Subject: - Grant of consequential benefits of Selection Grade, promotion etc. consequent upon fixation of inter-seniority of erstwhile so called unadjusted B.T./B.Ed teachers under 25% reserved quota under Punjab and Haryana High Court judgement dated 02-05 1972 on civil writ petition No. 3852 of 1971, titled as Sat Parkash V/S State of Haryana ----------Issuance of one month legal notice by Sh. Rajendra Parkash Gupta, retired as Headmaster on attaining superannuation on 30-04-1993 A.N. from Govt High School, Gumthala Garhu (Distt Kurukshetra) for antedated promotion. I Shri Rajendra Parkash Gupta ____ undersigned sponsor serve you with this following legal notice of one month. 1. That I entered the service of Haryana Education Deptt, as JBT teacher on 14-07-1954. On acquisition of higher qualification of M.A., B.Ed, I was awarded master grade of 110/250, w.e.f. 09-08-1959, the date of my passing B.Ed. I was regularly absorbed as Master in grade of 110/250 w.e.f. 01-01-1960 with the allotment of seniority no. 66 in the seniority list of Masters state cadre- Men branch of 01-01-1979. Consequent upon this I was awarded selection grade 700/1150 w.e.f. 01-12-1979. Subsequent, I was promoted as Headmaster w.e.f. 22-121981, with seniority No. 741 vol-II in the seniority list of Headmasters of 01-01-1985.

My promotion from Master to Headmaster on 22-12-1981 has not been awarded on due date, as was done in case of some 67 Headmasters who were awarded antedated promotion from Masters to Headmasters w.e.f. 02-05-1972, under Director of Schools Haryana Chandigarh Order No. 6/64-79-E1(4) dated 19-01-1987, as they were allotted seniority of 01-01-1979 in Masters cadre w.e.f. 01-10-1960. 3. My case for antedated promotion, like these Headmasters was left out and not considered besides my continuous and sufficient correspondence /representations dated 20-01-1986, 21-081987, 0203-1990,04-04-1990, 25-02-1991, 06-05-1991, 10-04-1992 and 10-011994. In the last representation dated 19-01-1994, I was informed vide DPI, Haryana memo no. 4/22-94-E1(4) dated 01-03-1994(Photo copy attached) that my case for antedated promotion as Headmaster will be considered after finalisation of CWP No.17907/1991, titled as Gian Parkash Jagga V/S State of Haryana. This CWP was finalised by the Punjab and Haryana High Court, Chandigarh on 28-04-2010. But my case of antedated promotion was not yet considered, besides sufficient lapse of time since 28-04-2010 and that too on my registered representation dated 23-04-2012. 4. The antedated promotion of Headmastership is invariably due to me with effect from 27-07-1973 the date when sh. Ranbir singh next below junior to me at seniority No. 67(of 01-01-1979) was promoted, if it does not become due w.e.f. 02-05-1972. 5. It is also pointed out that Principals grade 2200/4000 becomes due to me after about 15 years of date of award of antedated promotion of Headmastership. The refixation of my seniority as Headmaster on antedated promotion 02-05-1972/ 27-07-1973 is to be done by the competent authority of Haryana school Education department, by doing so, the refixed seniority will warrant, whether Principal grade 2200/4000 becomes due to me or not, keeping in view the seniority of Sh Ranbir Singh, which is next below junior to me. The seniority no. in the seniority list of Headmasters of 01-01-1985 allotted to me at no. 741 vol II is therefore absolutely wrong and I do not admit it as correct for all intents and purposes.

Page - 3 6. In view of the foregoing paras, it is quite clear that the ways and means adopted in this matter by the department to do the needful do not justify ends. Accordingly, I am undergoing a great monetary loss, which may run into lakhs of rupees due to inaction on the part of Director General School Education Haryana Panchkula of the Haryana School Education Deptt. My peace of mind has already been exhausted, as the antedated promotion in my case has not been considered since 19-01-1987, when 67 Headmasters were granted antedated promotion and that too since 28-04-2010, the date of finalisation of CWP no. 1797 of 1991. Heavy delay has been causing in this matter. Rule of natural justice has not been followed in my case. My fundamental rights----- Right to equality and Right against exploitation are infringed upon. I have been the condemned child under these circumstances and events, while 67 Headmasters were being blessed with antedated promotion, have become the favoured children of the state. Here lies the clear discrimination. 7. Accordingly I therefore pray that the antedated promotion may please be settled/awarded within one month of the receipt of this legal notice, failing which, I will be compelled to put the law into motion. After the expiry of one month, I will file the legal case in the competent court established by the law and the state will be responsible for the cost, interest, damage etc. To be incurred by me in the pursuit of the case.
