Motion for Issuance of a Preliminary Order of Forfeiture in the above styled case. In support

charging him with violating Title 18, United States Code, Sections 2 and 1341 and alleging that
$13,715,219.00 in United States currency represents the proceeds of his crimes and that certain

2. Based upon the evidence set forth in the plea agreement and presented at the plea
hearing held on February 20, 2009, the United States has established the requisite nexus between
the above property and the offense to which the defendant has pleaded guilty. Accordingly, that
property is subject to forfeiture to the United States pursuant to Title 18, United States Code
981(a)(1)(C) and Title 28, United States Code, Section 2461(c), Title 18, United States Code
Sections 982 and Title 21, United States Code, Section 853.

§ 853, the United States shall, to the extent practicable, provide direct written notice to any
person known to have an alleged interest in the seized property, and shall publish notice of this
order and the government’s intent to dispose of the property in the manner prescribed by the
www.forfeiture.gov for a period of 30 days. (See Rule G of the Supplemental Rules for
4. That upon adjudication of all third-party interests, this Court shall enter a Final
Order of Forfeiture pursuant to Title 21, United States Code, Section 853(n), in which all of said
property will be ordered forfeited to the United States to be disposed of according to law.
5. Also in the Information, the United States gave notice to the defendant that, in the
event of his conviction, he would be required to forfeit to the United States all proceeds derived
from the alleged offense(s), specifically: $13,715,219.00 in United States currency which
6. Accordingly, pursuant to Rule 32.2, the United States seeks a personal money
judgment in this case and now the Court must determine the amount of money the defendant will
be ordered to pay. Based on the evidence before the Court, and pursuant to the plea agreement
in which the defendant agreed to a money judgment in the amount of $13,715,219.00, the United
States seeks a money judgment in the amount equal to the proceeds of the defendant’s crimes,
specifically, $13,715,219.00.
7. Additionally, the United States of America, pursuant to Rule 32.2(e) of the Federal
Rules of Criminal Procedure and Title 21, United States Code, Section 853(p), hereby moves for

an order of forfeiture to include certain property of the defendant as substitute property, in place
of certain property that is no longer available for forfeiture and/or to satisfy the money judgment
of forfeiture entered against the defendant. A supporting memorandum and declaration as to the
forfeiture of substitute assets are submitted herewith and incorporated by reference. The

seize the substitute property and/or otherwise ensure its availability for forfeiture and to
immediately commence the ancillary proceedings required to finalize the forfeiture of the
substitute property. Additionally, the United States requests authorization to enter the above
defendant consents, the preliminary order of forfeiture becomes final as to the defendant and
WHEREFORE, the United States respectfully requests that this Court enter judgment of
criminal forfeiture by issuing the proposed Preliminary Order of Forfeiture forfeiting specific
property identified in the Information as well as substitute property and determining and
