Subject: Friday's Meeting with frm Sec Lehman

Gentlemen:

As you are aware, my team was invited to meet with Sec Lehman at his office
over lunch to discuss commission work, in particular the work of the
intelligence team. I breifed him on the progress we've made on the
workplan, the beginnings of a chronology we're working on, and our
approach to a side-by-side analysis of the pending intelligence
recommendations over the past several years. Attending this luncheon with
Sec. Lehman were Bruce Berkowitz, Lynn Wright, Lorry Fenner, Kevin Schaffer,
and myself.

Sec Lehman raised the following topics/issues in a wide-ranging discussion


over the course of two hours:

Domestic intelligence collection - he believes that the issue of an


American MIS and the proposed TTIC require our the Commission's attention.
We spoke generally about the history of these recommendations and how to
approach them.

— Intelligence Management - he spoke about his experience during his tenure


with Kissinger at ths WH where there was a group called the "40 Committee"
which oversaw intelligence. It included the DCI, SecDef, SecState and
others. We talked a bit about the 1C staff and how it has evolved since his
time into the Community Management Staff. He said the whole issue of
"national intelligence vs. tactical intellgience" is very important in
assessing whether we had enough collection capability prior to 9-11 and how
it was being managed. He suggested that we try to isolate, in the course of
our work, what management issues are structural in nature and which are
related to personality. For example, the recommendation to establish a DNI,
is this the result of a bad structure or could different managers make the
existing system
work better.

— Civil Liberties - in connection with intelligence collection


domestically. He was interested in how the staff comes to terms with this.
How do we put it in perspective in relation to, for example, the information
a credit organization can obtain on an individual vs. what information the
government can obtain. He believes we need a separate hearing on this
issue. He thinks that Ben-Veniste and Gorelick could add a great deal in
this regard early in the process.

— Warning and Response - a general discussion on the fact that in the

military we have a specific response to warning of attack, but that no well


exercised system exists in the civil side of government.

— State and Local - he is anxious to arrive at the key five recommendations


to help support the state and local governments. We need to quickly learn
what has already been recommended and add weight to the good ideas.

— Open Sources — he referred to the shutting down of State Department


consulate offices as an instance where we cut off a source of open
information on foreign countries/activities due to budget cuts at State. He
dates this back to the Nixon administration. He thinks that open sources
should be reviewed in the context of intelligence sources.

— Competitive Analysis - does this exist today? Where are the red teams?
How does the Community avoid "group think" if it is organized into Centers
with only one chain of command? Do "Centers" help or hurt competitive
analysis?

He also suggested a general way ahead for the staff:

-- identify key issues quickly.

— identify the pending recommendations in each of these areas (I spoke to


him about a "side-by-side" we are doing on the team to help identify and
comment on all the pending recommendations in the intelligence realm).

-- debate and challenge the pending recommendations on the Commission and


take a position on each of them.

-- identify what can be done quicly through Executive Order and what must be
done through legislation and develop a legislative strategy to implement the
recommendations.

Lehman indicated finally that he wanted to be involved and that he was


keeping his Friday afternoons open after each Thursday commission meeting to
get updates form the staff. I indicted that we would keep him informed of
our progress and appreciated his interest and support.
