Per our conversation, attached is our draft DoD Request that includes, inter alia, a request for
(1) training exercises that involved a plane as a weapon (see item #6), and (2) documents
from NORAD J2 officers related to planes as weapons (see item #9). As you can see, these
requests are fairly narrowly targeted and would not reach intelligence info within OSD,
So/LIC, J2, etc related to the issue of planes as weapons. As I mentioned, we drafted a
memo to Philip after our NEADS visit expressing our concern that there may be a gap in the
Commission's fact finding re this issue (at least with respect to DoD) and asking for his
guidance as to who among the staff should pursue these issues; we have not heard back
from him. I have had conversations with Bonnie, Mike and Lome about this issue, so I'm
copying them on this message. This draft is with the front office and we're hoping to get it out
late this week or early next week. Please keep us posted on how you proceed. Thanks -

Initial Planning Conference (IPC) for Amalgam Virgo O2, including the
exercise planning schedule. This request includes, but is not limited to, drafts
of the Concept and Objectives Statement (C&O), the Exercise Specifications
(EXSPEC), the Exercise Plan (EXPLAN), the Master Scenario Events Listing
(MSEL) and the Control Staff Instructions (COSIN), as they existed prior to
9/11/01. For each of the documents responsive to this request, please provide
information sufficient to determine the date the document was initially drafted,
and, if applicable, the date the document was finalized.

5. All after action documents related to Amalgam Virgo 02, including but not
limited to the contractor's report evaluating the exercise and the lessons
learned from the exercise.

6. All after action documents related to military exercises ~ since January of


1993 ~ in which an aircraft was hijacked and/or used as a weapon and which
involved NORAD.

2001, related to the issue of an aircraft being used as a weapon. This request
includes, but is not limited to, documents responsive to this request in the
possession of Lt. Col. Stuart at NEADS.

10. The NORAD Agreement and subsequent renewals, described in paragraph 4.1
of Nil 0-3 7 ("NORAD Planning and Requirements System (NPRS)), as drafted
and/or approved by the CINCNORAD between January 1, 1998 and
September 20, 2001.

11. The NORAD Vision, described in paragraph 4.1 of NI10-37 as drafted and/or
approved by the CINCNORAD between January 1, 1998 and September 20,
2001.

12. NORAD Requirements Review Report, described in paragraph 5.2 of NI10-37,


as drafted and/or approved by CINCNORAD between January 1, 1998 and
September 20, 2001.

13. The NORAD Integrated Priority List, described in paragraph 5.3 of Nil 0-3 7,
as drafted and/or approved by CINCNORAD between January 1, 1998 and
September 20, 2001.

14. NORAD Mission Need Statements (MNS), described in paragraph 6 of NI10-


37, regarding the subject of hijacked aircraft and drafted between January 1,
1998 and September 20, 2001.

The Commission requests that the documents requested above be provided as soon as they are
available, even though all requested documents may not be provided at the same time, through
means of a "rolling" production. The Commission further requests that the respondent provide an
index of all documents produced, indicating which documents are responsive to what requests.

If any requested documents are withheld from production, even temporarily, based on an alleged
claim of privilege or for any other reason, the Commission requests that the respondent, as soon as
possible and in no event later than the production date, identify and describe each such document or
class of documents, as well as the alleged basis for not producing it, with sufficient specificity to
allow a meaningful challenge to any such withholding.

If the respondent does not have possession, custody or control of any requested documents but has
information about where such documents may be located, the Commission requests that the
respondent provide such information as soon as possible and in no event later than the production
date.

If the respondent has any questions or concerns about the interpretation or scope of these document
requests, the Commission requests that any such questions or concerns be raised with the
Commission as soon as possible so that any such issues can be addressed and resolved prior to the
production date.
