The undersigned Assistant City Prosecutor, upon sworn complaint originally filed by the offended party, accuses PEDRO CRUZ of the crime of Infanticide, committed as follows: That on or about the 20th day of August, 2012, at around 10:00 o'clock in the evening, in the City of Manila, Philippines, within the jurisdiction of this honorable Court, the above-named accused, with deliberate intent to kill, motivated with his desire to conceal the extra-marital affair he had with Elena Santos, his step-daughter, did then and there wilfully, unlawfully and feloniously, strangle a baby girl, Angela Santos, born out of his carnal relationship with Elena Santos, who then was only one (1) day old from birth, and as a result of which, caused the former her unexpected and untimely demise.
