However, other tobacco products, including "little cigars" (cigarettes wrapped in paper containing tobacco), snuff and other smokeless tobacco products were not included in the prohibition. We believe that action should be taken to correct this oversight. THE PROBLEM Tobacco avorings are intended to mask from tobacco product users, particularly new users, the harsh, toxic properties of tobacco smoke and spit tobacco. In addition to mint, Skoal today is sold in peach, cherry, apple, vanilla and berry avors. The US Smokeless Tobacco's marketing campaign has been tremendously successful, more than

doubling the prevalence of snuff use among adult males, and among males 18 to 24, increasing it more than six-fold. By 2008, The Centers for Disease Control reported that 13% of male high school students in the U.S. used smokeless tobacco. If anything, cigars, especially "little cigars," provide even more egregious examples of this marketing strategy. Swisher Sweets come in cherry, strawberry, peach and grape avors. Captain Black little cigars are sold in "Peach Rum," "Tahitian Cherry," and "Madagascar Vanilla" varieties. And then there's HBI International, which produces wrappers in more than 30 avors including Milk Chocolate, Absinthe, Tequila, Peaches & Cream, Mango, Bubblegum and Chocolate Chip Cookie Dough. ACTION NEEDED Despite the federal ban on avored cigarettes, avored cigars and smokeless tobacco products continue to attract new young, users. A restriction to adult-stores only for the sale of all avored tobacco is a much-needed step to protect children and to reduce their risk of nicotine addiction and the subsequent lethal effects of tobacco. New York City has enacted a restriction, which was recently upheld by the 2nd U.S. Circuit Court of Appeals in New York. ACS CAN strongly is supportive of Assembly Bill 1179, sponsored by New York State Assemblywoman Amy Paulin. This legislation seeks to enact similar restrictions to the New York City ban. By restricting the sale of about 25 percent of cigars and less than 20 percent of moist smokeless tobacco to adult-only tobacco shops, New York would reduce children's access to the avored varieties that most appeal to them, without denying them to adults.
