President said. Thats
something that Im very proud to have led,
and I think the anybody whos serves in my
administration understands my attitude
and position on those issues.
The LGBT community itself is divided on
Hagel as defense secretary. Opposition is
largely coming from commentators or
in Franks case, a lawmaker who will soon
leave Congress as most LGBT groups
have accepted the apology from Hagel.
Mara Keisling, executive director of
the National Center for Transgender
Equality, is among those saying that the
LGBT community shouldnt view Hagel so
harshly considering his apology.
It was two years after Bill Clinton
signed DOMA, Keisling said. Weve
forgiven Bill Clinton for something worse
than name-calling. The point, largely, of
the social justice movement is educating
people, and then embracing them when
they come over to your side.
Asked whether LGBT groups should
demand a commitment to openly
transgender service in exchange for
supporting the Hagel nomination, Keisling
said those demands are underway and
talks have already started at the Pentagon.
I think wed like that issue to get raised
in conrmation hearings for whomever it is
whether its Chuck Hagel or somebody
else, Keisling said. But the conversations
are already starting over at the Pentagon
and the next secretary of defense is going
to have to be answering to that, regardless
of who it is.
John Aravosis, the gay editor of
AMERICAblog often critical of HRC
and the Obama administration, was
also unprepared to criticize either entity
over the Hagel apology or his potential
nomination as defense secretary.
Aravosis was critical of the 1998 anti-gay
remarks saying they are along the lines
of something the late anti-gay Sen. Jesse
Helms would say but added criticizing
LGBT groups like HRC for accepting the
apology is tough because what kind of
commitments theyve received ofine is
unknown.
Maybe they got massive promises
from Hagel directly, saying, I promise Im
going to bend over backwards to work
with you on the policy, Aravosis said.
Who knows? But thats also part of the
downside of having private conservation,
is the rest of us look at it and say, We
have no idea why you changed your mind.
Were still uncomfortable. Thats the sort
of the dynamic were in.
The Human Rights Campaign didnt
respond to a request to comment on
whether it had received any private
promises in exchange for accepting the
Hagel nomination or if they had a role in
crafting the apology.
Frank said he thinks the opposition
to Hagel is so strong now from both
progressive and conservatives that the
chances of Obama naming him to the
post are nil.
But in the unlikely event Hagel was
conrmed as Pentagon chief, Frank said
he has no doubt Hagel would implement
pro-LGBT policy change if ordered to do
so by the White House.
I believe that he will do whatever the
president tells him, Frank said. Im
pretty sure if he were appointed, which I
dont think hes going to be, he would be
directed to do the right thing.

New Years Day will have a new meaning
for the hundreds if not thousands of
couples who will nally have the right to
marry the person they love, Rawlings-
Blake said. It is a remarkable achievement
for Maryland, and we are excited to open
City Hall to host some of the rst wedding
ceremonies in our great state. Newly
married couples will stand before their
friends and family to profess their love and
commitment to each other. This is what
we worked for and I am looking forward to
take part in this historic and jubilant day.
It has been a long-time coming for us
as a couple, Wilson, who met Welihindha
in Detroit in 2008 during the National Gay
and Lesbian Task Forces annual Creating
Change conference, told the Washington
Blade on Dec. 27. He proposed to his
now spouse in 2009 while on stage at the
annual South Carolina Pride as former
American Idol contestant Frenchie
Davis and thousands of others watched.
Having the legal recognition for us as a
couple is really important to us.
South Carolina will not recognize the
couples Maryland marriage because
voters in 2006 approved a constitutional
amendment that bans nuptials between
same-sex couples. The Defense of
Marriage Act also prohibits Wilson from
sponsoring Welihindha, who is from Sri
Lanka, for his green card he has been
able to remain in the United States through
a series of work and student visas.
We feel nows the time, Welihindha
said. Weve been together for ve years
and even though its not recognized in
South Carolina, we feel [as] though getting
married in a place that recognizes us as
being equal as everyone else and coming
back to South Carolina would be inspiring
to the community there. Its still something
we feel is going to have a symbolic
meaning to us because of that.
Eastern Shore inn hosts
same-sex weddings
A gay-owned inn in Talbot County on
Tuesday hosted more than a half-dozen
same-sex weddings on the day the law
took effect.
Tracy Staples, owner of the Black Walnut
Point Inn on Tilghman Island in Talbot
County who married his partner, Bob
Zuber, shortly after the law took effect at
midnight on Jan. 1, ofciated the wedding
of Baltimore residents Clayton Zook and
Wayne MacKenzie shortly after 12:30 p.m.
on New Years Day in a gazebo overlooking
the Chesapeake Bay.
The couple met more than six years
ago while working at a Huntsville, Ala.,
television station. Zook, 28, joked with
reporters after he and MacKenzie, 30,
exchanged vows that their decision to
get married at the inn was kind of a last
minute decision.
We thought it would be great to be a part
of the rst day that its legal in Maryland,
Zook said. Its an easy day to remember
for an anniversary. As far as all the legal
ramications and everything goes, its great
for us to say, State of Maryland we thank you
for giving us these rights for giving us equal
rights and we want to show you that we do
appreciate that and so getting married on
the rst day shows the people of Maryland
that there are same-sex couples that are
interested in matrimony.
Ruth Siegel of Silver Spring married
her partner of 15 years, Nina Nethery,
inside Black Walnut Point Inn just after
midnight on Jan. 1. The couple, along with
Staples and Zuber and Dwayne Beebe
and Jonathan Franqui of Pensacola, Fla.,
who also tied the knot immediately after
the same-sex marriage law took effect,
shared a champagne toast and a rainbow
wedding cake after they exchanged vows.
I just couldnt stop crying and everybody
else couldnt stop crying, Siegel told the
Blade after she and her spouse watched
Zook and MacKenzie tie the knot. We
had a nice little crowd of people that we
didnt know. And everybody got really
close really fast. It was incredible.
The states same-sex marriage law took
effect after voters last November approved
it at the ballot by a 52-48 percent margin.
Maryland is among nine states and
D.C. that allow gays and lesbians to
marry. Lawmakers in Delaware, Hawaii,
Minnesota, Rhode Island and other states
are expected to debate marriage rights for
same-sex couples later this year.
Tomorrow morning most Marylanders
will wake up and go about their regular
day getting kids dressed, cleaning the
house, running errands, Evans told the
Blade on Monday before the law took
effect. However, for thousands of LGBT
Marylanders they will wake up with the
ability to marry the person they love. What
a great way to start 2013.
Our engagement began in Maryland a
year and a half ago rst in helping get the
bill through the legislature and then securing
the decisive win on Election Day, Kevin Nix
of the Human Rights Campaign added in a
Dec. 31 statement. The sheer joy well see
on peoples faces tomorrow both of those
married and of their family and friends
is priceless. Looking ahead, the Maryland
victory provides real momentum for the
next round of states to secure marriage in
2013 and were looking forward to fairness,
freedom, and family prevailing yet again.
Michelle Miller and Nora Clouse of
Stevensville in Queen Annes County have
been together for 15 years and the couple
had a commitment ceremony a decade ago.
Miller told the Blade after she and Clouse
exchanged vows at the Black Walnut Point
Inn that she and her spouse are thankful to
Gov. Martin OMalley, lawmakers and others
who supported marriage rights for gays and
lesbians in the state.
Im very proud of Maryland, especially
since the popular vote and the people had
to decide on this issue, Miller said.
Siegel agreed.
Its amazing, she said. It would be of
what I expect of Maryland.
Navy ofcer wears
uniform to Tilghman
Island weddings
Beebe, 38, who has been in the U.S.
Navy for 19 years, proposed to Franqui,
28, in uniform while marching in last Julys
annual San Diego Pride parade.
Florida does not recognize same-sex
marriages, but Beebe told the Blade
during a post-wedding interview at the
Tilghman Island Inn that he and Franqui
considered exchanging vows while
they were taking care of his mother who
continues to ght cancer at Walter Reed
Army Medical Center in D.C.
When we decided to make it legal, we
were kind of guring the options of so are
we going to go to New York, are we going to
go to Iowa or wherever, Beebe said. After
the election, in Maryland it was going to be
legal on [Jan.] 1 so we decided to come here,
visit Mom while shes undergoing treatment
for cancer and also get our marriage license
and then it sort of just all evolved into lets do
it on New Years night.
Beebe attended the other same-sex
weddings that took place later on Tuesday
at the Black Walnut Point Inn while wearing
his Navy uniform.
Its amazing to be able to wear my
uniform and be openly gay, he said.
Theres really not emotions or words to
describe to live almost 19 years under
Dont Ask, Dont Tell and then to be lifted
and then to be actually legally married in
the state to somebody that you love and
you are in love with and that you want to
spend the rest of your life with and that
you cant be red for it, they cant do
anything to you, youre just living your life
the way youre supposed to. Its amazing.

City Hall among rst to host same-sex weddings
Baltimore Mayor Stephanie Rawlings-Blake, who was a high-prole advocate
for same-sex marriage in Maryland especially during the referendum battle,
decided to open the doors of City Hall to allow same-sex couples to marry as
soon as it was legal.
Beginning at 12:30 a.m. on New Years Day, seven couples participated in
ceremonies with the rst ofciated by the mayor herself.
New Years Day will have a new meaning for the hundreds if not thousands

Rawlings-Blake in a statement prior to the event. It is a remarkable achievement
for Maryland and we are excited to open City Hall to host some of the rst

Jim Scales, a 40-year employee of Baltimore City who has been an ofce
manager serving all mayors since William Donald Schaefer, and his partner Bill
Tasker were the rst to get married in City Hall at 12:30 a.m. on Jan. 1. The couple,
who reside in Essex, have been together 35 years.
We didnt want to rush into this, Scales said.
The idea of opening City Hall originated with attorney Mark Scurti of PK Law. It
took several phone calls and networking, but he was ultimately able to pull it off
with help from the mayors ofce.
The other six couples who tied the knot at City Hall were Brigitte Ronnett
and Lisa Walther, Danielle Williams and Darcea Anthony, Jamie Kraft and Sarah
Vickery, Tom Rabe and Robert Coffman, Ryan Wilson and Shehan Welihindha,
and William L. Countryman, Jr. and Roy Allen Neal.
Similar ceremonies took place around the state with some occurring one
minute after midnight. Unions occurred in Annapolis, Tighlman Island, Howard
County, Cumberland and more. Havre de Grace City Councilman Joseph C. Smith
married his partner Don Starr at the citys Concord Point Lighthouse, complete
with reworks.
Community stands up to beating of Kenni Shaw
About 40 people gathered at the foot of the Washington Monument on the
evening of Dec. 30 in reaction to the attack and beating of Kenni Shaw, a 30-year-
old gay man, in East Baltimore on Christmas night.
Shaw was punched from behind around 9 p.m. on Christmas night as he left a
liquor store at E. Hoffman and N. Rose Streets in East Baltimore. He was bloodied
and sustained bruises to his face and body from the beating that ultimately lasted
about 10 minutes and included ve, perhaps six, men. Shaw was left lying face
down on the pavement as the attack continued.
Shaw, a cosmetologist, told the Blade that he believes this was a hate crime and
wants to speak out to help others in the community.
Delegate Mary Washington (D-43), the only elected ofcial present, introduced
herself to the crowd by saying, I am your delegate. When you knock us down we
multiply.
Annapolis trolley operator drops wedding parties
Matt Grubbs, owner of the Discover Annapolis Tours, announced in December
his intention to cease shuttling wedding parties and guests from churches to
receptions because of his opposition to same-sex marriage.
His decision not to do business with same-sex couples is based on his
religious beliefs. Since such discrimination would be illegal due to Marylands
antidiscrimination statute that includes sexual orientation, he has decided forego
the weddings part of the business altogether. As a result, he stands to lose some
$50,000 a year in revenue.
The law exempts my minister from doing same-sex weddings and the Knights
of Columbus dont have to rent out their hall for a gay wedding reception, but
somehow my religious convictions dont count for anything, Grubbs wrote in an
email to the Patch. Were a Christian-owned company and we just cant support
gay marriages. Were not trying to make a statement. Were not trying to make a
point. Were just trying to be faithful Christians.
Grubbs intends to request the General Assembly for an exemption so that he
can refuse his services to same-sex couples on religious grounds.

From Hillary buzz to
Baldwins arrival in
U.S. Senate
As we welcome the New Year we can
be sure that there will be a Supreme
Court decision on our right to marry. We
know the justices agreed to hear two cas-
es: one on DOMA Section 3 and the oth-
er on Californias Proposition 8. Everyone
and their uncle will be dissecting these
cases and trying to predict an outcome.
Lawyers will be giving us every possible
scenario on each of them until the day
the decision is rendered, which will most
likely be the last possible day in June.
As a layman I see the court upholding
the right to marry in California and over-
turning Section 3 of DOMA, with both deci-
sions based on states rights. This seems to
be the simplest thing for them to do if they
are not prepared to take the nal step and
decide that under the 14th Amendment,
same-sex marriages are protected by the
Constitution. Of course, hope springs
eternal that they will agree to invalidate all
those obscene state constitutional amend-
ments claiming that marriage can only be
between a man and a woman.
Setting aside the jokes made after
Colorado and Washington State legal-
ized marijuana and people said they now
understood the Bible where it says, if
man lies down with man they must be
stoned, the reality is that these anti-mar-
riage equality amendments were passed
because people wouldnt acknowledge
the fact that marriage in the United
States is a civil right, not a religious one.
It is granted in a license by the state and
the decision to follow that up with a reli-
gious ceremony is a personal one. I am
not convinced the court is willing to tell
all those people they are wrong just yet.
That feeling is heightened when listening
to Ruth Bader Ginsburg say she thinks the
court may have ruled on Roe v. Wade be-
fore the country was ready for it. But then
it is nearly impossible to predict what the
court will do, as we saw in the decision on
the Affordable Care Act.
Congress should be able to move on
some social legislation in 2013 possi-
bly a fair and equitable immigration bill
and maybe with Tammy Baldwin (D-Wis.)
in the Senate even ENDA can move if we
put enough pressure on the Congress.
Surely in the rst quarter of 2013 we can
put enough pressure on the president to
sign an executive order banning discrimi-
nation in federal contracting.
There will be more than enough hap-
pening in 2013 to keep us all talking
and debating. Anyone in Dupont Circle
should feel free to stop by the Java House
coffee shop on 17th and Q Street any
morning to partake in a conversation/de-
bate. Patrons there have fun anticipating
the possible Hillary Clinton run in 2016
and analyze everything she does or says
from a new haircut to talk of buying a new
house to where she will accept speaking
engagements to see how it might play
into a candidacy. Speculation on what
President Obama will do after his second
term began even before the term has be-
gun. Topics of conversation will surely in-
clude continued fascination with Michelle
Obamas wardrobe and guessing games
over new Cabinet members, ambassa-
dors and high-level appointments in the
White House. Since your opinion is as
valid as anyone elses sitting at the table,
feel free to join in the fun.
The more serious issues that will play
out in 2013 include what happens in Af-
ghanistan, Syria, Egypt, Iran, Israel and to
the Palestinian people. How many more
people will lose their lives as these ghts
continue? Most agree that 2013 will not
see the end of the turmoil in any of those
places but we can and must pray that our
leaders will nd equitable solutions that
will allow people to live in peace.
As we rejoice at the swearing in of the
new Congress, especially members like
Sen. Baldwin, and bid adieu to others
like Rep. Barney Frank (D-Mass.) we must
all remain vigilant and active if we are to
advance the causes we believe in. As the
president is sworn in to his second term
we must continue to pressure him to stay
strong in moving a progressive agenda
forward as we stand strong at his side and
pressure the members of Congress to do
the same.
2013 could become one of the most
exciting political years in a long time. We
will surely be able to claim some victo-
ries if each and every one of us remains
involved and continues to speak out for
what we believe.

Enterprise enlistment aided
by marriage equality, offset
by other policies
Marriage equality is good for business.
For that reason, entities of commerce
business associations and advocates, execu-
tive and management personnel, small and
moderate-sized local enterprises and larger
national and international corporations
have increasingly joined in supporting same-
sex marriage. Large and growing numbers of
businesses have promulgated internal policies
respecting gay relationships and promote the
same recognition by government.
As an anticipated slow slog to gain le-
gal acceptance on a state-by-state basis
evolves, business backing will prove essen-
tial to enlarging legalization beyond the cur-
rent limited landscape.
Corporate business leaders have provided
critical political support and signicant sums of
cash to fueling state marriage equality efforts
and recent ballot box campaigns. Discounting
the few proprietor outliers opposed on reli-
gious grounds, all types of businesses, particu-
larly the largest corporations, are supportive of
civil equality.
Broadening business engagement will be
essential to both expanding success beyond
a static inventory of predictable locales and
creating a momentum-building base of juris-
dictional wins to further advance accelerated
and expanded adoption.
Despite a rapid transformation in public
attitudes on the issue, legislative and elector-
al margins have typically been extremely nar-
row in the few states now offering marriage
as an option for gay and lesbian couples.
Even in Maryland, with its highly favorable
constituency composition, only a small mar-
gin of votes provided a late-call referendum
victory in November. Support from hundreds
of businesses endorsing the Yes on 6 cam-
paign helped ensure victory.
The new normal for the national economy
requires states to ercely compete for enter-
prise location and the resulting economic
and employment contribution. States increas-
ingly battle one another to attract and retain
businesses, making the corporate ability to
accommodate all employees and solicit the
best talent without restriction an important
decision-making component.
Maryland Gov. Martin OMalley is at-
tempting to grow the states share of bio-
medical, science and technology compa-
nies in particular. This effort is designed to
help offset the loss of jobs and investment in
other business segments partly the result of
a now emblematic and entrenched negative
regulatory and tax environment.
These targeted growth industries require
extension of what have become standard
and necessary state government nancial
incentives to maintain competitive consider-
ation over other locales. A differential on an
employee civil liberty can be a deal-breaker
in corporate determination, particularly for
businesses employing younger and job-
mobile talent. Not only do these employees
demand that state law comport with corpo-
rate policy for their own protection or that of
colleagues, they desire residence where full
opportunity is available to all.
Competitiveness in the cutthroat world of
business enticement on a state level is slowly
enlarging to include quality-of-equality con-
cerns. The common perception is that a juris-
diction offering a full range of civil citizenship
rights also attracts desired cultural amenities
offering a modern social lifestyle among like-
minded contemporaries.
Even OMalleys own laborious path to
endorsing gay marriage is symbolic of the
evolution of this corporate requirement.
The governors political competitiveness
as a long-shot potential contender for
the Democratic nomination for president
in 2016 recommended that he shift gears
on a proposed state policy he eventu-
ally backed. An advantage bestowed state
governments hoping to remain competi-
tive in the commercial arena mirrored his
personal political calculations.
Unfortunately for Marylands business de-
velopment and economic growth prospects,
however, civil marriage equality alone simply
wont cut it. While removal of this single dis-
incentive for a growing number of businesses
is a positive step, until the state improves its
overall treatment and taxation of businesses
and entrepreneurs it will continue to remain
less competitive among other regional and
nationwide choices.
The Free States free-spending tendencies
and anti-business obstacles will cause Mary-
land to lose out on corporate retention and
acquisition absent improving overall condi-
tions for commerce.
Neighboring Virginia, the top business-
friendly spot in the region, illustrates that
dichotomy. The commonwealth would be
well advised from a strategic perspective to
extend marriage equality to all residents.
But until Maryland and D.C. revise govern-
ment policies to enhance corporate suc-
cess and improve consumer conditions,
there is scant incentive for Virginia to do so
while commanding dominance in market-
place competitiveness.
Bottom line, gay wedding bells and better
business policies are a match made in heaven.
2013 sure to bring
great things for the
LGBT community

With the Gertrude Stein Democratic
Club special meeting and election con-
troversy over and the slate originally
elected on Dec. 3 ofcially reafrmed as
the winners, the club can move to the
work it is destined to do advocate for
the LGBT community of D.C.
Although the special meeting and the
challenges brought forth may have raised
a few eyebrows in the community and
seemingly split the club into two factions,
its mission was accomplished. Allowing
members the opportunity to question,
challenge, gain clarication and in some
cases vent, the meeting was democracy
in action at its best and much needed to
help the club move forward.
After all, the club is a democratic or-
ganization that thrives on democratic
principles. The special meeting allowed
members to participate in a democratic
process and gain clarity on a number of
issues that raised ags of concerns. I am
sure that this will ultimately lead to a revi-
sion of the clubs bylaws, which will only
help to allow the club to carry out its mis-
sion more effectively.
Additionally, the new leadership cer-
tainly has brought a lot of positive energy
into the group by taking a page out of
President Obamas book and organiz-
ing to bring in a diverse group of new
members who are red up and ready
to go! If you combine this energy with
the renewed energy of the clubs exist-
ing members, 2013 and beyond is sure to
bring great things for the LGBT commu-
nity in Washington, D.C.
However, there is still a giant elephant
in the room the need of the new lead-
ership to win those over who still doubt
their leadership ability. No one is deny-
ing that winning over the doubters will
not be an easy task. Yet, the challenges
that the new leadership will face should
not be used as a method of attack before
they have had ample time to prove them-
selves. Countless organizations have had
changes in leadership that may have
caused a riff in the membership, but they
have banned together for the good of
the organization and its mission.
The Stein Club members and the com-
munity should allow the new leadership
the time necessary to do exactly that,
especially considering that the one thing
that resonated in the special meeting was
that there is still work to be done to im-
prove the lives of those in the LGBT com-
munity. Yes, there have been great suc-
cesses in the quest for equality in recent
months in Washington, D.C., and across
the country but you cannot rest on your
laurels when all members of the commu-
nity are not treated equally.
Among the work that needs to be
done is reducing the number of hate
crimes plaguing the LGBT community in
D.C. This very important issue and others
should now be the focus as we prepare to
enter into 2013.
The special meeting, challenges and
questions about the meeting are now in
the past. That chapter has ended and it is
time to move onto to a new one. In this
new chapter, Martin Garcia, Angela Peo-
ples, Vincent Villano, Barrie Daneker, and
Jimmie Luthuli stand posed to lead a club
with a rich history and tradition into a new
era. This executive board, like those that
have come before them, will continue the
legacy and be staunch advocates for the
LGBT community.
Membership in the organization is
growing; fresh ideas are owing and old
and new members are eager to work
together. We are red up and ready to
go! Thats what every organization wants
and we have it. We need to embrace that.
I stand behind the club leadership and
am ready to do whatever I can to improve
the lives of my fellow LGBT brothers and
sisters. Will you join me and do the same?

GLEN BURNIE, Md. Larry Esser was 25 when he met Tom
Toth on his rst day of work at the old Chessie Systems ofce
in Baltimore in June 1981. The Centers for Disease Control
and Prevention had just reported the rst cases of what later
became known as AIDS. Marylands anti-sodomy law was still
on the books, but Toth, who was 32 years older than Esser,
felt it was important to live his life as an openly gay man.
Tom kind of pursued me, to put it quite bluntly, Esser
tells the Washington Blade during a Dec. 13 interview. I
really liked him, thats the funny thing. I didnt feel like he
was imposing himself or anything like that ... hes the bravest
person Ive ever met. His personal courage astonished me.
Esser stressed he had no idea I was gay when he met
his future spouse. He grew up in what he describes as an
extremely strict Roman Catholic household in Connecticut
where he routinely heard gay people were probably worse
than murderers and they were to be avoided at all costs
and they were mentally defective. Esser eventually found
himself in a relationship with another man he conceded
wasnt going anywhere when Toth nally made his move.
He was sitting at his desk and he was singing, Esser
recalls, laughing. It was like in a joking sort of way he was
singing and the other people around him were laughing
when he was doing it and he was singing something about
its springtime and its time for love. The way he tells this
story, I came in the door and heard him singing that and I
tried to sneak away. I didnt want any part of that. And he
saw me and he said, Uh oh. And thats when he began to
realize that I was not what he thought I was. How can you
explain how two people fall in love? I cant explain that.
But it just happened. I wasnt afraid of him personally.
Couples activism starts at home
The couple routinely engaged in what Esser calls guerrilla
activism that began when he said the railroad red him after
they began dating in 1983 because of his sexual orientation.
He considered moving back to Connecticut, but Toth
insisted he move into the small Glen Burnie home he shared
with his then-84-year-old mother, Mary.
There was no arguing with that, Esser says. The
funny thing is when he said it, it was exactly what I wanted
to hear, but of course I couldnt ask him that. It was up to
him to ask me, and he did. And I was delighted.
Esser took care of Toths elderly mother until she died
the following year. He says the same Chessy System vice
president whom he claims red him threatened to do the
same to his partner once he found out they were living
together. (He says the railroad in the late 1970s had tried
to re an early member of the Baltimore Gay Alliance that
later became the GLBT Community Center of Baltimore
and Central Maryland, but the union fought for him.)
He couldnt do it directly, Esser says, recalling efforts
to re Toth, who was a unionized stenographer. He did
a bunch of different things to try to get Tom to quit. And
amazingly, Tom was actually ready to resign. A woman
whose name I cant remember, but will always be grateful
to her told him dont resign because the railroad is going
to do a bunch of buyouts and youll be able to get a lump
sum payment and retire, and thats what he did.
The couple also for years distributed copies of the
Blade at locations throughout Anne Arundel County.
They decided to approach the Anne Arundel County
Public Library Board of Trustees in Annapolis in 1993 after
they read about the newspapers threatened lawsuit against
the Fairfax County (Va.) Library for its proposed ban on the
publications distribution inside its branches. Esser said
Toth was really rough with them, in part because hed
gone through a very repressive time back in the 1950s. (He
lived in Manhattan for 25 years and the New York Police
Department once arrested him during a gay bar raid.)
When we got to the library board, he told them point
blank, Youd better do this, Esser says. They were not
happy. They were not happy at all. I think some of them
were actually kind of sympathetic to what we wanted to
do, but they were taken aback by how assertive he was.
They werent used to that. The library board is used to
people coming and requesting things, not telling them
what theyre going to do. And they were not happy.
Esser says one of the board members later told him the
board did not want to meet with Toth anymore because he
was very blunt, but in the end they granted them permission
to place 15 copies of the Blade in libraries in Glen Burnie,
Severna Park and Annapolis. They continued distributing the
Blades each week from the Center for more than two decades.
By putting the paper there, I always felt that, I always
wondered if a young person going by thinking they were
maybe gay or knew they were gay but felt very isolated,
if they saw those papers, maybe that would give them a
little bit of encouragement or a little bit of reassurance.
But the other point was just sheer visibility. By having
those papers there, Tom used to say ... if even one person
picks one up, he said even if they throw them away they
still got to look at them. And that was an excellent point.
And he was quite right. That meant a lot to us.
Trust the truth
The AIDS epidemic had begun to exert its toll on gay
men by the time the couple began dating Esser recalls
a time both he and Toth went to a small Severna Park
health clinic to get HIV tests. Toth says the nurse asked
him whether he was a gay man. He said that was the
rst time in his entire life anyone asked him that directly,
Esser says. He had never been asked that question.
Esser says he felt the atmosphere during the late 1980s
was pretty optimistic in spite of the epidemic and
late-North Carolina Sen. Jesse Helms, fundamentalist
preachers Jerry Falwell and Pat Robertson and other
social conservatives who sought to demonize gay men
during the AIDS crisis.
Oddly enough, Tom never disliked [then-President
Ronald] Reagan, but I think thats because he remembered
him from his movie star days, Esser says. He felt Reagan
didnt understand the whole situation that he was dealing
with AIDS and gay people. He felt that Reagan really just
didnt understand it. Its not that he was anti-gay particularly;
he just didnt really know what he was doing ... I didnt feel so
kindly to Reagan at all. I thought he was just horrible.
Toth and Esser also became involved in the effort to
add sexual orientation to Marylands non-discrimination
law in the 1990s.
He recalls one legislator who was really being ridiculous,
saying really ugly things about us during a hearing on the
measure in Annapolis. One of this lawmakers colleagues
who had refused to listen to his speech asked Toth and
Esser how they could stand to hear his rhetoric.
Tom said, Well we know it isnt true, so we dont worry
about it, Esser says. Of course youve got to ght. You
cant let people say things that arent true and let them
say it without challenging it. And Tom did that. But at
the same time you cant let it stop you. You cant let that
negativism stop you. You have to keep ghting, pushing
against it and thats what Tom really, really did.
Esser notes that Toths life spanned the same period
through which Frank Kameny lived the two met during
the 2000 D.C. Pride parade. And Esser says when they
met, it was as if they were kindred spirits.
They were really speaking the same language, he
says, noting both Esser and Kameny came of age in the
1950s when lobotomies were performed as a way to cure
homosexuality. It was very impressive for me being a
younger person relative to them seeing what these two
men must have come through and how they were both so
determined to do what they were doing. They refused to
back down. They refused to accept what they were being
told they had to accept. They wouldnt do it. And that was
a beautiful thing to me. Its a moment I will never forget.
Mesothelioma that Toth developed from asbestos
exposure while working at a Baltimore shipyard that built
liberty ships during World War II had already taken its toll
by the time Gov. Martin OMalley signed the states same-
sex marriage law in March.
Toth and Esser legally married in D.C. in 2010, but he
wanted to vote for both Question 6 and President Obama
on Election Day. He applied for an absentee ballot
because he did not think he would live until Nov. 6.
It arrived in the mail in early October.
It came and I said do you want to sign it?, Esser, who
fought leukemia at the same time his spouse struggled
with mesothelioma, says. And he said, No, Ill do it
tomorrow. Well the next day he wasnt strong enough.
Toth died three days later on Oct. 11 at age 88.
He never did sign the absentee ballot, Esser says. He
was very aware of what was going on. He was politically

What the law means for
couples, kids and more

Hearing about the rst couples being
issued their marriage licenses, receiving the
happy news of friends planning to get married,
contemplating our own futures, and seeing
couples nally able to marry on Jan. 1, we, as
the rest of our community and allies, are nearly
left speechless by the historical magnitude of
what is happening in our state.
We share the joy, happiness and relief of
knowing that our families will be recognized
and treated with more protections than at any
time in our history. However, because of the
Defense of Marriage Act (DOMA), even if you
do choose to marry, your relationship will be
left unprotected by more than 1,000 federal
laws enjoyed by straight married couples.
Can we marry? The patchwork of
relationship recognition for our families
has evolved quickly in the last 10 years. If
you were legally married in another state
or country, then you are legally married in
Maryland, and you cannot marry again. If
you have a civil union or registered domestic
partnership (including an afdavit of
domestic partnership in Maryland), then you
can marry as long as it is to the same person.
Marrying will carry the additional state legal
recognition and benets. If you have a civil
union or domestic partnership and want to
marry someone else, you need to legally
dissolve your previous status. If you live
outside of Maryland, you can marry without
any residency requirement, but if you live
in a non-recognition state not only will your
marriage not be recognized when you return
home, if you ever need to end your marriage
you may have a problem getting divorced
since your home state wont recognize your
marriage even to end it and Maryland has a
one-year residency requirement for divorce.
What does marriage mean for parenting?
Regardless of your marital status, you must
do a second-parent adoption. Its the only
way to ensure that your parental relationship
to your child, as the non-biological parent,
is recognized and honored by all states.
An adoption order from a court must be
recognized by other states. Two lesbian
moms who are married can be named on
the babys birth certicate, but being named
on the birth certicate does not establish
parentage if you move to a non-recognition
state. Anytime you leave Maryland, you may
be placing the relationship with your child
in jeopardy, because a state that doesnt
recognize your marriage does not have to
recognize all of the things that ow from it,
including your status as a second parent
based solely upon your marriage. Two dads
cannot be named on a birth certicate,
and also need to go through the adoption
process. Once the adoption has occurred,
DOMA does not apply to the parent-child
relationship, and the child is eligible to
receive federal benets that ow from the
second parent (e.g., Social Security benets).
What else can we do to protect ourselves?
Regardless of whether you choose to marry,
you should do your estate planning. As we
know, our families still encounter hostility
from our families, hospitals, funeral homes,
among others, and its important to make
sure weve taken the legal steps to ensure our
wishes are honored. In addition, you might
want to consider re-titling your property to
tenancy by entirities. Its a status only available
to married couples and prevents creditors of
one of the parties from trying to secure an
interest in your home. Until now, same-sex
couples have not had that option.
It also might be appropriate for you and
your partner to create a prenuptial agreement
in order to navigate potential issues including
property, allocation of other resources and
committing to pursue a non-adversarial
method (like mediation or the collaborative
process) if you need to end your relationship
in the future. Because recognition of the
length of our relationships (there may be
a signicant difference between how long
weve been in a committed relationship
and how long that relationship has been
recognized by the state), or the way we view
our family which may be much broader than
what the court would consider our legal
family, the best way to protect ourselves and
our families may be to create a prenuptial
agreement. The agreement can clarify issues
and resources most important to our families,
instead of letting a court make those decisions
for us. We can decide how to best allocate
resources and property, whether alimony
should be considered, and we can have
those conversations when were best able to
have them without conict. Its an opportunity
to have the benets of marriage and also
customize our responsibilities to our families
and make our own decisions. If youre already
married, you also may want to consider a
post-nuptial agreement, which would provide
the same benets of determining the best
outcomes for your family.
What is DOMAs impact? As mentioned in
our Nov. 30 Blade article, because of DOMA,
there are denite drawbacks for some
couples choosing to marry. Its important
to think through how your future might be
negatively impacted by choosing to marry
and recognize the benets that wont be
available until DOMA is repealed. There are
a number of benets that same-sex married
couples wont have access to including Social
Security spousal or survivor benets, veteran
benets, federal health insurance, some
retirement benets and death benets. It also
impacts issues like health insurance coverage
and a multitude of taxes. The U.S. Supreme
Court has decided to hear the Windsor case
challenging the federal denition of spouse
under DOMA as a man and a woman. A
decision is expected in June 2013. This will
be a time for re-evaluation.
As we rejoice in this most signicant step
toward equality in our state, we encourage
you to contemplate the impact that choosing
to marry might have on you, your partner and
your family. For many couples, it is a good
idea to speak to a lawyer rst to make sure you
are fully informed of all the legal implications
while making this important life decision.

Educate the youth and teach them

up in trying to afrm them that we forget to
hold them accountable to being successful
and independent human beings. We
cant baby them we have to demand
excellence and high standards.

Some of the most educated, family
oriented, nancially stable men in our

family structure. We endure and take on so
much emotional hardship that its amazing
that more of us are not suicidal.

I covet the acceptance of my Lord and
Savior into his Kingdom.

KNOWN AT 18?
I wish I had known my parents were
going to die at a young age. I would
have spent more time fostering a more
meaningful and lasting adult relationship
that I can forever cherish. I was so busy on
my education and career grind that I lost
track of time. I now regret that choice.
WHY WASHINGTON?
I am from Virginia and need to be
close to my siblings as I am their primary
caregiver and provider.

Walter Lundy says handing out donated toys to needy Washington-area kids
has become the Christmas-related activity he most looks forward to.
It started modestly last year with what he calls his Red-Themed Toy Drive
Party. He hosted last years event out of his Bloomingdale home. Guests wore
red and brought gifts to his house the weekend before Christmas. On Christmas
Eve, he and a group of friends delivered about 100 toys to about 40 children in
seven or so families.
This year, the Dec. 22 party, which Lundy held at Halstead Tower in Alexandria,
yielded about 250 guests/toys that were delivered to about 100 kids in 10 local
families and a local group home. Lundy worked with the D.C. Department of
Human Services and its Strong Families program, the Greater Urban League
of Washington, the Hubbard Place and the Williams Life Center of Greenbelt,
Md., to identify needy families.
Its a very gratifying experience and its become the complete focus of my
holiday experience, the Petersburg, Va., native says. I feel like this is the
proper way to end the calendar year for me and I intend to do it every year.
Lundy hosted the event with his friend JoVone Pender. They paid for the
party themselves and Lundy says its an important component of the event.
I guess Im just a party type-of guy, he says. I love the toy part of it, of
course, but its also rewarding to give something to the community as well. We
deserve it.
Though not a gay-specic event, Lundy guesses about 90 percent of the
friends who help him deliver the gifts are also black gay men, not all of whom
are out. He says theyre just friends he knows from all over just guys I know
in the same-gender-loving male community.
Lundy works for the D.C. government but declines to give specics. Hes also
in a relationship but says, Well just leave it at that.
Lundy lived in Ohio for much of the 90s, but settled in Washington in 2003. He
lives in Bloomingdale in the fth Ward and enjoys tennis, NASCAR, exercising,
writing, cooking and socializing in his free time.

Screen adaptation of
Broadway warhorse
awed but worthy

By the time the credits roll on Tom
Hoopers cinematic adaptation of the
stage musical Les Misrables, the
audience is well acquainted with every
inch of Hugh Jackmans face.
Sometimes, thats a good thing. You
hear every word plainly and you share
every emotion that passes across that
expressive face. But the obsessive close-
ups highlight the melodramatic aspects of
the story and downplay the complex web
of relationships and themes that structure
the source material.
The movie adaptation is based on the
sprawling 1862 novel by Victor Hugo,
via the incredibly popular 1987 musical
version by Claude-Michel Schnberg,
Alan Boublil and Herbert Kretzmer. The
screenplay, which trims the material to two-
and-a-half hours, is by William Nicholson.
Its essentially the story of Jean Valjean, an
ex-convict who spent 19 years in prison for
stealing a loaf of bread to feed his sisters
starving children.
Newcomer Samantha Banks as ponine
is the standout performer of the all-star
ensemble cast. Her rendition of the new
Broadway standard On My Own is
deeply moving and beautifully delivered.
Sung as the lovelorn ponine wanders
the rainy streets of Paris serving as a go-
between for Marius and Cosette, the song
is an example of Hoopers work at its nest.
The intimacy of the camera work matches
the intimacy of the musical moment and
the nuances of Banks ne acting.
On the opposite end of the emotional
spectrum, Sacha Baron Cohen and Helena
Bonham Carter bring some badly needed
comic relief to the movie as the cynical
Thnardiers. Master of the House, a comic
inventory of the many ways they eece their
unwary guests, is a delightful counterpoint
to the otherwise earnest proceedings. Their
highly effective performances esh out both
the couples considerable charm and their
signicant menace.
The three leads (Hugh Jackman as Jean
Valjean, Russell Crowe as Javert and Anne
Hathaway as Fantine) also offer strong
performances, but their impact is lessened
to various degrees by their limitations
as performers and by Hoopers work as
director. Hooper made movie musical
history by having the actors sing live on
the set instead of lip-synching to a pre-
recorded soundtrack. This often brings
an emotional intensity to the material,
but sometimes undermines the musical
demands of Schnbergs intricate and
complicated score.
For example, Crowe subtly humanizes
Javert, capturing his stern ruthlessness as
well as his profound belief in how human and
divine justice interac t in an orderly society.
Hooper highlights these moments with some
stunning cinematography: Javerts duel with
Valjean in the thrilling Confrontation at
Fantines deathbed, his unfeeling horseback
rides among the poor of Paris and especially
his delivery of Stars while pacing on the
ramparts high above the city.
But theres a critical problem with his
vocal performance as Javert. While Crowe
has a pleasant singing voice (hes been the
lead singer for several bands), hes not the
Broadway belter the role requires. He has
pitch and rhythm problems in the opening
scenes and in his big solo numbers, his
vocal performances fall at. This robs his
excellent work of much of its power. These
problems could probably have been
worked out in the studio, possibly even
with the discreet use of some dubbing.

With the Washington Metro area
housing remaining hot and competitive
and the national housing recovery under-
way, maybe its time to put your house on
the market.
When selling a home, you obviously
want to get as much money as possible
for the property but not everyone knows
how to achieve that goal. While you cant
change the location of your home or turn
a rambler into a colonial, you can make
your home look its best to buyers with
certain easy improvements and changes.
The rst step in preparing your home
for sale is to take a good look at it ob-
jectively. At many residential real estate
rms, several sales agents will tour a
house, not only for pricing, but also to
give the listing agent and the seller tips
on repairs or changes that will maximize
the sales price. Most people are willing
to paint and redecorate if they know they
will come out ahead.
Well-placed repairs and changes can
earn you a return of three to four times
the money invested so clearly certain re-
pairs are worth doing. Here are some im-
provements that can raise the sale price
of your home.
First impressions:
the exterior
If a potential buyer sees a broken shutter,
an overgrown lawn and dying shrubbery and
a dog-scratched front door, you have made a
bad rst impression. This is extremely hard to
counteract later on. Even if the buyer likes the
interior, the damage has already been done
and they are already feeling negative about
the house before they enter the house.
Second impressions:
the interior
Once inside, if they see clutter and
too much furniture or smell lingering pet
odors, you have to make changes. Paint
the interior if needed and get advice on
de-cluttering spaces from your real estate
agent. Your house preparation mantra
should be clutter is bad; sparse is good.
Moving furniture opens up the spaces
and painting gets you the biggest bang
for your buck. If the rooms are small and
crowded, remove some of the furniture and
pack away unnecessary items. Neutrals and
soft colors on the walls are generally best,
with white paint for trim and moldings.
Heavy curtains should be opened up or re-
moved to leave only sheers.
Get rid of dying plants, limit wall pic-
tures, and pack away seasonal dcor, such
as Christmas wreaths in January. Shampoo
the carpeting, or better yet, remove it. Wash
the windows to make them sparkle as dirty
windows make a house look neglected.
Hot spots: the kitchen,
master bedroom and bath
The kitchen gets the most attention
when buyers value a house so spend your
x-up dollars here rst. If the cabinets are
in good shape but outdated, you may get
away with simply painting the cabinets
and changing the hardware. Remove dat-
ed wallpaper, replace old appliances and
consider renishing or replacing ooring.
Eating space in the kitchen is very im-
portant so if it doesnt currently exist, try
to create some space. Put a table in the
adjacent family room or two bar stools
next to a counter overhang which can
be created when you replace the coun-
tertop. A new granite countertop will pay
for itself two to three times over.
All too often, the master bedroom
suite is neglected or cluttered and the
master bath is crowded with toiletries on
every surface, mismatched towels and
old mats on the oor. Luckily, quick xes
can be done cheaply.
In the bedroom, clean out the clos-
ets and pack up clothes you wont need
for awhile. Paint the room in soft colors
and do the bed coverings and curtains in
white or off-white. This gives the room a
quiet, luxurious and larger look.
If the bathroom needs redoing, consider
replacing only toilet and sink and be sure the
tub and shower are scrubbed and caulked.
Old medicine cabinets and light xtures are
also fairly cheap and easy to replace. Buy
matching towels, remove wallpaper and re-
paint where necessary. Use the same xes
for other bathrooms in the house.
The rest of the house
Lets hope all the stuff you just got rid of
in the rest of the house isnt in the basement.
If your basement is overowing, its a good
time to have a garage sale or rent a storage
space. Deal with a wet or damp basement
before you put the house on the market as
even the hint of water is a big turn-off. If the
basement is nished, furnish it carefully, so
you will get full credit for the nished rooms.
The yard is very important and a neat,
mulched yard is appealing and will ap-
pear to be easy to care for, even if it
isnt. Mulch and edge all the beds and
if weather permits, plant owers and
use sod to cover any bare patches in the
lawn; grass seed takes too long.
These recommendations for getting
a house ready to sell do pay off. Selling
your house without these changes and
repairs will get you a lower price than the
size and location your property would
otherwise garner.
