COMES NOW, DEFENDANT NATIONAL HOUSING AUTHORITY (NHA), through the undersigned counsels most respectfully states that: 1. During the last hearing of this case on 01 February 2012, the hearing on the Motion to Dismiss filed by private dependant spouses Lucas was heard by this Court; 2. However, it appeared from the records of this case that herein NHA was not furnished a copy of the Motion to Dismiss; 3. Counsel for private defendants undertook to send a copy to NHA. The NHA received a copy of the Motion to Dismiss on 03 February 2012; 4. Hence, this Manifestation; 5. After careful scrutiny of the Motion to Dismiss filed by the private defendants, NHA is no longer filing any comment thereto. The Motion to Dismiss not being prejudicial to the rights and interests of NHA;

6. The NHA has no objection to the dismissal of this case
