Attached to this memorandum is an executed subpoena to Nextel

Communications.

On the above listed date, a subpoena was served on Ursula Patterson, Supervisor,
Subpoena Compliance Unit, Nextel Communications, 2001 Edmund Halley Drive,
Reston, VA.

The subpoena requested all records for telephone number 310-877-5039 from
December 1, 1999 through March 31, 2000 inclusive. This cell telephone was in the
control of Qalid Benomrane.

Ms. Patterson advised that it may take Nextel Communications up to 60 days to

obtain the records from the company's archives.

Pursuant to lawful authority, YOU ARE HEREBY COMMANDED to

produce no later than April 23, 2004, at the offices of the National
Commission on Terrorist Attacks Upon the United States, 301 7th Street,
S.W., Room 5125, Washington, D.C., or at a mutually agreed location,
the books, records, correspondence, memoranda, papers, and documents
set forth in Attachment A.

Any contumacy or failure to obey this subpoena may subject you to

sanctions and penalties provided by law.

This subpoena to be served by any member of the staff of the National

Commission on Terrorist Attacks Upon the United States.

Subject: Request for Nextel Subpoena

Team la, headed by Dieter Snell, has requested that you authorize a subpoena for telephone
records relating to their investigation of the plot and the hijackers.

The request would be addressed to NEXTEL for records relating to a particular phone number
for the period December 1999 through March 2000. That phone number belonged to a foreign
national who lived in the Los Angeles area who has provided potentially significant information
to the FBI that may shed light on the activities of 9/11 hijackers al-Hazmi and al-Mihdhar in
California in early 2000. The FBI has not sought these records.

Please let me know if you would like any further details.
