Sub: requisition to take steps to file impleading petition in Civil Appeal 2317/2011, which is pending before Honble Supreme Court by D.M.K Party. -----The Arunthathiyars Communities segregated in slums and ghettos and afflicted by grinding Poverty, Disease, Ignorance, Ill-health and backwardness, and hunted by fear and anxiety, are the constitutional intended beneficiaries of Reservation, not because of the castes or occupations which are merely incidental facts of history, but because of their backwardness and disabilities stemming from identified past or continuing inequalities and discrimination. The Arunthathiyar community is the last rung of the other scheduled castes. For the welfare of the Arunthathiyars, D.M.K. party president Dr.Kalaignar has formed one man committee which was presided by Justice Janarthanam to give preferential reservation to Arunthathiyars. Based on the said committees recommendations Dr.Kalaignar has enacted the Tamilnadu Aunthathiyars (Special Reservation of seats in Educational Institutions including Private Educational Institutions and appointments or posts in the services under the state within the Reservation for the Scheduled Castes Act,2009 (Act 4 of 2009)

-2with effect from 29.04.2009. One writ petition filed by R.Rajasekar subbiah challenged the above said act, Before the Hon`ble Madras High Court Madurai Bench in W.P.(MD) No. 11799 /2010, W.P.(MD) No.12463/2010, W.P.(MD) No.12550/2010 and W.P.(MD) No.13814/2010. The Honble Court was pleased to pass an order in above mentioned writ petitions on 03.02.2011, that The above writ petitions can be disposed of by this court after a decision is rendered by the Supreme Court in SLP(C) No.23507/2010 now named as Civil Appeal 2317/2011 challenging the order of the Punjab & Hariyana High Court made in CWP1829 of 2010 dated 29.03.2010 as the issues raised in these writ petitions are identical.

Thereafter the act was challenged by Krishnasamy by way of writ petition 22096/2012. We have submitted before the Honble Madras high court bench that , the supreme court was pleased to take up final hearing of Civil Appeal 2317/2011 on 07.11.2012 . The said Krishnasamy has filed impelading petition in Civil Appeal 2317/2011. Unless government has impleaded as party in Civil Appeal 2317/2011, prejudice would be caused to the arunthathiyars and also we have chance to express our views as well as status of arunthathiyar. Hence it is just and necessary to file an impleading petition by the Government of Tamilnadu in Civil Appeal 2317/2011. Hence we requested to you please take steps to file impleading petition in Civil Appeal 2317/2011, Which is pending before Honble Supreme Court by D.M.K. Party and to protect the welfare of Arunthathiyar Community. Thanking you yours faithfully,
