The facts supporting this belief are as follows: S.H. and the defendant have three children in common, however they were not residing together and the defendant did not have permission to be at her home. S.H. applied for an Order of Protection against the defendant on the day of this incident. Around 11:30 pm the defendant threw a brick through the window of S.H.s apartment and charged through the glass armed with a pistol. Once inside the apartment, the defendant shot J.G. in the head and back. J.G. died as a result of the gunshot wounds. The defendant (SCC 31010)

shot D.D. in the face. D.D. is currently hospitalized in critical and unstable condition. The defendant located S.H., who was hiding in a closet with her three children, ages 3, 5 and 7 years old. The defendant pressed a pistol to S.H.s forehead as she clung to her children. S.H. has a circular injury to her forehead and other cuts and lacerations. J.G. and D.D. were childhood friends of S.H.
