For the Association:

A hearing in this matter was held in Windsor on January 12, 2013.

Introduction This interest arbitration was convened to resolve the collective agreement between the Windsor Police Service Board and the Windsor Police Association (hereafter the Association) for the renewal of the Uniform and Civilian collective agreements that expired on December 31, 2010. The Association represents approximately 600 uniform and civilian members. Notice to bargain was served on January 6, 2012. Proposals were exchanged in June 2012. After conciliation, the matters in dispute proceeded to a hearing in Windsor on January 12, 2013. It should be noted that the parties agreed to a four-year term.

In determining the outstanding issues, I have been guided by the legislative criteria. They are set out in the Police Services Act. Both parties referred to them in their written materials and oral submissions. Moreover, both parties made detailed submissions; not just about local economic conditions, but also about economic conditions in the province more generally. All of these submissions have been carefully reviewed. It is axiomatic that the most important of all the governing criteria is replication.

Award Post Retirement Benefits Existing members (including retirees and members hired up to and including December 31, 2014) shall be grandfathered as per the current collective agreements; it is agreed and understood that the eligibility to post retirement benefits under the current collective agreements, but not the nature or quantum of those benefits, for members hired prior to January 1, 2015 will not be the 2

subject of future negotiations. Members hired on or after January 1, 2015 shall have the then active member retirement benefits until the age of 75.

All other classifications to receive equivalent percentage increases together with the same payment schedule. Retroactive payments to be made within ninety days of the issue of this award.

LTD Board shall increase its LTD contribution to the Association from $10,000 per month to $12,500 in 2013 and $15,000 in 2014.

Chiropractic Commencing January 1, 2013, coverage shall be increased to $500.

Vision Commencing January 1, 2013, coverage shall be increased to $350. 3

Psychologist Commencing January 1, 2014, coverage shall be increased to $1,750.

Grievance Language Association proposal awarded.

SIU Indemnity Language to be changed to allow one legal counsel for each subject officer, and one legal counsel for all witness officers collectively.

CID Platoon Schedule Employer proposal awarded effective January 1, 2014.

Civilian Lay-Off Language (c) The Board shall layoff temporary members prior to the layoff of any other member. In the event of layoff, a full time member with seniority may move into another classification, displacing another full-time member with less seniority with an equivalent or lower pay grade. In the event a full time member cannot displace another full time member with less seniority, that member shall be able to displace the lowest seniority permanent part time member provided the full time member has met the necessary testing and/or qualifications required for the part time position as has been established by the employer. Such member(s) will be allowed a maximum of three (3) months to qualify for said classification(s), except if the move is into the communications centre, which shall allow a maximum of four (4) months to qualify. 4

Conclusion At the request of the parties, I remain seized with respect to the implementation of this award.
