AFFIDAVIT

I, ARRA CAMILE RUBIO, Filipino, of legal age, single, residing at No. 5, Pulong Gubat, Balagtas, Bulacan, after having been sworn in accordance with law hereby depose and state the following, to wit: 1. That I am the defendant in Civil Case NO. 2222 entitled SPOUSES MARCELO and MILAGROS ORTEGA represented by their duly authorized and appointed attorney-in-fact, REMIGIO BALMEO, Plaintiff, versus ARRA CAMILE RUBIO, her family, assigns and all other persons acting under her, Defendant. 2. That I know personally the Spouses Marcelo and Milagros Ortega since I became of legal age; 3. That I do not know personally the alleged attorney-in-fact Remigio Balmeo and that I only had known about him when I received a copy the Summons of this Court; (gusto dito na ilagay na never nya na meet si Balmeo at ang nagdala sa kanya ng demand letter is si Apple (anak ni emie) na si apple anng kilala nya na katiwala) 4. That I am the possessor of the property subject matter of this case specifically Lot 1246, but not of Lot 1248, as alleged in the Complaint but I did not come into possession of said property by mere tolerance, as alleged, from 2005; (Gusto ni arra na lagyan dito na since 1995 pa sya in possession para daw maraise and defense ng prescription.) 5. That I had been in negotiations, sometime in June, 2005, with the Spouses Ortega to purchase Lot 1246 only; 6. That I and Spouses Ortega had come to a final agreement for my purchase of said Lot on September 7, 2005; as evidenced by a Deed of Sale of same date. (Exhibit 1); (somewhere sa part na ito gusto ni arra na istate nya na pinakita sa kanya yung title at wala pa yung 2007 na annotation at that time para mapreempt yung ibbutas sa atin na 2007 lang narecon yung title.)

7. That the Spouses Ortega had instructed me to meet them at the office of their lawyer Atty. Pablo Ramos who will prepare the Deed of Sale; on said date where we will sign the document and I will tender to them the payment; 8. That I tendered the agreed price for Lot 1246 only (Exhibit 1-A) in the amount of THREE HUNDRED SEVENTY NINE THOUSAND PESOS (Php 379,000) (Exhibit 1-B) and after which I signed the Deed of Sale Exhibit 1-C); 9. That I personally saw the Spouses Ortega (Exhibit 1-D and 1-E) sign the document and after which it was signed by Atty. Ramos (Exhibit 1-F) and it was dated September 7, 2005 (Exhibit G); 10.That I was given a copy of the Deed of Sale and was told by Manuel Ortega that after Lot 1248 was sold, they will tell me to be ready for the processing of the new Transfer Certificate of Title;

11.That I took possession of the property immediately thereafter and have built a concrete structure as my residence and have remained in possession of the property as its owner continually from 2005 until today; 12.That upon receipt of the Demand letter and Summons of the Barangay on March 2012; It was my belief that a mistake may had been made as I knew at that time that the Spouses Ortega was not in Bulacan as they had been always traveling abroad for extended periods of time; 13. That I immediately went to the residence of the Spouses Ortega in Marilao but was informed by neighbors that the Spouses Ortega was abroad and someone was only checking in on their house; 14. That I learned, after I had received the Summons of this Court, that the person designated as attorney-in-fact in the Complaint, was one introducing himself in the neighborhood as the caretaker of the Spouses Ortega 15.That (dadagdagan to ni aref about damages saka attorneys fees)
