CG ASAP Tenancy Agreement

Duration of Tenancy: six months, commencing on the 3rd April 2013. Tenancy Schedule and Renewal: The Landlord and the Tenant/s may agree to continue this tenancy agreement after a minimum and initial 12 months period. If The Landlord and the Tenant/s agree to continue this tenancy agreement any tenancy extension and renewal will be overseen by CG Associated Services and Products Ltd, who will prepare the new contracts on behalf of both parties, subject to their standard charges. Agreed 6 month Rent: The agreed rent is 2100 euro, equal to 350 euro per month. Deposit and Payment Schedule: The Tenant/s agree/s to pay a deposit of 350 euro against this Tenancy Agreement and subject to the Tenancy Agreement Conditions contained herein. The Landlord accepts and the Tenant/s agree to pay 350 euro at the signing of this Tenancy Agreement, being equal to one months advance payment and covering the first months rent due. The tenant agrees that the monthly rent will be paid by standing order direct to the Landlords bank account, details of which follow. Bank: Alpha Bank ........................... Financial Obligations: During the tenancy agreement, the Tenant is responsible for the payment of all electricity, water, municipal and telephone bills. Furthermore, the Tenant is obliged to register and transfer the aforementioned services in their name. The Tenant is responsible (not applicable to communal pools and grounds) for the routine pool maintenance (if any) including provision of the pool chemicals, also to maintain the gardens and grounds within the perimeter of the property, all of which are to be kept at a hygienic and tidy standard throughout the tenancy period. In the event that the Tenant/s fail/s to transfer water, municipality and electricity services in to their names within fourteen days working days of the commencement of the rental term, the Tenant/s acknowledges that the Landlord reserves the right to terminate the agreement. Each party acknowledges it is their responsibility to undertake and make their own insurance arrangements. Landlord and Tenant acknowledge and agree that CG Associated Services and Products Ltd will not be bound, expected or obliged to perform any further duties on behalf of either party until the tenancy agreement is due to expire at which point a renewal or new contract may be required between the parties In the event that either party wishes to commission CG Associated Services and Products Ltd for an additional service, it is agreed that CG Associated Services and Products Ltd fees will be levied at their normal rates and charged accordingly. 2. Extension or Termination Tenancy: If the Landlord and the Tenant agree to continue the tenancy agreement the rent may be increased after the first year by a percentage, which both parties will agree to, and takes into account the rise in inflation. In any case the increase will not exceed 4%. In the event that either party wishes to terminate this Tenancy Agreement, both parties agree that a written Notice to Quit must be presented by the instigating party to the recipient party at least one month prior to the departure date, after an initial period of 5 months. 3. Late Payment of Due Rent: The Tenant agrees that rental monies are to be paid within seven working days of the due date for each respective month, therefore in the event of two consecutive delays in payment of more than seven working days, the Tenant/s acknowledges that the Landlord reserves the right to terminate the agreement. 4. Use of Property: The Tenant agrees to peacefully use the property as residence for himself/herself, close family and bonafide persons. Any other use of the property is not allowed. The Tenant acknowledges that the keeping of pets at the premises is entirely at the Landlords discretion. 5. Restriction: When the tenancy agreement is over, the Tenant must deliver the property back to the Landlord without any objection and in the same condition as when possession was taken, subject to fair and reasonable wear and tear. The Landlord has installed the equipment set out on the attached schedule (if any) of fixtures and fittings. 6. Damages: During the tenancy, the Tenant is obliged to keep the property in a good and proper condition, being accountable for restoring any damages caused by himself/herself and/or any bonafide person. The Tenant is obliged to notify the Landlord immediately in writing of any apparent defect in the premises, other than such as the Tenant is liable to remedy himself/herself. The Landlord acknowledges receipt of a deposit (nil interest applied, and being equal to one months rental) from the Tenant as a guarantee for keeping the terms of this tenancy agreement. At the end of the term and once the keys have been returned to the Landlord or his/her agent, an inspection and inventory will be carried out. The Landlord agrees to then repay the deposit to the Tenant after deducting any rental arrears or any other sums due as a result of any breach by the Tenant of his/her obligations, and also providing that:- All household bills are paid and final receipts are available. - The property is returned in the condition it was let. The deposit cannot be used by the Tenant for monthly rent and if it is not used for the above purposes, then it must be returned fully to the Tenant when the tenancy agreement expires. 7. Other Conditions; 7(a). The Landlord or his/her agent has the right to periodically inspect the premises, subject to 24 hour notice. The Tenant agrees the Landlord may show future prospective tenants the property once they have given the Landlord Notice to Quit and agrees to not hinder the Landlord/Agent during these visits. The Tenant further agrees that an emergency inspection may be made at the discretion of Landlord or his/her agent, if the property or tenant are considered to be at risk, whereupon an inspection report will be complied and a copy sent to the Tenant. 7(b). This tenancy agreement embodies the entire understanding of the Landlord and the Tenant and there are no promises, terms, conditions, or obligations, oral or written, expressed or implied other than those contained. 7(c). The violation of any of these terms by the Tenant or the Landlord shall give the right to either party to terminate the lease and/or take judicial measures against the other party, including recovery of unpaid rent or unreturned deposits. 7(d).
