Photography Consent and Release Form

I authorize the officers, agents and employees of the District of Columbia Public Library (hereafter the Library) to photograph ____________ (participants name) on ______________, 2013 (date) in the Your Prom Your Way Video Contest. The terms photograph or photography mean any method including photography, filming, videotaping, or any other process of still image or audiovisual capturing in any method used now or in the future that is subject to the United States Copyright Act. (17 USC 101 et. Seq.) I authorize the Library to permit the use and display of the photography in any publication, display, advertisement, or promotion. I also authorize the Library to use ________________ (participants name) name, likeness, biographical information, or quotes. I grant the Library an exclusive, perpetual, worldwide license that includes making the photography available in any format through www.dclibrary.org or other Web-based service via podcasts (multimedia files, such as audio and/or visual distributed over the internet using formats that allow downloading and playback on mobile devices and personal computers). I further grant the Library permission to make and maintain more than one copy (hardcopy and/or digital copy) of the photography for purposes of security, back-up and preservation. I waive and release the Library and its officers, agents and employees from any claim or liability relating to the use of ____________ (participants name) name, likeness, identity, voice, photographic image, video image and oral or recorded statements in the photography. I agree to indemnify the Library, the District of Columbia Government, and its officers, employees, agents, successors, heirs, and assigns, for any and all claims, liabilities, damages, and expenses, including reasonable attorneys fees actually incurred, due to any claimed infringement of copyrights, trade names, trademarks, service marks, right of publicity or privacy, or other proprietary, personal or property right arising from use of the photography.

I agree that the Library shall have the right to cease use of the photography at anytime without prior notice for any reason deemed to be in the Librarys best interest. I understand and agree that the Library shall have exclusive ownership of the copyright and other proprietary and property rights in the photography. To the extent required, I hereby grant and assign all copyright in the podcast to the Library. This Agreement expresses the complete understanding of the parties with respect to the photography and supersedes all prior representations and understandings. I agree to, and accept, all of the terms and conditions contained herein. I acknowledge that I have read this consent and release prior to signing it, that I understand its contents, that I have the authority to consent on behalf of ________________ (participants name) and I agree to let them be photographed.
