A better relationship between city, provl governments looms

TACLOBAN CITY- A better relationship between the city and the provincial governments is looming with Tacloban reelected mayor, Alfred Romualdez, heaping praises with Leytes incoming governor, Leopoldo Dominico Petilla. Romualdez, who is on his way of serving his third and last term, said that he is looking forward in working with Petilla who belongs to the family considered to be the main political rival of the formers family. I know Dominic. I think I can better work with him, let us see, Romualdez said. The Tacloban city mayor stood as a wedding sponsor of the new Leyte governor whose family has supplanted the Romualdez dominance in the province. The relationship between the city and provincial governments appear to be thorny due to a number of reasons which include ownership issue on various real properties located in Tacloban. Both are claiming ownership on these properties like a portion of the Magsaysay Boulevard and the RTR Plaza which even reached to the courts. to page 2

Despite the high classroom shortage, Department of Education (DepEd) Assistant Regional Director Rebecca Ragrag assured that no classes will be held under a tree or outside a building on Monday. If there are academic classrooms that are being used as principals office, canteens and libraries, they should vacate those in favor of classrooms. Remains of Marine slain by ASG in Sulu to be brought to Gen. MacArthur town

TACLOBAN CITY The remains of one of the seven Philippine Marines slain in an encounter with Abu Sayyaf bandits in Sulu last Saturday will be brought to his hometown in General MacArthur, Eastern Samar on Wednesday. Jessa Sabejon, wife of slain Private First Class (Pfc.) Dominador Sabejon, Jr. said the remains of her husband is still at the Philippine Marines headquarters in Fort Bonifacio in Taguig but will be flown to Tacloban and later to General MacArthur. Its heart-breaking. I hope justice will be served to my husband and his comrades, Jessa said in a mobile phone interview. Jessa said she learned of her husbands death through a phone call from his comrade in Sulu. I am proud of my husband for fighting against the lawless elements in Sulu but his death is something that is hard to accept. TACLOBAN CITY - The Department of Public Works and Highways (DPWH) Second Leyte Engineering District (2nd LED) is working double time to construct one-classroom school buildings in time for school opening on Monday. District Engineer Margarita Junia said they are eyeing to finish all the 37 one-classroom buildings by June, two classroom buildings by August, and three-classroom buildings before the end of 2013. These are realistic targets since one-classroom buildings can be

The district implements school building program in 66 elementary and secondary schools. These projects, funded by the Department of Education and channeled through DPWH, will comprise 128 classrooms that will benefit thousands of basic education students in 12 municipalities of Leytes second district. All projects are ongoing except for two, due to realignment. The district engineering office is also working to complete road improvement and preventive maintenance activities before the opening of classes to ensure safety of pupils and students. Junia said clearing of sidewalks will ensure the safety of the students walking to and from their schools. Ragrag admitted that classroom shortage problem is recurring every opening of a new academic year but this has been gradually addressed every year. KABLAS: A Glimpse on the Quality and Competency of Education in a remote Community

Hermano Two years ago, a team of seven students from the Eastern Samar National Comprehensive High School (ESNCHS) of Eastern Samar Division made an admission to the DepEd-SMART Schools Program sponsored National Contest DOON PO SA AMIN (DPSA) aimed for students to make a documentary on extra-ordinaries in their community through webpage form or multimedia. The title of the entry is KABLAS or impoverished which intends to tell a story of a 13 year old boy and his struggle to get a good education studying in ESNCHS coming from a far-flung sitio. The boy, in his first year high school, would travel to and from home for four hours every Monday and Friday. One can imagine why he chose to pursue those trek torments when he can instead enroll in a barangay high school very close to where his home is. This situation baffled me as a coach to the team so I silently examined separately from facilitating the team project. I asked why he opted to study in ESNCHS with all the adversities attached to it and he gave me a bundle of reasons but of which, two wedged my attention: that ESNCHS is right at the very heart of the city where basic student necessities are found and teachers are far more competitive than the ones in their nearby school. Fact: teachers teaching in outlying barangays are mostly from the city center. We asked permission from the chief of the village for us to stay overnight and we were warmheartedly offered to sleep in one of the three elementary classrooms. The next day we were given the opportunity as well to witness the teacher-pupil-classroom scenario. Typical prayers to start the day off then proceeded with the lessons. Along the course, we were stunned to witness a very inappropriate, very uncalled for, very bungling unskilled and ineffectual teacher lecturing pupils about the DIFFERENT REGIONS IN LUZON: Rehiyon I ILOCOS Rehiyon II LAMBAK CAGAYAN, Rehiyon III GITNANG LUZON, Rehiyon IV - CALABARZON, Rehiyon V MIMAROPA, Rehiyon VI REHIYON NG BIKOL, Rehiyon VII CORDILLERA ADMINISTRATIVE REGION, Rehiyon VIII NATIONAL CAPITAL REGION. Is the teacher a product of a highly competitive ranking system for hiring teacher-professionals or a political appointee so I heard of the term? Was the district supervisor SUPERVISING at all? Was she the primary reason why the boy opted to do contemptible sacrifices just to get a quality education he earns at ESNCHS? Are we heading into a right direction or into a reprehensible future? There is still hope. Im not an indifferent person more so an indifferent teacher. Borongan City has its new DepEd City Division Office with very proficient supervisors installed on it. I am counting on them and I look forward to a better tomorrow for our country.

OFTEN understood as a lowly and useless virtue, humility actually enhances our humanity. It is what keeps our dignity as persons and as children of God in a realistic way. Many times, we fall victim to our own illusions and delusions about ourselves, and the many other ways and forms, very subtle at that, that pride can blind and mislead us. For example, we always like to get our own way, or to make ourselves the hero in a particular situation while diminishing the role of the others, or we can even speak badly about ourselves, so that the others may form a good opinion of us, etc. Conceit grips us. We have to be keenly aware of the deceptive ways and tricks of pride. Humility clears our vision, showing both our wretchedness and our greatour spiritual life. We become easy prey to our weaknesses and the temptations around. To persist in developing other virtues and to wage continuing ascetical struggle would hold no charm to us. We have to understand though that humility is a function of our self-knowledge that in turn is a function of our knowledge and love for God. Its he who knows us objectively. After all, he is our Creator and Father. And he intervenes in our life all the time. He is never far nor indifferent to us. We should disabuse ourselves to gain selfknowledge by simply relying on some self-analysis using human sciences, like philosophy, psychology or sociology, etc., that are not

To achieve this, though, is a heft task zeroing on the challenge of not dichotomizing ones entire being, separating the secular from the religious life. One has to be conscious that God is watching all the time, illustrating it in a form of jest that life should be likened to a cellular phone, that is, when one is about to commit sin, the phone will alarm. In telling the truth and truth alone, the media practitioners, according to spiritual advisers, do not only help themselves to become holy but can also be instruments for other people to be holy. We like to flaunt the good things we have, and we become extremely embarrassed when our weaknesses and mistakes get known. We should realize that humility involves some kind of abandonment of our own selves, unafraid of being known as we are. When we commit mistakes, we, like the prodigal son, should go back to God whose delight it is to forgive and to strengthen us. Yes, humility is what leads us to ask for forgiveness when we fall. Humility liberates us from own foolishness.

Departing from being a priest-centered religion, the lay ministry is gaining acceptance among the faithful. Big parishes in urban areas had long commissioned laymen to assist in the giving of host during communions. This was the most conspicuous role of laymen in the church. Some people could hardly accept laymen and still look up at and for the priest when receiving Holy Communion. Others appears doubting but are forced to receive the host from laymen anyway for practical reasons like being situated afar from the cue leading to the priest. Over the years though, laymen are being given more active and significant role in the Catholic Church. More than being called to assist in the distribution of host in the Holy Eucharist, laymen are now being trained to also spread the Word of God as well. This allows a complete community celebration of the liturgies, both of the Word and the Eucharist with the lay minister as leader of the community prayer. The celebration is done in the absence or unavailability of a priest to celebrate Holy Mass. Instead of mere old folks reciting the Holy Rosary and novenas in church during Sundays, the entire community now has the opportunity to celebrate the Word and Eucharist even without a priest. The lay minister is granted authority to proclaim the Word and share some reflections then give communion to the faithful. The celebration is akin to the Holy Mass minus the part on the consecration as the hosts are already consecrated for the community prayer.

Without this innovation, people in rural areas and remote places that cannot be reached by the priest are deprived of hearing the Word and receiving Holy Communion. This makes the Basic Ecclesial Communities a responsive thrust of the Catholic Church to the spiritual needs of the faithful. Because of this new program, Catholics will now have the opportunity to fulfill their Christian obligations, especially that of attending Holy Mass on Sundays. We now have no excuse of failing to attend Holy Mass as there is now an equivalent substitute. This will save the faithful from

the church that constantly remind rivals to set aside bitterness and division caused by political conflicts within their turf. This is a concern that goes beyond telling the truth especially that some people contend that truth is relative, depending on whose side of fence one seats. Biblically, there is only one truth, according to spiritual leaders the truth that is based on the fear of God.

No. 60443 emanating from the cadastral proceedings involving the subject land and other records from the cadastral proceedings, more than fifty years ago, in 1932, the Director of Lands filed with

the Court of First Instance of Leyte a petition for the settlement and adjudication of titles over certain lands in the Ormoc Cadastre. One of the lands included in the proceeding was Lot No. 689 located in the town (now city) or Ormoc, containing an area of 338 square meters, more or less. For several years, no one laid claim to this Lot No. 689 despite notice having been given in accordance with law. In 1932, the cadastral court ordered all claimants to file their claims for the subject lot on February 4, 1933. Despite several extensions granted by the Court motu propio, nobody filed a claim on the said lot. So, an order of general default was issued and the dismissal of the cadastral proceeding as regards said lot was ultimately entered. 9. On July 22, 1940, defendants who stated that they were the legitimate children and only heirs of the deceased spouses, Segundo Garcia Fernandez and Eulogia Alvarez, filed a petition with the Court of Appeals to lift the order of default based on Section 513 of the old Code of Civil Procedure which was however dismissed on technical grounds by decision rendered on September 27, 1940. 10. In 1940, after receiving the adverse resolution of the Court of Appeals, defendants abandoned the land believing that they could no longer claim any right over the land since their petition was dismissed. 11. Defendants were never citizens of the Philippines; they were never in actual, open, continuous, exclusive and adverse possession of the land in the concept as owner. Defendants were all the time living in Spain as they were residents and citizens of Spain. In fact, defendants are not in possession of the title of the land. In addition, during the cadastral proceedings and the proceedings before the Court of Appeals and Supreme Court, defendants never appeared in person. In fact, in his letter-reply to Atty. Teoduro T. Carvajal, the Spanish consul to the Philippines stated that as per letter of the Mayor of Langreo, Asturias, Spain, there is no record in the Municipality of Langreo, Asturias, Spain that defendants were residing thereat from 1981 up to 1988. A copy of the letter is hereto attached as Annex B. 12. Lot No. 689 is a private property. However, having been abandoned by the original owner, the land is one without an owner; and as such, it pertains to the state as part of the patrimonial property under the principle that lands without an owner belong to the state. While the same cannot be acquired by occupation under Article 714 of the New Civil Code, it can be acquired by the law on acquisition prescription as provided in Article 1113 of the New Civil Code. Said Article 1113 provides thus: All things which are within the commerce of man are susceptible of prescription, unless otherwise provided. Property of the state or of any of its subdivisions not patrimonial in character shall not be object of prescription. 13. Plaintiffs have been in open, continuous, adverse and peaceful possession in concept of an owner of the subject parcel of land (Lot 689 located in Burgos St., Ormoc City) for more than fifty (50) years. 14. Plaintiffs have paid the taxes due thereon. 15. Plaintiffs have not been sued over the subject lot as they never received judicial summons involving the subject lot. 16. As such, plaintiffs have acquired ownership over the land by virtue of the law on acquisitive prescription as provided in Art. 1137 of the New Civil Code which provides thus: Art. 1137. Ownership and other real rights over immovables also prescribe through uninterrupted adverse possession thereof for thirty years, without need of title for of good faith (1959a) 17. Original Certificate of Title No. 0-592 for Lot 689 is null and void inasmuch as defendants were never citizens of the Philippines; they were never in actual, open, continuous, exclusive and adverse possession of the land in the concept as owner. Quick look at the Holy Retreat for the Media held at the Archdiocese of Palo Chancery in Palo, Leyte on May 26, 2013.

Local media practitioners, together with Rev. Fr. Amadeo Alvero and Sr. Gemma de la Cruz of the Archdiocese of Palo Social Communications Commission, pose for souvenir photo before the start of the Holy Retreat for the Media on May 26, which is part of the month-long Jubilee of the Mass Media held in celebration of Diamond Jubilee of the Diocese of Palo in Leyte.

Fr. Alvero(left photo) warmly welcomed the members of the fourth estate, who are collectively named Media for Christ and introduced the retreat master (Ret.) Rev. Fr. Oscar Lorenzo (center), who vividly explained how media practitioners could attain holiness while being in the practice of information dissemination. Sr. Gemma (right) added few inputs worth the note.

Among those who gave their reaction to (Ret.) Rev. Fr. Oscars discussion were Francisca Babes Custodio, manager of DyVL; publisher Nestor Abrematea; LSDE columnist Al Ellema; RTV-12 and DVBR program host/reporter Roger Tilana; information officer Mercy Caboboy; and veteran journalist Felipe Vertudes.

The media practitioners later proceeded to the Palo Cathedral, a pilgrimage site and passed through the Porta Sancta (Jubilee Door) to complete their Holy Retreat.

At the open forum facilitated by LSDE columnist Eileen Ballesteros, veteran journalist Rollie Montilla, LSDE staffwriter/editor Joey Gabieta and other newsmen had the chance to get the words right from Archbishop John Dus lips on matters related to the recently concluded elections, the plans and programs of the Archdiocese of Palo, the Archdiocese reaction to scandal that a priest allegedly got entangled in and the RCAPs claim over some properties in Palo and Tacloban, including the Rizal Park located across the Sto. Nio Church in Tacloban.
