Dear Leslie M Garner, Thank you for your reply to my inquiry, the case you have linked to is not

the case I am looking for and I believe I may have been off by one year in my request. All the articles I had found referencing Getty's own internal investigation and the corresponding SEC investigation were from 2007 but it appears that these were all articles done after the fact and it actually took place in 2006 by another article I had found after I had sent my original request. You may read the article at this link http://media.gettyimages.com/article_display.cfm?article_id=145 and in the fourth paragraph it references the SEC conducting an informal investigation in 2006. I understand the confidentiality of the investigations but I had assumed since there were so many articles referring to the investigation that it had become a matter of public record here are several other articles referencing the SEC investigation which led my request for information from you. I will provide three links that have close to 20 articles all from the same time period talking about the investigation but I cannot find any results of it. http://seattletimes.com/html/businesstechnology/2003610937_getty10.html http://markets.financialcontent.com/stocks/news/read/1540406/Keller_Rohrback_Announces_Derivati ve_Lawsuit_Filed_Against_Getty_Images http://www.cfo.com/article.cfm/8159503?f=related There were also two lawsuits from stockholders as a result of the same incident which drug on for about two years and ended when Getty bought back all the shares of stock and took the company private thus ending the lawsuits. The two lawsuits filed from the stockholders were Edmonds v. Getty and Lopez v. Getty. Getty's own internal investigation admitted that there was backdating of stock options yet denied any wrongdoing. I am very interested in the story and if you could provide me with the results of the SEC investigation I would greatly appreciate it. Should you have any other questions please feel free to contact me via email or telephone and I would be happy to assist you in any way that I can. Thank you in advance for your time and your insistence. Regards, Greg Troy (513) 544-7069

Dear Mr. Troy: Thank you for contacting the U.S. Securities and Exchange Commission (SEC). As you may be aware, SEC investigations are conducted on a non-public and confidential basis to help ensure the integrity of the investigative process. In general, the SEC will neither confirm nor deny the existence of an investigation unless, and until, it becomes a matter of public record as the result of a court action or administrative proceeding. I have checked our public database for Getty Images, Inc. but did not find any SEC enforcement actions from 2007. However, I did find a case from 2010 against Arnold McClellan and Annabel McClellan (http://www.sec.gov/litigation/complaints/2010/comp21758.pdf). Is this the case you are seeking? To obtain information about the eventual outcome of this case, or to seek information on an SEC investigation, please contact our Freedom of Information Act Office at 202-551-8300. Sincerely, Leslie M.
