Changes Based on Comments
Peraceti c Aci d
AMS recei ved 24 comments regardi ng
the proposed change to peraceti c aci d.
Most comments supported a conti nued

be al l owed, but di d not provi de
i nformati on on al ternati ve practi ces or

The majori ty of commenters requested
that AMS revi se the proposed
annotati on for peraceti c aci d to i ncl ude
the word al so at the begi nni ng of the
second sentence, and to ci te the l i sti ngs
for hydrogen peroxi de at secti ons (a)(4)

suggested to cl ari fy that peraceti c aci d

concentrati ons l ess than the stated
percentage wi l l not be subj ect to the
peraceti c aci d use restri cti ons. AMS
agrees and has accepted thi s change,
wi th modi fi cati on. AMS has i ncl uded
the word al so and the paragraphs

(i )(8)) i n order to avoi d the need to
renumber these l i sti ngs i f substances are
added or removed from paragraphs (a)
or (i ) of secti on 205.601 at a l ater date.
n the proposed rul e, AMS
speci fi cal l y requested comments that
i denti fi ed any formul ated hydrogen
peroxi de products l abel ed for
agri cul tural use that contai n more than
5% peraceti c aci d and that may be
i mpacted by the rul emaki ng acti on.
Three comments addressed thi s topi c.
AMS recei ved one comment from an
organi c mushroom producer that uses a
formul ated product that contai ns 5.6%
peraceti c aci d. AMS al so recei ved two
comments from chemi cal suppl i ers that
requested that the percentage of
peraceti c aci d be rai sed to 6% and 17%.
n revi ewi ng the comments, AMS
consi dered the i ntent of the NOSB
recommendati on to restri ct the amount
of peraceti c aci d by annotati on to onl y
al l ow hydrogen peroxi de products that
contai n a smal l amount of peraceti c aci d
and that are subj ect to new l abel i ng
requi rements under EPA. The i ntent of
the NOSB was not to al l ow organi c
peroxi de products contai ni ng hi gh

consi derati on of the comments, AMS
has amended the annotati on for the fi nal
rul e to i ncrease the percentage of
peraceti c aci d i ncl uded i n the
annotati on from 5% to 6% as i ndi cated
on the pesti ci de product l abel . AMS has

Changes Requested But Not Made
Peraceti c Aci d
One commenter i ndi cated that i t i s
not cl ear why peraceti c aci d shoul d be
al l owed, but di d not provi de
i nformati on on the avai l abi l i ty of
al ternati ve practi ces or materi al s. AMS
recei ved many comments from certi fi ed
organi c growers i ndi cati ng the need for
thi s substance; therefore, thi s materi al
shoul d conti nue to be permi tted i n
organi c crop producti on.
One commenter supported the
proposed acti on, but i ndi cated that
l i mi ti ng the al l owance of peraceti c aci d
to fi re bl i ght i s not expansi ve enough,
and that i t shoul d be al l owed wi thout
any restri cti on. An expanded al l owance
for peraceti c aci d was requested i n the
peti ti on consi dered by the NOSB.
3
The
expanded al l owance requested was not
recommended by the NOSB due to
concerns over the i mpact of broad
spectrum use on soi l mi crobes. Upon
revi ew, AMS concurs wi th the NOSB
recommendati on and has not accepted
the commenter s suggesti on for an
expanded use.

One commenter supported the
proposed acti on and proposed l anguage
that woul d add must be fol l owed by a
fresh water ri nse to the text of the
annotati ons for peraceti c aci d at
paragraphs (a)(6) and (a)(8) of 205.601.
However, no rati onal e for thi s addi ti on
was provi ded. We have not accepted
thi s suggesti on. Thi s substance i s used
i n organi c crop producti on as sani ti zer

requi rement on the l abel for a
freshwater ri nse. Further, the added
process of a freshwater ri nse coul d

One commenter i ndi cated that AMS
shoul d not restri ct the percentage and

Potassi um hydroxi de
AMS recei ved ei ght comments
regardi ng the proposed change to
potassi um hydroxi de. Some
commenters supported the change as
proposed. Some commenters opposed
any expansi on of the use of thi s
substance i n organi c handl i ng, but di d
not i ncl ude data on avai l abl e al ternati ve

One commenter i ndi cated that the
al l owance for potassi um hydroxi de
shoul d not be expanded si nce thi s
materi al i s toxi c to human heal th and
that i ts use has adverse effects on the
envi ronment. The commenter al so noted
that potassi um hydroxi de i s not al l owed
i n organi c handl i ng i n the European
Uni on or by the nternati onal Federati on
of Organi c Agri cul ture Movements
(FOAM) standards. AMS has
consi dered the comment, as wel l as the
status of potassi um hydroxi de under the
regul atory authori ty of the Food and
Drug Admi ni strati on (FDA). Accordi ng
to FDA, potassi um hydroxi de i s
general l y recogni zed as safe (GRAS)
when used as a formul ati on ai d, a pH
control agent, a processi ng ai d or a
stabi l i zer and thi ckener (21 CFR
184.1631). The FDA regul ati ons further
provi de that substances general l y
regarded as safe i n food may be used to
wash or to assi st i n the peel i ng of frui ts
and vegetabl es (21 CFR 173.315). As
such, AMS agrees wi th the NOSB
recommendati on that the annotati on for
potassi um hydroxi de shoul d be revi sed
to al l ow i ts use i n any peach processi ng
(e.g., frozen, canned), as there are no
commerci al l y vi abl e al ternati ves for
peel i ng peaches. n compari son to the
previ ous al l owance for thi s substance to
peel peaches that woul d be i ndi vi dual l y
qui ck frozen, there i s no addi ti onal ri sk
to the human heal th or the envi ronment
by expandi ng the al l owance of
potassi um hydroxi de for peel i ng
peaches for other types of processi ng
(e.g., canni ng). Therefore, AMS has
adopted the proposed annotati on for
potassi um hydroxi de as fi nal rul e
wi thout change.
The same commenter i ndi cated that
they di d not support the proposed rul e
because they bel i eve there i s a confl i ct

(TAP) that i nformed the Board s

AMS does not agree that thi s i s a

However, the NOSB i s not requi red to
