Ideally the standing orders of company should mention the retirement age for employee. The appointment letter mentions the terms and conditions of employment. For furt furthur hur clarification you can mention the standing orders in appointment letter itself. You must be having standing orders in your company. 1) Government departments have rules to retire their employees on attaining the age of 60 years. 2) In respect of private sector retirement age shall be as per standing order of the company. 3) Judges of Supreme Court retire on attaining the age of 65 years 4) AICTE has lawfully allowed the professors of engineering colleges to work till the age of 65 years. 5) There is no restriction if you devise a rule to retire your employee at the age of 40 years or at the age of 75 years as long as it is applied equally to all the employees. If it is used unfairly then aggrieved employees will take to legal recourse.
