Attachment C-Site Safety and Accident Prevention Scheme


1. The Sub-Contractor covenants that he shall at all times comply with the requirements of the Contractor relating to health and safety and the provisions of the Site Safety and Accident Prevention Scheme (hereinafter called the Scheme) set out hereunder. The Scheme is intended to arouse the awareness of the Sub-Contractor to the importance of working safely on Site and to the prevention of accidents. It is not intended to punish the Sub-Contractor for having accidents but to call for greater attention to be paid to site safety through certain financial contributions by the Sub-Contractor. Such contributions will be allocated to a fund held by the Contractor called Accident Prevention Promotion Fund (hereinafter called the Fund). For the avoidance of doubt, any contributions so made shall not relieve the Sub-Contractor of his obligations and liabilities under the Sub-Contract. 3. The Fund will be used to finance safety promotion on sites, e.g. safety awards and safety competitions. Upon completion of the Contract, the balance of the Fund, if any, will become the asset of the Contractor and be allocated to his other projects for safety promotion. If the Sub-Contractor fails to rectify any non-compliance of the safety requirements within the date specified in a written notice served by the Contractor, the Contractor may at his discretion rectify such non-compliance on behalf of the Sub-Contractor and without prejudice his rights under demand the Sub-Contractor to contribute a sum to the Fund which sum is equivalent to 100% of the costs sustained by the Contractor for so doing. The Sub-Contractor shall make the following contributions to the Fund for each and every such incident: -

xvii) Fail to comply with any aspect of the Contractors safety policy, safety plan or safety procedures as from time to time given to the Sub-Contractor 7.

All contributions to the APPF shall be made by way of deduction from payment due or which may become due to the Sub-Contractor. It is expressly agreed that each and every one of the Contractors decisions on the contributions prescribed above is final and binding as between the Contractor and the SubContractor. The Sub-Contractor shall observe and comply with the requirements in all enactment, ordinances and regulations in relation to the employment of qualified personnel, including but not limited to competent persons and certified workers in the execution of the SubContract Works. The Sub-Contactor s attention is specifically drawn to Annex 1 of this Attached Document C which gives as guidance to the Sub-Contractor a list of enactment, ordinances and regulations in relation to the employment of qualified personnel. This list is not exhaustive and the Contractor shall not be held responsible for any representations, errors, omissions or mistakes therein. The Sub-Contractor shall not be relieved of his duties, obligations and liabilities whatsoever under any of the enactment, ordinances or regulations, whether or not included in Annex 1.
