The defendant, in violation of Section 565.020, RSMo, committed the class A felony of murder in the first degree punishable upon conviction under Section 565.020, RSMo, in that on or about February 28, 2013, in the City of St. Louis, State of Missouri, the defendant after deliberation, knowingly caused the death of C.R. by striking her with a baseball bat.

PROBABLE CAUSE STATEMENT DATE: March 1, 2013 I, William Briddell, a law enforcement officer for the City of St. Louis, State of Missouri, knowing that false statements on this form are punishable by law, state that the facts contained herein are true. 1. I have probable cause to believe that Rosevelt Scott, a Black Male DOB: XX/XX/41 Age: 71, committed one or more criminal offense(s). Count 1: Murder In The First Degree (Class A FELONY) RSMo 565.020 ON 2/28/2013 Time: 6:15 PM Place: 44XX MARGARETTA AVE (SCC 10021) Count 2: Armed Criminal Action (FELONY) RSMo 571.015 ON 2/28/2013 Time: Place: 44XX MARGARETTA AVE 2. The facts supporting this belief are as follows: The defendant was in a romantic relationship with C.R. and lived with her at 44XX Margaretta. An eye witness told me that on February 28, 2013, the defendant was angry with the victim for an unknown reason and told the victim that he wanted to hit her with a bat. The defendant then retrieved a baseball bat from its place leaning against a television and struck the victim in the head with the bat. The victim fell to the floor and the defendant continued to strike her with the baseball bat. C.R. died as a result of the injuries inflicted by the defendant. Specifically, she had multiple fractures to her skull. The cause of death is blunt force trauma to the head. When I told the defendant that C.R. was deceased, he told me, I tried to kill her.
