Governor May Act Over the Summer; Gun Owners Disappointed By Senate President Stephen Sweeney

s we went to press in late June, anti-gun legislative attacks in the Garden State were at their zenith, with several anti-gun bills on or expected to reach Governor Christies desk by the end of the month. These included an amended bill banning .50 caliber firearms, Senate President Stephen Sweeneys universally despised firearms ID card bill, a bill suspending Second Amendment rights for anyone placed on a secret government list by unaccountable bureaucrats, and legislation requiring the State Police to publicly disclose confidential ATF trace data in violation of federal law, among several others. Governor Christie could act on the gun bill package over the summer. As we went to press, it was unclear what action the Governor would take on each of the bills, but ANJRPC has been providing detailed input to

ANJRPC THREATENS LEGAL ACTION ON VOTE-RIGGING BY ASSEMBLY DEMS
coalition of Garden State gun owner and sportsmens groups led by ANJRPC served legal notice on Assembly Speaker Sheila Oliver on June 24, warning that impending action on several gun bills would be invalid and subject to legal challenge as a result of illegal vote-rigging in an Assembly committee earlier in June. The warning letter, prepared by ANJRPC counsel Dan Schmutter and now available on the ANJRPC website, cited a serious violation of legislative rules by the Assembly Law & Public Safety Committee at a June 6th hearing. When the Democrats self-described
centerpiece of their gun bill package (A4182 / S2723) failed during a roll-call vote, the committee chairman aborted the roll-call after 9 of 11 votes had been cast, in violation of rules requiring that voting must be completed once it has started before any further action can be taken. Rather than completing the vote as required, the chairman simply left the roll-call unfinished and instead announced he was holding the bill. Republican committee members objected and argued with the chairman. In further violation of Assembly

he past six months have presented the ultimate challenge for those who love Liberty. First, a tragedy of epic proportions, pure evil at the hands of a monster. Next, a one-sided media firestorm, devoid of facts or fairness, blaming us for the acts of a madman. Then, a nationwide legislative juggernaut to steamroll our rights into oblivion. New York took the first hit, then Colorado and Connecticut. In New Jersey, more than 80 gun bills came at us in a steady stream from January to June, in an endless procession of legislative hearings and inquisitions where gun owners stood up and fought with every ounce of heart and strength against impossible odds. Its been a battle of epic proportions non-stop, ruthless and relentless, and the enemies of freedom never counted on ordinary folks locking arms to form Libertys shield. But thats exactly what we did, and now that we are entering the final phase of the fight, its time to look back briefly and assess the battlefield. Out of more than 80 bills introduced, as we went to press it appeared that approximately 16 were heading to the Governors desk. Of those 16, two were positive for gun owners, 9 were neutral or neutralized through amendments resulting from gun owner input, and 5 were blatant attacks on gun rights. Four pro-active, uncontroversial bills addressing longstanding gun owner concerns were promised but were stalled and have not yet been delivered. Additionally, anti-gun Democrats suffered several extremely embarrassing moments that were documented on YouTube videos that have gone viral. These include the infamous hot mic comments of three legislators discussing gun confiscation and disparaging gun owners; various committee chair blunders (dishonoring the pledge of allegiance, telling the public their testimony would be taken after voting, and heavy-handed ejection of gun owners from hearings); and blatant committee voterigging that could result in the demise of the awful Sweeney firearms ID card bill. These results have come at a price: gun owners are physically and emotionally exhausted from 6 months of intense and non-stop battle. But there is no rest for the weary yet this is the moment to which we all have been called, and we must persevere to the very end. If the flame of Freedom burns in your heart and you wouldnt have read this far if it didnt then you must find the strength to go the distance and see this fight through the final phase. Governors office throughout the legislative process this year and will continue to do so over the Summer. Gun owner attention should turn to the Governors office in July and Augustplease subscribe to ANJRPCs free email alerts for updates and specific action alerts. A tremendous amount has happened in Trenton since the last issue of News & Briefs. In April, Senate President Stephen Sweeney (D-3) met privately several times with leaders of both the gun rights and anti-gun communities to discuss anticipated legislation. While we were initially encouraged by the dialogue, and some of our input made the legislation less bad, it was clear by the end of the process that the larger agenda had been pre-determined, anti-gun organizations were driving the process, and gun owner input was relegated to micro-commenting on bad bills that were going to move and nothing more. Tellingly, ANJRPCs proactive agenda of simple, noncontroversial fixes to ongoing problems plaguing gun owners could have easily been attached to the other legislation moving through the process, but instead was stalled and delayed for months and now has an uncertain future. Among other things, ANJRPC had sought strict enforcement of the 30-day permitting requirement for FID cards and handgun purchase permits, extension of handgun purchase permits to one year, and transportation clarifications to eliminate the risk of 10year jail sentences for brief stops en route to the range. These tiny asks should have been easy and a no-brainer. The events of the last several months have proved to be a significant disappointment regarding Senate President Sweeney, who previously had an excellent record on Second Amendment issues. To his credit, he (for now) has blocked passage of magazine capacity restriction bills, but the onesided discussion process this Spring, his failure to move the proactive agenda of simple fixes together with his own agenda, and his awful FID card bill, mark a very significant directional change from someone who has previously been an ally. The FID card bill (S2723), touted by Sweeney as a national model, throws out existing FID cards and replaces them with either a privacy-invading driver license endorsement or other form of ID; suspends Second Amendment rights without proof of firearms training; imposes a 7-day waiting period for handgun purchases; ends all private sales; and

effectively creates a registry of ammunition purchases and long gun sales. The final version of the fifty caliber ban (A3659) bans firearms that shoot centerfire cartridges of any caliber that attain a muzzle energy of 12,000 ft-lbs. or greater. Though limited grandfathering has been added in response to gun owner concerns, the firearms must be registered, cannot be passed down to heirs, and owners will be civilly liable for damages if the firearm is used in a crime. Additionally, the bill has been amended specifically to prevent anyone with a pending order for these firearms from taking possession of them. The efforts of gun owners over the past 6 months have been extraordinary and have had a definite impact on the legislative process. The massive outcry of gun owners in February in response to Assembly attacks slowed down the process in the Senate. The sustained pressure in the Senate slowed and disrupted the process even further. And the delivery of the bill package to the Governor in late June means that action taken over the summer could stymie anti-gun legislation while the legislature is out of session and less likely to return before the November elections. Because of gun owner efforts, anti-gun legislation that was intended to be completed in March has been pared down, amended, and held back until late June, which could let us live to fight another day. Because of gun owner efforts, anti-gun politicians have been exposed as lawless gun-banners who are bent on confiscating firearms. From the committee chairman who stated that he will take testimony after committee voting, to the 3 legislators caught on an open microphone saying they wanted to confiscate, confiscate, confiscate guns, to the committee vote-rigging in violation of legislative rules (see page 1), who these people are and what they aim to do has been laid bare for all to see. Gun owners must continue to remain engaged throughout the summer, until the very end of the lawmaking process. Rules, the bill was then transferred to a different committee (the Assembly Budget Committee) where the outcome could be better controlled by Democrats. The Budget Committee voted to release the bill 11 days later in a partisan vote. In a joint statement by ANJRPC, NJSFCS, and NJ2AS, the groups said Vote-rigging doesnt get any more blatant than this. These legislators ignored their own rules when they couldnt get their way in one committee, obstructing the bills defeat and relocating it to another committee for a do-over vote where the fix was in. This outrageous abuse of power will result in the ultimate demise of this legislation. New Jersey Assembly Rule 12:3 provides that once a roll-call vote begins, no further action can be taken until the results are announced. Rule 10:6 requires that committees follow this mandate. Rule 10:22 states that any bills passed by a committee in violation of the rules are forbidden from being considered for third reading or final action, which would invalidate any final action taken on the legislation by the Assembly. It also would invalidate Assembly action on 10 other gun bills released by the Law and Public Safety Committee on June 6th. The legislation at issue is Senate President Stephen Sweeneys 42-page omnibus FID bill that restricts only lawabiding citizens and has no impact on criminals (see detailed bill description in the lead story on page 1). Although Democrats have described the bill as a national model, legislators from both parties have questioned the purpose of the bill and expressed serious concerns about it. Gun owners have universally condemned the legislation. n
Range SafetyIts Not Just About Firearms
embers of Cherry Ridge Range will soon be seeing new signage about range safety procedures having to do with hearing protection and that address eating, drinking and smoking on the firing lines. Range safety is certainly about safe firearms handling procedures; however, its also about proper health and hygiene practices during and after shooting. Most of us know that exposure to loud noise can damage hearing, which is why most ranges require hearing protection. As a competitive shooter, I make it a practice to double plug since I am exposed to the noise of gunfire on a regular basis and I want to be sure I am doing all I can to protect my hearing. We strongly recommend that our members and guests adopt this practice since it further protects the hearing. Double plugging means that the shooter uses earplugs that are inserted into the ear canal as well as using over-the-ear, headphone-type hearing protection. When not actually shooting, the shooter is free to remove the earmuff hearing protection, but leaves the ear plugs in place. This helps to insure that the shooter is never entirely without hearing protection in the event that for some reason there is a discharge of a firearm when the shooter was not expecting it. Make sure to inspect the foam insides of whatever type of earmuffs you are using since foam can become dry and brittle, thereby losing its protective sound insulation. New earmuffs can be purchased at the Cherry Ridge Range Store at discounted pricing along with disposable and reusable ear plugs. In addition to being proactive about hearing protection, shooters should also refrain from smoking, eating or drinking at the range while shooting and should take care to wash hands carefully after shooting. Personal items and items not in use during shooting should be kept behind the safety line so as not to accumulate dust. Eye protection is also very important and most ranges also require that shooters wear eye protection while shooting or being on the range near where shooting is taking place. Shooting glasses or goggles protect the eyes from dust and fragments that may be in the air so be sure to wear them! There are shooting glasses available at the range store in many styles including ladies styles and sunglasses. Most items in the range store are discounted from normal retail prices so stock up on earmuffs, protective glasses and shooting hand wipes to insure a safe and healthy day at the range! n Kathy Chatterton is ANJRPC President and holds the CMP Distinguished Pistol and NRA Distinguished Revolver awards. he Cherry Ridge Range is open 360 days a year. The only five days that the range is closed are Christmas Day, one work weekend in April and one work weekend in September. Work weekends are for range maintenance and this past Aprils work weekend was also to honor our longtime Chief Range Trustee, John Healey. For Johns many years of service and his love of the shotgun range, the shotgun range was named the John J. Healey Shotgun Range. In a surprise presentation on April 27, ANJRPC President Kathy Chatterton dedicated the range to John, pictured below with his wife Terry. Maintenance and upgrades are continuing at the Cherry Ridge range. One long overdue is the updated sign, also below, directing members and guests to the various ranges. There is more to come... n

NJRPC members and member clubs have stepped up in a big way to financially support our efforts defending freedom in the State House, the media, and the courts. New Jersey State Indoor Conventional Pistol Championship

he NJ Indoor State Pistol Championship was again hosted this year by clubs in Old Bridge and Riverdale, March 15-17, with 80 competitors, including 55 NJ residents and 9 NJ juniors, participating. The overall match winner was Dave Lange of Glen Rock, again claiming his title as New Jersey Indoor Champion with a score of 2659-134X (of a possible 2700). Annemarie Pepitone of Waretown was Indoor Woman Champion with 2363-39X. Kevin Ball of Englishtown was High Resident Senior with 255171X. John Gemmill of Cliffwood Beach earned honors as High Grand Senior with 2546-75X. The title of Indoor Junior Champion was well earned by 20-year-old Joseph Storch of Piscataway. He also claimed High Marksman honors with 2399-48X, the highest Indoor Junior aggregate in six years, which included personal bests 847-21X in the .22 caliber match and 787-12X with .45! Ralph Barbary of Woodland Park was top NJ Resident Master with 254368X. First place Expert was Edilino Situico of Hamilton with his personal best 2566-84X. High Sharpshooter was Keith Stern of Kendall Park with 2433-37X. Paul Bredus of Matawan fired a Centerfire personal best (80717X) and broke 2400 for the first time. Eric Verhasselt of Rochelle Park fired his personal best grand aggregate 2389-40X, earning his promotion to Sharpshooter! n

he combined .22 caliber NMC scores of the top 10 New Jersey competitors at our 2012 Outdoor State Pistol Championship held last September were submitted for national ranking in the NRA State Team Postal Matchthis year NJ came in 2nd place, missing 1st by only 4 points! Local Boy Scouts Councils Can Apply for $100,000 in Grants from NSSF
popular Scouting activities, and NSSF hopes even more Scouts will gain knowledge of the shooting sports by taking advantage of these grants. BSA Councils applying for a grant must specifically earmark funds for shooting sports programs and provide matching funds at least equal to the grant request. NSSF will provide funding to the first 50 qualifying applicants up to a maximum of $2,000 in matching support. Councils must use awarded funds toward the purchase of equipment and supplies for their shooting sports activities from an NSSF member retailer, a list of which is available at www.nssf.org/ retailers/find. Examples of qualifying purchases are ammunition, eye and ear protection, firearms, targets and shooting vests. The challenge grants from NSSF, the trade association for the firearms, ammunition, hunting and shooting sports industry, are available to qualifying BSA Councils. Target shooting programs are among Scoutings most popular, teaching Scouts marksmanship skills, firearm and range safety, teamwork and fundraising. Our challenge grant program extends our longstanding partnership with the Boy Scouts of America and presents councils with a great opportunity to teach Scouts about the shooting sports and safe, responsible firearms ownership, said Melissa Schilling, NSSFs director of recruitment and retention. Our founding fathers recognized that our rights and freedoms were granted by our creator when they wrote our Constitution and Bill of Rights. Our rights and freedoms are under constant attack and we must stand and fight for our freedom every day. Whenever legislation is proposed contact your representative and express your views. Write letters to the editor of your paper, talk to your friends and neighbors, speak at your local club, and promote freedom in all you do and all you say. Our forefathers fought for freedom in Trenton in 1776 and we must fight for our rights and freedom in Trenton today. We also must fight for our rights and freedom in Washington, D.C. In November we must vote freedom first, and we must remember how our representatives voted on any firearms bill in the past. Do not vote for anyone that wishes to reduce our rights of freedoms. On a federal level, the U.S. Senate must vote to ratify a UN treaty by a two-thirds majority and the Senate also approves Supreme Court appointments and federal judges. We must vote for our freedom in all elections. Two reports on homicides were released in May 2013; one by the governments Bureau of Justice Statistics which found that gun-related homicides dropped 39 percent between 1993 and 2011. Another report by the Pew Research Center found a similar decline by looking at the rate of gun homicides, which compares the number of killings to the size of the countys population. It found that the number of gun homicides per 100,000 people fell from 7 in 1993 to 3.6 in 2010, a drop of 49 percent. There is no need for additional restrictive firearm legislation and we must stand and fight for our rights and freedom. Stand and fight. Vote freedom first. God bless America. n

organization responsible for implementing all of the NRA programs and activities in the state. We are charged to support and defend the peoples RIGHT to keep and bear arms, also to promote, protect and support the interest of shooters, gun owners, collectors, competitive shooters, hunters and sportsmen at the state and local levels. We are the largest New Jersey pro-gun-rights organization with individual members and Member Clubs. It is our mission to use all of our resources for the benefit of our members and Member Clubs by encouraging the formation of rifle and pistol clubs, assisting these clubs, and giving aid and assistance to individual members. We also promote the annual sponsorship of local and state championship competitions. Here are the things we do to accomplish our mission: We employ a professional lobbying firm in New Jersey to monitor gun-related legislation in Trenton, promote our interests and work against the introduction of anti-gun bills. We support state championships in rifle, pistol and other courses of fire. We sponsor both adult and junior teams for the National Championships at Camp Perry, Ohio, and junior teams to the Walsh Invitational, the largest indoor rifle tournament in the nation. We provide members with access to legal advice concerning firearms and support individuals and Members Clubs in acting against unfavorable local legislation. We conduct NRA firearm safety training programs and support Member Clubs in the development of similar training programs. We own and operate the Cherry Ridge Range in Highland Lakes, NJ. (See back page for directions.) We conduct shooting events to introduce the public to our sport. We award college scholarships to juniors who have demonstrated an understanding of and support for the Second Amendment. We publish a bi-monthly magazine and maintain a website with links and a directory of affiliated state clubs/organizations at: www.anjrpc.org n

It is approximately four miles north of Route 23 off Canistear Road (GPS coordinates for the intersection of Route 23 and Canister Road are: Long - 74 / 29 / 32 West; Lat - 41 /4 / 52 North). C anistear Road is approximately 21 miles northwest on Route 23 from U.S. Highway 46 and Interstate 80 (and 12.5 miles from Interstate 287).
