Therearetwomatterspresentedhereforreconsiderationtogether,asbothaffectthenewgTLD applicationfromNameshopinsuchawaythattheentireapplicationisblockedfrommaking timelyprogress.OnepertainstoStaffANDBoardInactionontheApplicant'sappealagainstthe unexplaineddecisionontheNameshopChangeRequestanotherpertainstotheStaff Action/InactionleadingtotheSARPpaneldecisiononApplicantSupport,alsounexplainedand nonspecificontherationalefortheruling,butbotharecaseswherebothStaffAction/Inaction couldbeonlyapartialcause,withBoardInactionbroadlyresultingintheadversitysuffered. TheapplicanthasanindepthunderstandingofandrespectfortheICANNprocess,hasfaithin

theneutralityoftheChairandthemembersoftheBoardasmuchastheApplicantunderstands thatICANNhasacompetentCEOandStaff.Whilesubmittingthis,theapplicantdoesnotwish thisrequestforreconsiderationperceivedasacomplaintagainstthenewgTLDprogramorthe overallICANNprocess.ICANNiscontinuouslystrivingforhighstandardswithinitsframeworkof aexemplarymodelofacontinuouslyevolvingMultiStakeholderGovernance.Thesituationofthis requestforreconsiderationarisesoutoffaithintheoverallprocessandnotoutofdiscontent. Anycommentsontheprocessfollowedornotfollowedandanycriticisminthisdocumentis expressedwiththebeliefthattheseexpressionswouldcontributetofurtherelevateICANN's governancestandardstoevengreaterheights. IntheseinstancesaffectingtheNameshopapplication(aspossiblyinanotherSARPdecision andpossiblyinsomeothernewgTLDdecisions/indecisionswhicharebeyondthescopeofthe Nameshoprequestforreconsideration)thereisanintricateinterplayofStaffandBoardAction/ Inactioncontributingtowrongdecisions/delays.Suchaninterplayoccursduetoacertain excessivecautiononthepartofboththeCEO/SeniorStaffandtheChairandMembersofthe BoardwhichcausesthemtobedetachedfromthenewgTLDprocesstothepointofbeingso disconnectedthatthenewgTLDprocessisneitherrunbytheBoardnorbyStaff,norfully reflectingthegeneralwillofthemultistakeholdercommunityofICANN.TheChairandsome membersoftheICANNBoardhavedeclaredsomeformofconflictofinterest,whichinmost casesispossiblyindirectand/ornarrow.Whileitindicateshighstandardsonthepartofthose withadeclaredconflictofinteresttorecusethemselves,thisalsoamountstoa'generic' withdrawalfromtheentireprocess,grosslydisproportionatetothenarrow(smallorinsignificant) conflictofinterestthatmightactuallybe. Whilethereismeritinstayingawayfromdeliberationsanddecisionswithperceivedlegal implications,thisalsoleadstoasituationofinsufficientlydeliberated/unattendeddecisions, whichcausesgreaterharmtotheprocessasinthisinstanceofconsiderablysignificant substantialmaterialharmtothisapplicantwithapurposefulandmeaningfulbusinessconcept,a TLD'position'(atermfromtheMarketingterminology)ofappealtoallInternationalDomainName registrants,withamemorable,appealingstringwiththegoodfortuneofbeinguncontended .Internetwhichispurposefulbesidesbeingcommerciallyvaluable. ThespiritofthisrequestasareconsiderationrequestoninactionofStaffattheCEOleveland oninactionoftheChairandMembersoftheBoardarisesfromthebeliefthattheCEOandthe Boardareaccountableforanyshortfallatanylevelintheprocess,whetherornottheomission iscausedbymembersinternaltotheorganizationorexternal,ofthepresenttimeorinthe distantpast.TheapplicantbelievesthatatthehighestlevelofICANN,suchdegreesof accountabilityisbroadlyassumed. AbsenceofattentionbytheChairandMembersoftheBoardandCEOtothefactsmade availabletothemisthereforecitedastheprimarycauseforthissituationthataffectsthe applicant.Neitherthefactsavailablewerefullyconsidered,norwasthereanyindicationofany efforttoaskformoreinformation/clarifyinginformationwherenecessary.

Withthisreasoning,thisrequestforreconsiderationisfiledagainstStaffaction/inactionand Boardinactionontwodecisionsthattogetheraffectnameshop.

3.Descriptionofspecificactionyouareseekingtohavereconsidered. 3.1. RequesttoreconsidertheChangerequestdecision:

TheoriginoftheChangerequestwasthecommunicationinitiatedbytheapplicantonJuly11, 2013requestingthenewgTLDstafftoallowachangeofstringasasolutiontoaproblem concerning.IDN,theappliedforstring,whichlargelyoccurreddue(a)acertainambiguityinthe applicantguidebook(b)completeabsenceofelectronicsafeguardswithintheformtorefuse prohibited/reservedstringsduringtheprocessoffillinguptheeformorbywhatmightbecalled 'windowoversightsystems'(manual)nottoacceptanapplicationifthestringis'prohibited'or 'reserved'or'willnotbeapproved'asinthecaseof.IDN. Theapplicantsubmittedtheapplicationfortheoriginalstring.IDNwhichwasaccepted,the applicationwasnot'returnedacrossthecounter'intimefortheapplicanttobecomeawareof theinadvertentomissionasalsotomakethenecessarycorrection,whichtheapplicantwould havemadepossiblyswiftlyalmostacrossthecounterwithouttimedelays,inwhichcasethe presentissuewouldhavebeenrenderednonexistentthenandthere. SoonaftersubmissionnewgTLDactuallynoticedthestringappliedfor,askedtheapplicantto reconfirmthestringappliedfor(reconfirmtheanswertoquestion13a)byacommunication throughtheCRMportal,intheprocessoftakingtheapplicationonrecord.Theapplicant respondedbyrepeatingthattheappliedforstringis.IDNasanasciistringandthisreplywas alsoreceivedwithoutfurtherobservations.Despitethisspecificattentiontotheappliedforstring duringtheprocessofsubmission,itwasnotpointedoutthattheappliedforstring'willnotbe approved'andtheapplicationwasretainedwithoutcommentsorfurtherpointers. TherewerenoproblemsreportedonthestringappliedforthroughtheCRMoranyothermeans andnotevenwhiletheapplicantwaspresentforaweekattheICANNmeetingthatfollowed (Prague).TheapplicantinformallyheardfromfellowmembersoftheCommunityabouta possibleproblemandchosetowriteproactivelytodrawtheattentionofnewgTLDonthis problemwithaviewtoproposeasolution. AgainstthisbackgroundtheChangerequestwassubmittedonSeptember30,2012. NewgTLDsentaletterexplainingdifficultiesinallowing.IDNbutacknowledgedtheChange RequestonNovember1asarequesttobeprocessed. ThedecisionontheChangeRequestwascommunicatedafteraboutfivemonthsfromthedate

ofrequest. ImmediatelythereafterNameshopfileditsappealtotheChair,CEOandCOObyemailon February27,2013,whichwasforwardedtotheChairandsomeBoardMembersofthenew gTLDprogramasalsototheChairoftheAtLargeAdvisoryCommittee. Thechangerequestisinorder,andtherequestednewstring.Internetmeaningfullyfitsthe overallmissionofthisapplication,itisnotageographicalstring,itisnotareservedorprohibitted string,itisnotacontendedstring,sofullyqualifiestobeapprovedasthenewstring,thesame wayafewotherchangerequestsmighthavebeenapproved. Thedecisioncommunicatedonthenameshopstringchangerequestisarbitrary,discriminatory andsurprisinglyprejudicialtoICANN'shighstandardsofGovernanceandNameshoprequests thisunexplaineddecisionreconsideredwithouttimedelays,andtoallowtheapplicationto progressintunewiththepriorityof150awarded. TheapplicantinformallyheardfromfellowmembersoftheCommunityaboutapossibleproblem andchosetowriteproactivelytodrawtheattentionofnewgTLDonthisproblemwithaviewto proposeasolution. Inhisletterbyemail,theapplicantassuredthatNameshopastheapplicantfor.IDNhasno intentionofpositioningthisTLDinanymannerasacountrylevelTLDtocauseanyconfusion whatsoever. ICANNwasalsorequestedtotakeintoaccountthefactthatthestring+idea+businessmodel makestheapplication.Viewedtogether,.IDNisglobal,withalargerpurposeandtheideaas

conceivedtobeimplementedbyafairbusinessmodelwouldindeedaddenormousvalueto ICANN'snewgTLDprogramintheareaofIDNimplementation. AgainstthisbackgroundtheChangerequestwassubmittedonSeptember30,2012. NewgTLDexplainedsentaletterexplainingdifficultiesinallowing.IDNbutacknowledgedthe ChangeRequestonNovember1asarequesttobeprocessed. TheaboveandfollowingfactspresentedintheChangerequestandbyemailcommunication wereknowntoStaffandtheBoardMembersofthenewgTLDprogram: TheproposedgTLDwouldconnectusersfromdifferentcommunitiestoconnectglobally.This gTLDwouldbeofhelpinfurtheringtheInternetCommunity'seffortstopreservetheInternetasa unified,Globalspace. TheproposedTLDhasalargerpurposeandtheideaasconceivedtobeimplementedbyafair businessmodelwouldindeedaddenormousvaluetoICANN'snewgTLDprogramintheareaof IDNimplementation. TheearlierrequesttothenewgTLDteamwithacopytotheActingCEOonJuly18,wasa requesttoICANN:1)Toconsider.IDNfordelegation,iftheabovedetailswouldsatisfythe ccNSOandtheGAC.2).Iftherearedifficulties,toallowtheapplicanttochangethestringto anotherstringofthreeormoreASCIIcharactersthatisnotreserved,notacountryorterritory name,uncontentiousbutrepresentsthepurposeofthisTLD. TheapplicanthasalsonoticedobjectionsinthecommentprocesstoICANNallowingtheapplied forstringonthegroundsthatitisanalpha3countrycodeforIndonesia.Indeferenceofthese objections,despitethebeliefthattherequest(1)statedaboveisinorderonthegroundsstated earlier,theapplicant[conveyedhis]wishestooptforrequest(2)statedabove,thatofchanging thestringappliedfortoanotherstringofthreeormoreASCIIcharactersthatisnotreserved, notacountryorterritoryname,uncontentiousbutrepresentsthepurposeofthisTLD Nameshop[conveyedtheintention]tochangetheanswertoquestion13aasINTERNET whichsuitsthemissionofconnectingInternationalizedDomainNameuserstotheGlobal Internetspace. Theproposedchangedoesnotaffectcountriesorgeographicregions.Thechangedstring confirmstothepurposeoftheapplicationbynameshop,thatofenablingIDNregistrantsto connecttotheglobalInternetusersfromallotherlanguagecommunities. Theapplicanthad,intheChangeRequestonSeptember30,2012,includedPublicInterest CommitmentslaterformalizedthroughthePublicInterestCommitmentprocess.

Amongothercommitments,Nameshopcommittedto 1.approachandinvitethreeormoreInternetLeadersofknowncommitmenttoInternettobe activeandparticipativemembersoftheManagementBoardtosetdirectionsforthe managementoftheproposedTLD.Thisistoensurethatthisstringismanagedresponsibly,as benevolentlyaspossible.Theywouldseated[freeoflegalliabilities]togetherwithother ManagementBoardmemberswithafocusedBusinessperspective. 2.Nameshopwouldvoluntarilysetaside,yearafteryear,onequarterofthePostTaxprofits(or pretaxprofitsiftheTaxLawsallowafulltaxexemptionofcontributiontosuchacause)arising fromregistrationofevery.INTERNETdomainnametobeutilizedforthegoodoftheInternet, wherepossiblewiththeflexibilitytoallocateandutilizefundsforinadequatelyfunded humanitariancauseswithoutanygeographicdiscriminationifsufficientfundsforInternet causesareotherwiseavailable. TheappealaddressedtoFadiChehade,CEOofICANNandtoDrSteveCrockerbyemailon February27includedthesefactsandthefollowing: Nameshop(http://nameshop.inNOTnameshop.comwhichismisleading),withthe'company' structureofaProprietaryfirminIndia,hasappliedforthestring.IDN. ThoughnotfiledasaCommunityTLD,itisaTLDwithalargerCommunitypurpose,astheidea andpurposeoftheproposedTLDistoofferabridgefortheInternationalizedDomainName RegistrantstoopenuptheirWebspacesforusersbeyondtheirownlanguagecommunities. Thestringwasappliedforwiththeideaofabusinessplantoofferthisdomainextensiontothe registrantsofvariousIDNdomainnamesasanadditionalASCIIdomainnamethatwouldpointto theirIDNspace,whichisotherwiseaspacewithadomainnameinalocalscript,notintelligible, henceoutofreachforthoseoutsidetheirlanguagespace. Theoriginalstringappliedfor,.IDNwassoappliedfor,withthelargerpurposeofbuildingglobal TrustoverIDNdomainsandmakingwebspaceswithInternationalizedDomainNames accessibleacrosstheirlocalscriptstherebycontributingtotheInternetCommunity'seffortsto keeptheInternetasOneInternetasaglobalspace. TheChangeRequestwasfiledtochangetheanswertoquestion13(a)asINTERNETwhich suitsthemissionofconnectingInternationalizedDomainNameuserstotheGlobalInternet spaceandofcontributiontothecommunity'seffortstokeeptheInternetasOneInternet.

TherequestedchangeisfairtothegeneralcommunitybecauseNameshopseekstoreplacea stringthatwouldotherwiseaffectacountry'sprivilegeswithagenericstringthatrepresentsthe purposeoftheTLDapplication.Therequestedchangeisfairasitenablestheimplementationof

anASCIITLDthatwouldbridgeIDNcommunitieswithothercommunitiesandcontributetothe community'seffortstopreservetheInternetasOneInternet. Onthecontrary,disallowingthechangewouldindeedbeconstruedasunfair,asitamountstoa breachofprocessofthechangerequestprocessasalsoamountstosubjectivejudgementby theevaluationteam,prejudicialtotheoverallICANNprocess. 6.MaterialityWouldthechangeaffecttheevaluationscoreorrequirereevaluationofsomeor alloftheapplication?Wouldthechangeaffectstringcontentionorcommunitypriority consideration? Therequestedchangedoesnotmateriallyaffecttheevaluationscoreorrequireareevaluationof anyotherapplication.Thechangedstringisuncontestedanddoesnotinanywayaffect communitypriorityconsideration. 7.TimingDoesthetiminginterferewiththeevaluationprocessinsomeway? ThisrequestforchangewasfiledduringSeptember2012,anditisstillnotlatetoallowthis changeandproceedinaccordancewiththeprioritydrawnforthisapplicationpriorityno150. TheChangeRequestisconformitywiththecriteriaspecifiedasshownabove.NewgTLDhas rejectedtheRequestwithoutdueconsiderationof: a)themeritsoftheoverallpurposeofthisapplication b)thegapsintheApplicantGuidebookthataretobeattributedtotheerrorofchoiceofanaplha 3string c)themeritsoftheChangeRequestasafairsolution,and d)theconformityoftheChangeRequesttothecriteriaspecifiedforchange. [ThesearethereasonswhyNameshop]appealedagainstthisdecision,forwhichreasonsare notassigned. Nameshoppointedoutthatthisisanapplicationunderanapplicantsupportrequest,an applicationfromaDevelopingcountryandanapplicationofvaluetotheIDNprogram. TheChairandCEOwererequestedtoreconsiderthisdecisionandallowthisapplicationto proceedinaccordancewiththepriorityofthisapplication(No150),alsoconsideringthefactthat thisstringwouldserveitspurposebetterifdelegatedtogetherwiththeearlyIDNstrings. Nameshopalsoreaffirmedit'scommitmentstoimplementthisstringresponsibly,with communityadvicewherepossible,asalsocommittoutilizeasignificantportionofprofitson largercausesasspecifiedinthechangerequest,towhicheffectNameshopwouldbeexecuting PublicInterestCommitmentsseparately[andsoexecutedandpublished]

9.2.

RequesttoreconsidertheSARPpaneldecision:

ItisnotexplainedastowhytheSARPpanelmadethisdecision.Thecommunicationstatedthat thepanelweighedtherequestagainstthestipulatedcriteriaandappearedtoconveythatSARP determinedthattheapplicantdidnotmeettheminimumcriteriawhichwaslistedunder1)Public InterestBenefit,2)FinancialNeedand3)FinancialCapabilitiesthatisseeminglycontradictory withthatofCriteria2. ICANNdidnotdesignasuitableapplicationforFinancialSupport,whichwouldprobablyhave providedtherequiredinformationabouttheneedandcapabilitiesoftheapplicantintheright perspective,butintheabsenceofasuitablydesignedapplication,SARPappearstohave decidedbasedonaninadequateunderstandingormisunderstandingoftheapplicant'sneedfor financialsupportatthisspecificpointoftime. ICANNdidnotrequiretheapplicanttomakeastrongandforcefulargumentforfinancialsupport, nordiditcallforelaboratedocumentationto'provethemeritsandneedsoftheapplicant. PossiblyinviewofthepublicexposuretotheapplicantinICANN'smultistakeholderprocess, ICANN,perhaps,chosetobegentleontheapplicantsinitsrequirementforinformationto supporttherequest. Withthisunderstandingitwasexpectedthatthemeritsandtheneedoftheapplicantwouldbe thoroughlyunderstood,notonlybasedonthefinancialsupportsection,butbasedontheentire application,byadditionalopinions,researchonmoreinformationontheapplicantasmaybe accessibleandnecessarilybyadditionalquestionstotheapplicantwheretheinformation availabledoesnotprovidesufficientunderstanding.Allthisappearsnottohavehappened. Theinformationcontainedintheprivateandpubliccomponentsoftheapplicationforfinancial assistanceasattachedwassufficienttodemonstratetheneed,qualificationandthemeritsof theapplication.(Thepaneldidnotcallformoreinformation,didnotcallforanyexplanationon anyinformationthatitwasnotunderstoodanddidnotraiseanyclarifyingquestions.Ifcalledfor, theapplicantwouldbeinapositiontopinpointclarificationsonperceivedproblemareas) Thefollowinginformationcouldbegatheredfromvarioussectionsofthenameshopapplication: 1.PublicInterestBenefit: A)criteria:Communitybasedproject. ThoughnotdesignatedasaCommunitybasedTLD,theproposedTLDresultsinsignificant benefitstothebroadercommunityofInternationalizedDomainNameregistrantsofeveryscript, andtoallGlobaluserswhowouldliketoaccessIDNspacesandtotheIDNcommunities,as listedintheanswertoQuestion18bandmoreclearlynarratedinthestringchangeapplication

andinrelatedemailcommunication. Criterion:PublicInterestBenefit: TheproposedideaofofferinganASCIIlayerbywayofacorrespondingASCIIdomainnameto makeanInternationalizedDomainNamereadablebyusersfromotherlanguagecommunities, withtheideaofbridginglanguagecommunitieswhichareotherwiseconfinedwithintheirweb spaces,waswiththelargerpurposeofcontributingtotheInternetCommunity'seffortto preservetheInternetasOneInternetwhilealsocontributingtosmoothenIDNadoption.Thisisa visiblysignificantPublicInterestbenefitaroundwhichtheveryconceptoftheproposedTLD revolves. Also,MonthsaheadofICANN'scallforPublicInterestCommitmentsandtheformalizationofthe PublicInterestCommitments,NameshopmadepublicInterestCommitmentsonSep30, voluntarilyofferedtomakethesecommitmentslegallybindingandformallyresubmittedthePICs withgreaterclarity. criterion:Serviceinunderservedlanguage: TheTLD.internetwouldofservicetotheIDNTLDsthatservetheunderservedaswellas widelyspokenlanguages. http://duediligenceindia.blogspot.in/),evenaftertheissuewasfullysettledfiveyearsago,the sourcesoffundingforthisapplicationwerelimitedtofundsfromtheapplicant,somemore fundsfromfamily,whichweresupplementedbyaBusinessAssociateingoodfaith.[$15000 wasinitiallybroughtinbythepromoter,$23,000bywayofacomfortableloanfromafamily membersupplementedbya$14,000loanfromtheBusinessAssociatewhichhasbeenrepaid already] Theinvestmentstrategy[duetotheselimitations]isconservative.Thecapitalcostsarekeptata minimallevelwithastrategytopurposefullyavoidunnecessarypreapplicationinfrastructureor publicity.TheapplicantcompanyhasitsownofficeinfrastructureforNameshopasadomain resellerbusinesswhichisoperatedtogetherwithInternetStudio,awebhostingbusiness.This infrastructureismorethanadequateattheapplicationsstage. Theapplicanthasclearlyhinted,inthewriteupandworkingsinthefinancialsectionthat"The conservativeprojectionspresentedarenottotakenasasignofshortsightednessorlack ofunderstandingofthepotentialfortheTLDstringappliedfor"Theapplicanthas consideredsuchpostivescenariosandwithaviewtobepreparedforvolumesofsevealmillion registrations,optedtoworkwithAfiliasevenasaStartUp.TheoverallRegistryServicefunctions arefullyentrustedtoAfilias,whoasaRegistryServiceProviderhasascalableinfrstructureto

handletechnicalrequirementsforuseveninascneariowherethevolumesexceedthatofthe existingTLDswithtopregistrationsvolumes. OurcontractwithAfiliasissuchthatanychangeinthelevelofregistrationsonlyaffectsthe variablecostsperdomainpaidtoAfiliasthereisnoescalatorclausethatwouldresultinthisfee beinggreaterthantheagreeduponschedule.Thisfeestructurehasaminimumcostper financialtransactionandthisrepresentstheentirefeepaidtoAfiliasforhandlingallofthe technicaloperationsoftheRegistryincluding4ofthe5criticalregistryfunctions. Theapplicant'sbusinessplanistobuildupthisTLDspaceasaglobalTLD,withalternate businessmodelsthatrequiresomediscussionswiththeRegistryServiceProviderandpotential associates.Thesediscussionsaretobetakenuppostapplicationandtheapplicantwishesto presentthedetailsatalaterdate. TheapplicantisinapositiontoconsultwithexpertsfromtheDomainIndustryandfromthe ICANNCommunitytoensurethatthebusienssoftheisTLDisnotonlytechnicallyservicedwell withsignicantincreasesinactivityvolumes,butalsoensurethattheactivitiesarecommercially ethicalandconfirmtoInternetCommunityvaluesasthespaceexpands.Therewouldbe significantchangeinthescaleofoperationspostfunding. PreviousProjectsExecuted:Theapplicanthasabackgroundinbusiness,comesfromatrading family,hasgraduatedfromaBusinessSchoolinIndia.Theapplicantownedanmanaged WhitefieldCottonsPrivateLimited,whichasaTextilemanufacturingcompanyduring1997 2001exportedTextilestothetuneof$1.5millionpoisedforgreaterresultsbutagapinprogress occurredatthispointoftimeduetothebankingsituationdescribedearlier. Duringthelastthreeyears,theapplicantasanindividualhasgivenshapetoaventuretodesign andmanufacturemobileinternetdevicesandposedtoprogress. AllthisinformationhasbeenprovidedandeasilyaccessiblebySARP. Ittakesthepeculiarrationaleandpredeterminationofadisinclinedbankertomisinterpretthe informationprovidedonfinancialneedtoquestionfinancialcapabilitiesandtomisinterpretthe informationprovidedonfinancialcapabilitiestoquestionfinancialneed.Thisraisesquestionsas towhethertheinclinationsofICANNweretolookforreasonstooffersupportortomakeall effortstoinventreasonsnotto.

WhatareyouaskingICANNtodonow?

10.1. RequesttoreconsidertheChangerequestdecision: TheapplicantrequestsattentionoftheChair,CEOandthemembersoftheBoardtothe

RequesttoreconsidertheChangerequestdecision: Thechangerequestarosefromthecircumstancesof(a)acertainambiguityintheapplicant guidebookconcerningalpha3countrynames,and(b)acompleteabsenceofelectronic safeguardswithintheformtorefuseprohibited/reservedstringsduringtheprocessoffillingup theeformorbywhatmightbecalled'windowoversightsystems'(manual)nottoacceptan applicationifthestringis'prohibited'or'reserved'or'willnotbeapproved'asinthecaseof.IDN. Formonthsaftersubmissiontherewerenodirectivesonthestringoriginallyappliedfor,sothe applicantfiledtheChangerequestasafairsolution. Thechangerequestisinorder,andtherequestednewstring.Internetmeaningfullyfitsthe overallmissionofthisapplication,itisnotageographicalstring,itisnotareservedorprohibitted string,itisnotacontendedstring,sofullyqualifiestobeapprovedasthenewstring,thesame wayafewotherchangerequestsmighthavebeenapproved. 11.2 RequesttoreconsidertheSARPpaneldecision:
