filed an application titled Apparatus for measuring linear density of elongated textile material in Chennai on 28/07/2005. The application was rejected on the 25th of February 2011. The purpose of this device is to measure the linear density of a yarn test specimen. The patentee claims that the simultaneous testing yarn/sliver/roving and it handling of electronic signals of two different materials having different physical properties is an inventive step since it is a technical advancement over the prior art. Claim 2 of the instant patent deals with the process of determination of the linear density of the specimen proportion, which is a technical advancement over the prior art. Determination of both well defined length and weight will lead to that evaluation means, which will further evaluate the values and provide a liner density of the specimen. Arrangement of the feeding system in the instant invention is entirely different that the inventive feature of the apparatus as claimed in claim 3 is providing laying arm and roller with which the feeding specimens are automatically fed in to the test apparatus. Manner of determining the optical yarn characteristic of the Present invention is entirely different where light source is a non monochromatic. Device for determining hairiness of the thread like element where light source is used which is not laser. The application was rejected based on the fact that the above claims made by the patentee is obvious to a person skilled in the art and offers no technical advancement. However, the device is a definite improvement over the previous art by combining multiple features in one device. If the inventive threshold is lowered down for this patent, it has a good chance of being granted a UM. 1523/MUM/2005 M/s. Mercury Laboratories Limited from Baroda, Gujarat filed an amended application on 6th October, 2008 with the major claim being A process for enhancing the activity of an enzyme comprising addition of cyclodextrin to an enzyme in an aqueous solution at a temperature range of 15 to 37C wherein the said aqueous medium has an enzyme concentration in the range of 9.8 - 96M and wherein the molar ratio of said cyclodextrin and said enzyme is in the range of 1:1 10:1. It got rejected because of the lack of inventive step. According to the examiner, The only difference between the method of the present application and the cited art is that in the prior art it does not specifically teach use of alpha-amylase obtained from Aspergillus oryzae, however, the use of said alpha-amylase from Aspergillus oryzae is merely one of several straightforward possibilities from

which the skilled person would select, in accordance with the circumstances, without the exercise of inventive skill, in order to solve the problem posed in the prior art. Therefore, the inventive step for the subject-matter of amended claims 1 to 2 is not acknowledged over the above cited art. As a result, what is claimed in amended claims 1 to 2 failed to meet the requirements of Section 2 (1) (j) of the Act. However, under the UM Law, the specific use of alpha-amylase from alphaamylase from Aspergillus Oryzae to enhance the process will be reviewed to see if this specific process can be recognized.

1688/MUM/2006 Nano Cutting Edge Technology Pvt. Ltd from Mumbai, Maharashtra filed an amended application on 9th June, 2010. The major claim of the application is about An antimicrobial formulation comprising in a carrier, silver nano -particles of average particle size of 1 to 100 nm and concentration in the range of 1 to 100 ppm stabilized biologically with an aqueous solution of macerated plant tissue cells in combination with hyaluronic acid having concentration in the range of 0.05% to 5%. The application was rejected on the fact that it would have been clearly obvious to motivate one of ordinary person skilled in the art at the time of invention to utilize the antimicrobial formulation of D4 and to modify that formulation by adding the hyaluronic acid as taught by D1 and D5 because the prior art suggests it is very routine to use the hyaluronic acid in combination with an antimicrobial metal such as silver for making an effective antimicrobial formulation even at low concentration of silver particles as clearly taught in D4, which could be seen as an alternative antimicrobial composition for solving the underlying problem. Thus, the teachings of D4 D5 and D1 suggest reasonable expectation of success by one of ordinary person skill in the art in obtaining the claimed formulation of present application without exercise of inventive skills. Therefore, the inventive step is not acknowledged for the subject-matter of amended claims 1-7. The fact that the anti-microbial formation is novel in its idea of creating an effective antimicrobial formulation at low concentration of silver, the inventive step has been disregarded because of the claim that it will be obvious for a person skilled in art to figure this out. Therefore, it becomes a strong case for being considered for UM.

477/MUMNP/2008 ELI LILLY AND COMPANY filed an application on 13th Match, 2008 titled PYRAZOLE-ISOQUINOLINE UREA DERIVATIVES AS P38 KINASE INHIBITORS. As indicated by the title, Pyrazole-Isoquinoline Urea Derivatives are being used as kinase inhibitors. This application was rejected on the fact in a previous art, ureido-pyrazole derivatives and their use as kinase inhibitors are explained. The main difference is that the applicant has replaced the naphthyl ring with an isoquinoline ring. The effect of these rings at this position is similar. Therefore, the problem of finding further kinase inhibitors has been solved in an obvious manner. However, the problem of finding further kinase inhibitors has been solved but according to the patent law, its not a big enough inventive step to be considered for a patent but may qualify for UM based on its effectiveness. 1496/MUM/2009 Hindustan Organic Chemicals Limited, Mumbai, Maharashtra filed an application on 24/06/2009 for a novel process for the evaluation of hydrogenation catalyst in Mumbai. Objections were raised based on the prior art since it already mentions a low temperature oxidation process for increasing the hydrogenation activity using cobalt. Another document mentioned the process of regeneration of molecular averaging catalyst via hydrogen treatment. Based on these two documents, it was said that it would be obvious for the person skilled in the art to figure out goup VIII elements hydrogenation catalyst by oxidation-reduction cycle. The applicant clarified that the accelerated test co nsisted of reduction oxidation cycle under specific conditions elaborated in the patent specification and recording the temperature variations during the same for reference as well as required catalyst samples and comprising them quantitatively. D1 teaches oxidation process for increasing catalyst activity whereas D2 teaches regeneration via hydrogen treatment. This invention does not describe any process to increase activity or to regenerate any catalyst but it reveals an improved accelerated test to quickly judge/evaluate the performance of hydrogenation catalyst sample of copper chromite or chrome free copper oxide with reference to a standard catalyst and hence is non-obvious. However, the officer rejected this. This application has got a UM potential because it establishes novelty and also defines a process that improves upon a previous method.

727 MUM 2006 OmniActive Heath Technologies Pvt Ltd filed this application entitled Xanthophyll Crystals Containing Trans-Mesozexanthin and Process For Its Preparation on 10th May 2006. Based on prior art, it can be observed that the process disclosed therein is a catalytic isomerization whereas the process defined in this application is thermal isomerization. The applicants process has been accepted as novel and having inventive step. However, the product claims were not accepted. The applicant devised a process for conversion of (trans, R,R)-lutein which is the major component of total xanthophylls to (trans,3R,3S,meso)-zeaxanthin when added with phenyl carbinol and potassium hydroxide under specific reaction conditions. Prior Art disclose the same approach except the nature of the solvent in which the reaction is carried out. The product of the prior art is similar to that of the claimed invention and hence no technical advancement or economic significance has been realized to make the invention inventive. However, the totality of the application can be considered for a UM since the end product even though similar to prior art might be different enough to qualify for a UM Patent.

1428/CHE/2004 This application entitled Illuminating device arrangement for a scooter type vehicle with storage box below the seat was filed by TVS Motor Company on 24/12/2004.

The invention talks about a detachable light stationed in the storage boxes of scooters that can be used to light up the storage box and since itll be detachable, it can be used for other purposes too. The patent was rejected on the basis of being obvious to a skilled person prior art discloses something similar - a self-illuminating storage box for a scooter type vehicle comprising a light source accommodated within the box; Another prior art disclosed a set of electric charging means provided for the vehicle, and another set of electric charging means provided for the light source, the said two sets being detachably attached to each other such that the light source is also detachably attached to the box. Based on the above prior art, the application was rejected as it lacked inventive step. However, the idea is novel and can be considered for a UM patent. 2189/MUM/2007 This application entitled THERMAL INSULATION SYSTEM/KIT FOR INSULATING HOT PIPES AND THE PROCESS FOR MANUFACTURING THE SAME was filed PRS Solutions on 02/11/2007. In this application, the applicant has figured out a way to maximize the thermal insulation using thermal tapes inside the hot pipes. This application was rejected on the basis of lacking inventive step and also lack of description about the invention. However, such an application, which improves upon a previous technology and potentially, be a more cost-effective solution can be considered for a Utility Model Patent.

2760-chenp-2005??? An application entitled "Internal Combustion Engine Operated with two fuels that have different knock resistance" with the International filing date of 23/4/2004.

The highlight of this technology is that the Internal Combustion Engine it is able to distinguish between two fuels with different knock resistances. It does this by metering the quantity of air-fuel mixture to be supplied based on the signal indicating 393/CHENP/2004 Idemitsu Kosan Co. Ltd. filed an application on 21/8/2001. The application aims to find a process for oligomerisation of ethylene that prevents precipitation of polymer in circulating lanes. The solution that the applicant suggest is achieved by maintaining the temperature of reaction medium in the reactor at 115 C or more through the use of an external heat exchanger, which is designed to cool the reaction medium to a temperature not lower than 110 C. The prior art clearly defines that the reaction medium should always be kept at a temperature of 100 C to 130 C in order to ensure that any polyethylene formed will be kept in solution and no clogging will be formed in the circulating lines. The applicant claims that the present invention includes an external circulating heat exchanger for a greater heat transmitting efficiency and further claimed that a greater heat transfer area could be obtained as compared with the process by using a jacket of reactor. However, the application has been rejected on the basis that these modifications will be obvious to a person skilled in the art and lack incentive step. UM Law however can be helpful to get this process protected since it is an iterative improvement to an existing process. 811/DEL/2003 Frito Lay India filed an application titled as AN IMPROVED LAMINATE FILM filed on 17/06/ 2003. The: An outer layer of a polymer selected from polyester, polyethylene tereph thalate (PET), polypropylene terephthalate (PPT), polyethylene naphthal ate (PEN), oriented polyamide (OPA), oriented nylon (ONY), polybutyle ne terephthalate (PBT), polyhydroxy benzoate (PBT), biaxially oriented polypropylene (BOPP) and polyvinyl chloride (PVC) the layer being optiona lly printed; A core layer of polyethylene; An inner layer composed of a polymer selected from polyethylene, and polymide cast polypropylene, and metallized on its inner side, the metallizati on being effected using plasma atmosphere; wherein the thickness of the la yer is in the ratio of 1:2:1.

The main aim of this invention is to this film is used for packaging, which provides superior barrier properties to moist ure and oxygen permeation through the film and the intermediate polyethylene la yer acts as an adhesive layer; and there is a substantial reduction in the overall thickness of the package.
