13-01-03 Stanley Fischer and FATCA - secret complaint process in Israeli banking regulation
For months, Bank of Israel's Stanley Fischer refused to respond on inquiries regarding the disposition of complaint against Bank HaPoalim's for its unlawful FATCA-related conduct. Recent conversations with Bank HaPoalim and Bank of Israel staff now indicate that Bank of Israel conducted a confidential review of the complaint, and that its confidential outcome was communicated to Bank HaPoalim, but not to the complainant. Moreover, such confidential communications led Bank HaPoalim to conclude that it was permitted to engage in even more extreme unlawful conduct. Petition, filed with the Supreme Court of Israel alleges that Mr Fischer "substitutes his loyalty to the State of Israel and its laws with loyalty to another nation and its law, and/or with loyalty to financial institutions and their interests." Conduct of Mr Fischer, and Bank of Israel-Banking Regulation should raise concerns regarding integrity and stability of financial systems in the State of Israel. The State of Israel is unparalleled in its unconditional submission to the US FATCA.

Specifically, the petition sought to compel Stanley Fischer to duly register and review a complaint, relative to conduct of Bank HaPoalim, BM, vis a vis purported enforcement the United States FATCA in the State of Israel. [1] In a letter, forwarded today to Mr Fischer and Bank of Israel-Banking Regulation, Mr Fischer is asked to immediately produce to the complainant all records, which a complainant is entitled to receive as part of due process of Banking Regulation Consumer's Complaints, pursuant to the law of the State of Israel. [2] Conversations with Bank HaPoalim, BM, and Bank of Israel staff now indicate that the Bank of Israel eventually registered the complaint against Bank HaPoalim, BM (No 82304-12) and conducted confidential review of the complaint, with no notice or service of any papers on the complainant all along, not even the outcome of the review.

Today's letter to Mr Fischer states that it also appears that outcome of the review of the complaint was in contrast communicated to Bank HaPoalim, BM, and such communications led the Bank to believe that it was permitted to engage in even more extreme unlawful conduct against consumers in this matter. [3] The petition to compel Mr Fischer to duly register and review the complaint alleged that in permitting Israeli banks to enact, adjudicate, and enforce their own version of US law in Israel, Stanley Fischer "undermines the rule of law", "sovereignty of the State of Israel", and "substitutes his loyalty to the State of Israel and its laws with loyalty to another nation and its law, and/or with loyalty to financial institutions and their interests." [2] The petition in the Supreme Court of Israel was subject to a fate that was remarkably similar to the fate of the complaint against Bank HaPoalim, BM at Bank of IsraelBanking Regulation: The office of the clerk of the Supreme Court refused to duly register the petition. [5] Combined, conduct of Mr Fischer, Bank of Israel-Banking Regulation, and the Supreme Court of the State of Israel should raise concerns regarding integrity and stability of financial systems in the State of Israel. Corruption of banking regulation in collusion with the US courts, under the color of lawfulness, has been increasingly recognized as central to the current socio-economic crisis in the United States. [6, and see quotes below] The provisions of the United States FATCA and response to it by various nations, is likely to map the territory of influence of corrupt US banking regulation and the financial crisis. The State of Israel is unparalleled so far in its unconditional submission to the US FATCA.
