THE MUNICIPAL GOVERNMENT OF TANUDAN with office address at sitio Banagao, Poblacion, Tanudan, Kalinga, herein referred to as the FIRST PARTY, and MARIA LINDA G. GAVINO, likewise of legal age, Filipino, married with address at Dagupan, Tabuk City, Kalinga herein referred to as the SECOND PARTY, WITNESSETH WHERAS, the Sangguniang Bayan passed Resolution No. 53 s. 2007 authorizing the Municipal Mayor to contract the services of at least Physician with meritorious justification; WHEREAS, the Local Government Code of 1991 mandates the position of a Municipal Health Officer as mandatory to attain to the health welfare of the constituents in the municipality; WHEREAS, the first party believes that the implementation of the health programs, projects and activities of the municipal government needs the involvement of a professional Physician to address vital concerns of the municipal citizenry; WHEREAS, the first party desires to hire the services of DR. MARIA LINDA G. GAVINO who was the Municipal Health Officer dropped from the roll of the former Municipal Mayor to serve the Tanudan people while waiting for the decision of the Civil Service Commission on her case; WHEREAS, second party was found to be qualified to the position of Municipal Health Officer having been the Municipal Health Officer since 1992; Section 1. Scope of Service: The Second Party shall perform the duties and functions of the Municipal Health Officer pursuant to the provisions of the Local Government Code, and other relative functions such as: a) Attending to the health welfare of the Tanudan People; b) To consolidate reports of the Mid-wives relative to health problems in their respective barangays; c) To manage the Rural Health Unit; and d) To perform such other activities and functions as directed by the Chief Executive. The Municipal Government reserves the right to modify any of the terms or provisions of this contract or to terminate the contract anytime upon notification of the concerned parties. Remuneration: The First Party shall pay the compensation of the contracted Physician equivalent to the basic salary of the Municipal Health Officer and other benefits enjoyed by the regular employees of the local government unit concerned, like ACA/PERA, SA/LA, RATA, PhilHealth Premium, GSIS and Pag-Ibig Premium, 13th month pay, Cash Gift, Clothing allowance and others. Section 3. Effectivity: This contract takes effect on July 2, 2007 the actual assumption to duty and shall remain in force unless otherwise terminated due to meritorious reasons and review of performance if very satisfactory.
