PREFACE

1.1 Work Order for Services on labor with material basis for the RCC works of WING J1 Swapnanagari site, Chakan. 1.2 M/S Shree Sai Associates. Chakan (hereinafter referred to as BUILDER ) 1.3 Mr. Shankar Mukesh Bagadi (Hereinafter referred to as CONTRACTOR) The Contractor will be responsible for execution of the all the work in accordance to this Work Order, in particular the detailed in article 2. 1.4 TOTAL AREA FOR RCC WORKS: 1.5 TOTAL COMPENSATION : ARTICLE: 2 Approx 87466 sq ft.

@ Rs. 123/- sq ft (Rupees One hundred Twenty three per Sq.ft)

SCOPE & PERFORMANCE OF WORK CONTRACTOR

2.1 In general the scope of the Contractor will include the provision and supervision of Labor, material and shuttering for RCC works for the Buildings of approx.87466 sq.ft. Designed for the structure as defined in the architectural and RCC drawings provided to the contractor. 2.2 All concreting works pertaining to the Building will be carried out by the contractor, including the footings, beams, columns, slabs, RCC for elevation treatment if any, PCC for footings and plinth. All concrete works will be carried out using concrete mixer and weight batcher on site. Mix design to be approved by the owner representative.

2.3 All shuttering material used on site including sides, bottoms, Slab Plywood, supports etc. should be of excellent quality and should meet the requirements of the Owner. MS plates with good quality will be permitted. 2.4 Cutting and provision of steel as per RCC designs will be done by the Contractor. Contractor will be responsible to correctly stack the steel delivered at site. Collect and properly store small cut pieces of steel in the area provided to the contractor.

Line out: Line out and setting out of the structure as per measurements and architectural drawings will be carried out by the Contractor. Excavation and Backfilling : Excavation up to the desired level will be

done by the Client. Cleaning, dewatering and minor dressing of the footing pits will be done by the Contractor. Backfilling of the excavated area will be done by the Client, leveling and compaction will be done by Contractor. Any support labour required for this activity will be provided by the Contractor. Compaction machine of minimum 500kgs to be used for compaction.

Any support labour required for this activity will be provided by the Contractor. 2.6 Foundation: Casting of footing, providing a mason for finishing of the works, provision and fixing of shuttering and casting on site of stub RCC columns, plinth beams and tie beams. Formation of the plinth level, PCC / Concreting for the plinth, BBM if any required in the plinth will be done by the Contractor. 2.7 Columns: Setting up column center, casting of initial starters, and final shuttering of columns, including checking of location and position, line and plumb will be contractors responsibility. Sides of the columns will be deshuttered as per the instructions of RCC consultants. Hacking of the same will be done within 3 days from the casting of columns. In case of columns and lift pardi, the contractor will be required to provide appropriate shuttering to take the load / jerk of pumped concrete. 2.8 Beams: All beams will be monolithically casted along with the slab. Appropriate beam bottom will be provided. Supports for beam bottom will be provided at every 3 ft. Cross supports will be provided to all supports. Beam sides may be removed 24 hours from time of casting. Beam bottom supports to be maintained for min. 14 days from the date of casting, in case of beams greater 4.5m length and cantilever, supports to be removed after 21 days. All the de-shuttering will be done in accordance with RCC consultant. Hacking for the beams to be done within 24 hours from the time of opening a side.

2.9 Slabs: Casting of slabs will be done monolithically along with the beams. Provision of proper support for the steel in the slab will be done. Supports for the slab will be provided in a fashion similar to the beams. Slab supports may be removed only after a min. of 7 days from the date of casting of the slab or as directed by Engineer on site / RCC Consultant. 2.10 Sills and Lintels: Contractor will appropriately cast the sills and lintels utilizing the spare bars / cut pieces available in the store. Casting of lintels and sills will be done in line with the casting of beams and slabs. Hacking will be done for the sills and lintels. Labour work for drilling in columns, beams for grouting of steel will be the Contractors responsibility.

2.11

Over Head Water Tank: All concreting works pertaining to the OHWT of Approx 50,000 Liters will be carried out by the contractor, including the beams, columns if any, slabs, RCC Pardi, as per the architectural and RCC drawings. Appropriate size cover blocks will be provided for all concreting works. All concrete works will be carried out using concrete mixer and weight batching or volumetric batching as approved and accepted on site. Mix design to be approved by the builder representative prior to any concreting works.

2.12

Hacking and filling up honeycombing of all concreting works will be done by the contractor within 24 hours from the date of de-shuttering. Curing of all works will be the responsibility of the contractor upto 28 days from the date of casting.

2.13 2.14

All curing work will be the responsibility of the contractor, including the ponding on the slab. Hacking of all the RCC members, cleaning, finishing the honey comb areas is contractors responsibility.

2.15

Completion Period Time is the essence of this order and hence the execution schedule should be strictly adhered to. In general the complete RCC works for the said building will be completed latest by 15 JAN 2014, including overhead storage tanks. The schedule as attached to be strictly followed. 1. Contractor shall abide by the schedule agreed upon by the Parties for execution of the Work and shall throughout the term of the Order co-operate with Builder to avoid any delays in the completion. In case of delay in completion penalty clause will be charged by Rs1/sq ft/day contractor as per decided by Project In charge. ARTICLE: 3 3.1 TOTAL COMPENSATION TO THE CONTRACTOR

For all the works described in this order, a fixed and firm compensation @ Rs. 123/- sq ft (Rupees ONE HUNDRED AND TWENTY THREE RUPEES per square feet) shall be given to the work contractor. The total area under consideration will be the end to end measurements of the slab, deductions for ducts will be made, deduction for lift duct will not be made in any slab, bottom slab of the lift room and the water tank will be included in the area. No extra payment will be made for elevation features and double height shuttering. The paragolas will be considered as per carpet area. No extra payment will be made for plinth work. The above Compensation shall include all taxes and duties. Service tax as applicable shall be paid to the contractor. The Builder, if applicable, will deduct any Tax, at source as per prevailing provisions of the law. Payment terms and Invoicing Procedure will be as per attached. Retention of 5% of the total cost will be done and returned after a period of 6 months from the date of completion. 2 (two) copies of Contractors invoices along with supporting documents duly certified by Site Engineer, clearly indicating the Order number shall be addressed to the Builder and submitted to the Builder Site office.

ARTICLE: 4 4.1

SAFETY & GENERAL RESPONSIBILITIES

Contractors personnel deputed for the Work shall abide with all rules & regulations including the safety procedures prevailing at Site/ Office and shall be medically fit to perform the Work.

4.2

The Builder shall not be liable for any claim for loss or profits or any other consequential or direct / indirect damages that may be suffered by the Contractor during the execution of the work.

4.3

Contractor shall at all time keep the Builder fully indemnified against any consequences arising out of Work Contractors own or on account of Contractors default or negligence.

4.4

The contractor shall take all safety measures on site such as safety helmets, safety belts, labor insurance etc. In case of any mishap on site only the contractor will be responsible for any consequences arising for such a situation. The contractor will not have any claim for the same.

4.5

No child labor will be permitted to work on site. If anyone is found, the Builder has the authority to stop the work immediately. During any governmental inspection if the same is identified, the contractor will be solely responsible for the consequences.

Labour insurance shall be provided by the contractor. Security of material will be contractors responsibility. Barricading at each floor to be provided by contractor to avoid any mis-happening. Safety net shall be provided from 4th slab level by the contractor. Safety net will be provided by the client.

All the slabs will be casted in one attempt only. No electric supply for individual rooms in labor camp will be provided. General and Statutory Obligations: All statutory obligations, permits, licenses etc. in respect of the Work shall be done by the Contractor. Insurances for the Contractors personnel and Equipment as applicable and in accordance with project requirements shall be arranged by the Contractor at his own cost and will submit a photocopy of all licenses and permits to the Builders office before starting work.

ARTICLE: 5

TERMINATION OF WORK ORDER

51. At the Completion of Works or 52. The Work Order shall be terminated in case of misbehavior, disobedience, dishonesty or negligence on the part of Contractor and/or his personnel or Contractors failure to execute, complete and deliver the Work within the specified / reasonable time as decided by the Builder. Upon any such termination, the Builder shall pay in accordance with the following: All amounts due and not previously paid to Contractor for Work completed in accordance with the Order prior to any notice of termination, and for Work completed thereafter as specified in the notice, after deducting an amount as may be considered suitable to adjust for loss of work caused due to the Termination. The Builder has all rights, to recover from the Contractor, any loss that is incurred or foreseen due to the Contractors default. The Builder shall not be held responsible for any damage, either direct and / or indirect, to the Work Contractor consequent on his exercising his right to early terminate or suspend the Order.
