Background On December 21, 2000, the Secretary establ i shed wi thi n the Nati onal Organi c Program (NOP) (7 CFR part 205) the Nati onal Li st regul ati ons secti ons 205.600 through 205.607. The Nati onal Li st i denti fi es the syntheti c substances that may be used and the nonsyntheti c (natural ) substances that may not be used i n organi c producti on. The Nati onal Li st al so i denti fi es nonsyntheti c nonagri cul tural , syntheti c nonagri cul tural , and nonorgani c agri cul tural substances that may be used i n organi c handl i ng. The Organi c Foods Producti on Act of 1990 (OFPA), as amended (7 U.S.C. 65016522), and USDA organi c regul ati ons, i n secti on 205.105, speci fi cal l y prohi bi t the use of any syntheti c substance i n organi c producti on and handl i ng unl ess the syntheti c substance i s on the Nati onal Li st. Secti on 205.105 al so requi res that any nonorgani c agri cul tural and any nonsyntheti c nonagri cul tural substance used i n organi c handl i ng must al so be on the Nati onal Li st. Under the authori ty of the OFPA, the Nati onal Li st can be amended by the Secretary based on recommendati ons devel oped by the NOSB. Si nce establ i shed, AMS has publ i shed mul ti pl e amendments to the Nati onal Li st begi nni ng on October 31, 2003 (68 FR 61987). AMS publ i shed the most recent amendment to the Nati onal Li st on September 27, 2012 (77 FR 59287). Thi s fi nal rul e amends the Nati onal Li st to enact fi ve recommendati ons submi tted to the Secretary by the NOSB on November 5, 2009, and December 2, 2011. . V. Statutor y and Regul ator y Author i ty The OFPA, as amended (7 U.S.C. 65016522), authori zes the Secretary to make amendments to the Nati onal Li st based on proposed amendments devel oped by the NOSB. Secti ons 6518(k)(2) and 6518(n) of the OFPA authori ze the NOSB to devel op proposed amendments to the Nati onal Li st for submi ssi on to the Secretary and establ i sh a peti ti on process by whi ch persons may peti ti on the NOSB for the purpose of havi ng substances eval uated for i ncl usi on or del eti on from the Nati onal Li st. The Nati onal Li st peti ti on process i s i mpl emented under secti on 205.607 of the USDA organi c regul ati ons. The current peti ti on process (72 FR 2167, January 18, 2007) can be accessed through the NOP Web si te at http:/ / www.ams.usda.gov/ nop. A. Executi ve Order 12866 Thi s acti on has been determi ned not si gni fi cant for purposes of Executi ve Order 12866, and therefore, has not been revi ewed by the Offi ce of Management and Budget (OMB). B. Executi ve Order 12988 Executi ve Order 12988 i nstructs each executi ve agency to adhere to certai n requi rements i n the devel opment of new and revi sed regul ati ons i n order to avoi d undul y burdeni ng the court system. Thi s fi nal rul e i s not i ntended to have a retroacti ve effect. States and l ocal juri sdi cti ons are preempted under the OFPA from creati ng programs of accredi tati on for pri vate persons or State offi ci al s who want to become certi fyi ng agents of organi c farms or handl i ng operati ons. A governi ng State offi ci al woul d have to appl y to USDA to be accredi ted as a certi fyi ng agent, as descri bed i n secti on 6514(b) of the OFPA. States are al so preempted under secti on 6503 through 6507 of the OFPA from creati ng certi fi cati on programs to certi fy organi c farms or handl i ng operati ons unl ess the State programs have been submi tted to, and approved by, the Secretary as meeti ng the requi rements of the OFPA. Pursuant to secti on 6507(b)(2) of the OFPA, a State organi c certi fi cati on program may contai n addi ti onal requi rements for the producti on and handl i ng of organi cal l y produced agri cul tural products that are produced i n the State and for the certi fi cati on of organi c farm and handl i ng operati ons l ocated wi thi n the State under certai n ci rcumstances. Such addi ti onal requi rements must: (a) Further the purposes of the OFPA, (b) not be i nconsi stent wi th the OFPA, (c) not be di scri mi natory toward agri cul tural commodi ti es organi cal l y produced i n other States, and (d) not be effecti ve unti l approved by the Secretary. Pursuant to secti on 6519(f) of the OFPA, thi s fi nal rul e woul d not al ter the authori ty of the Secretary under the Federal Meat nspecti on Act (21 U.S.C. 601624), the Poul try Products nspecti on Act (21 U.S.C. 451471), or the Egg Products nspecti on Act (21 U.S.C. 10311056), concerni ng meat, poul try, and egg products, nor any of the authori ti es of the Secretary of Heal th and Human Servi ces under the Federal Food, Drug and Cosmeti c Act (21 U.S.C. 301399), nor the authori ty of the Admi ni strator of the Envi ronmental Protecti on Agency under the Federal nsecti ci de, Fungi ci de and Rodenti ci de Act (7 U.S.C. 136136(y)). Regul atory Flexi bi l i ty Act The Regul atory Fl exi bi l i ty Act (RFA) (5 U.S.C. 601612) requi res agenci es to consi der the economi c i mpact of each rul e on smal l enti ti es and eval uate al ternati ves that woul d accompl i sh the objecti ves of the rul e wi thout undul y burdeni ng smal l enti ti es or erecti ng barri ers that woul d restri ct thei r abi l i ty to compete i n the market. The purpose i s to fi t regul atory acti ons to the scal e of busi nesses subject to the acti on. Secti on 605 of the RFA al l ows an agency to certi fy a rul e, i n l i eu of prepari ng an anal ysi s, i f the rul emaki ng i s not expected to have a si gni fi cant economi c i mpact on a substanti al number of smal l enti ti es. Smal l agri cul tural servi ce fi rms, whi ch i ncl ude producers, handl ers, and accredi ted certi fyi ng agents, have been defi ned by the Smal l Busi ness Admi ni strati on (SBA) (13 CFR 121.201) as those havi ng annual recei pts of l ess than $7,000,000 and smal l agri cul tural producers are defi ned as those havi ng annual recei pts of l ess than $750,000. U.S. sal es of organi c food and non- food have grown from $1 bi l l i on i n 1990 to $31.4 bi l l i on i n 2011. Sal es i n 2011 represented 9.5 percent growth over 2010 sal es. 1 Accordi ng to USDA, Nati onal Agri cul tural Stati sti cs Servi ce (NASS), certi fi ed organi c acreage exceeded 3.5 mi l l i on acres i n 2011. 2
Accordi ng to NOP s Accredi tati on and nternati onal Acti vi ti es Di vi si on, the number of certi fi ed organi c operati ons i n the U.S. has more than doubl ed over ti me from approxi matel y 7,000 operati ons i n 2000 to over 17,000 operati ons by the end of 2011. Of these operati ons, over 4,900 are organi c handl ers, over 10,000 are organi c crop producers, and over 1,900 are organi c l i vestock producers. AMS bel i eves that most of these enti ti es woul d be consi dered smal l enti ti es under the cri teri a establ i shed by the SBA. n addi ti on, the USDA has 84 accredi ted certi fyi ng agents who provi de certi fi cati on servi ces to producers and handl ers. AMS concl uded that the economi c i mpact of thi s amendment to the Nati onal Li st, i f any, woul d be mi ni mal to smal l agri cul tural servi ce fi rms and may spur further devel opment of organi c annatto producti on. Comments Recei ved on Proposed Rul e AMSNOP120016; NOP12 07PR AMS recei ved 43 comments on the proposed rul e AMSNOP120016; NOP1207PR. Comments were recei ved from organi c producers and handl ers, manufacturers of peraceti c aci d and si l i con di oxi de products, a nonprofi t organi zati on, an i ndustry group, speci al ty food i ngredi ent processors and di stri butors, speci al ty food products manufacturers, three trade associ ati ons, accredi ted certi fyi ng agents, an organi c consul tant, and pri vate ci ti zens. Most comments favored amendi ng the Nati onal Li st wi th the changes descri bed i n the proposed rul e. Four comments stated general opposi ti on to the al l owance of any substance on the Nati onal Li st, but di d not provi de speci fi c comments on the proposed amendments. Comments recei ved for each substance are further descri bed bel ow. One comment opposed the use of geneti cal l y modi fi ed organi sms (GMOs), whi ch i s outsi de the scope of thi s rul emaki ng acti on and i s al ready prohi bi ted under the USDA organi c regul ati ons at secti on 205.105(e). Comments on the proposed amendment for beta-carotene extract col or and removal of annatto extract col or were supporti ve of the acti ons as proposed. Therefore, AMS i s fi nal i zi ng the amendment and removal of these substances, respecti vel y, as proposed through thi s fi nal rul e. Changes Based on Comments Peraceti c Aci d AMS recei ved 24 comments regardi ng the proposed change to peraceti c aci d. Most comments supported a conti nued al l owance for peraceti c aci d i n organi c crop producti on. A few comments i ndi cated that peraceti c aci d shoul d not be al l owed, but di d not provi de i nformati on on al ternati ve practi ces or other materi al s that are avai l abl e as al ternati ves to i ts use. The majori ty of commenters requested that AMS revi se the proposed annotati on for peraceti c aci d to i ncl ude the word al so at the begi nni ng of the second sentence, and to ci te the l i sti ngs for hydrogen peroxi de at secti ons (a)(4) and (i )(5). Thi s amendment was suggested to cl ari fy that peraceti c aci d i n hydrogen peroxi de formul as at concentrati ons l ess than the stated percentage wi l l not be subj ect to the peraceti c aci d use restri cti ons. AMS agrees and has accepted thi s change, wi th modi fi cati on. AMS has i ncl uded the word al so and the paragraphs l etters that were requested, i .e., (a) and (i ). AMS di d not i ncl ude the subsequent number i n paragraph l etter (i .e., (a)(6) or (i )(8)) i n order to avoi d the need to renumber these l i sti ngs i f substances are added or removed from paragraphs (a) or (i ) of secti on 205.601 at a l ater date. n the proposed rul e, AMS speci fi cal l y requested comments that i denti fi ed any formul ated hydrogen peroxi de products l abel ed for agri cul tural use that contai n more than 5% peraceti c aci d and that may be i mpacted by the rul emaki ng acti on. Three comments addressed thi s topi c. AMS recei ved one comment from an organi c mushroom producer that uses a formul ated product that contai ns 5.6% peraceti c aci d. AMS al so recei ved two comments from chemi cal suppl i ers that requested that the percentage of peraceti c aci d be rai sed to 6% and 17%. n revi ewi ng the comments, AMS consi dered the i ntent of the NOSB recommendati on to restri ct the amount of peraceti c aci d by annotati on to onl y al l ow hydrogen peroxi de products that contai n a smal l amount of peraceti c aci d and that are subj ect to new l abel i ng requi rements under EPA. The i ntent of the NOSB was not to al l ow organi c peroxi de products contai ni ng hi gh l evel s of peraceti c aci d up to 17%. After consi derati on of the comments, AMS has amended the annotati on for the fi nal rul e to i ncrease the percentage of peraceti c aci d i ncl uded i n the annotati on from 5% to 6% as i ndi cated on the pesti ci de product l abel . AMS has i ncreased thi s percentage up to 6% to ensure that the formul ated products currentl y used i n the marketpl ace woul d conti nue to be al l owed i n organi c producti on. mpl ementati on Peri ods n the proposed rul e, AMS requested comments that descri bed whether product reformul ati on wi l l be necessary and the ti meframe that wi l l be needed to compl y wi th the proposed amendment for si l i con di oxi de at secti on 205.605(b) and the proposed removal of annatto extract col or from secti on 205.606. AMS recei ved seven comments regardi ng the ti meframe that organi c handl ers need to i mpl ement the amendment to si l i con di oxi de, rangi ng from i mmedi atel y to four years. Two commenters requested an effecti ve date of two years. One commenter requested 34 years, and another requested 46 months. Further, the harvest season for organi c peaches wi l l begi n i n June; wi thout thi s fi nal acti on, potassi um hydroxi de can onl y be used to peel peaches for frozen product.
