‘Six delegates were
ineligible to vote
in MTUC election’
KUALA LUMPUR: At least
six delegates were ineligible
and had unlawfully partici-
pated in the election for the
post of Malaysian Trade
Union Congress secretary-
general two years ago, the
High Court was told yester-
day.
Counsel R. Sivarasa,
representing the Peninsular
Malaysia Club Employees
Union and its secretary-
general Abdullah Sani Abdul
Hamid who had filed a suit
against MTUC secretary-
general G. Rajasekaran, said
the six delegates from four
unions in the MTUC were
unqualified under Rule 6 (6)
of the congress’ constitution,
and were therefore not enti-
tled to vote in the election.
“It is the plaintiffs’ con-
tention that the election of
MTUC principal officers for
the term 2008-2010, on Dec
18, 2007, especially the post
of secretary-general, was
in breach of Rule 6 (6),” he
said.
Abdullah Sani is seeking a
declaration that the result of
the election for the secretary-
general’s post for the term
2008-2010 as announced at
the MTUC’s Triennial Del-
egates Conference (TDC) on
Dec 18, 2007 was unlawful
and void.
He also seeks an order
directing the MTUC to hold a
special delegates conference
for a fresh election for the

packages, says PAS
KUALA LUMPUR: PAS has
called on the federal govern-
ment to table a paper in the
upcoming parliament session
to ensure the effectiveness of
the Malaysian economic stimu-
lus packages.
PAS information chief Datuk
Mahfuz Omar said recent
statements by Bank Negara
and Finance Minister Datuk
Seri Najib Abdul Razak on the
country’s economic growth
were not positive and have
been worrying.
“Earlier on, we were assured
by Najib that we would not be
badly affected by the economic
crisis as we have strong funda-
mentals to withstand it. How-
ever, recent announcements
indicate otherwise,” he said.
Last week, Bank Negara
announced that the gross dom-
estic product for the first quarter
of the year would contract by
6.2% – the biggest fall since the
fourth quarter of 1998.
Najib also said the economy
was expected to shrink by 4%
to 5% this year, but would show
positive growth from the fourth
quarter into 2010.
Mahfuz said that apart from
tabling the plan, the govern-
post within 60 days of the
date of a court order, and to
provide names of delegates
within 30 days.
Abdullah Sani, who is also
MP for Kuala Langat, further
claims costs and any relief
deemed fit by the court.
In a letter dated June
10, 2007, Rajasekaran had
informed the plaintiffs and
affiliated unions that the TDC
would be held on Dec 17 and
Dec 18, 2007 and invited
candidates for the posts of
principal officers.
He provided the affiliated
unions with forms to submit
the names of delegates from
their respective unions.
Abdullah Sani had in a
letter dated Oct 29, 2007,
informed Rajasekaran of
his candidacy for the post of
secretary-general.
Polling was held on Dec
18, with Rajasekaran win-
ning 259 votes and Abdullah
Sani 255.
Sivarasa contended that
Rajasekaran had failed to
provide the delegates list
prior to the TDC.
He said the delegates list
was important, being similar
to the Electoral Roll in a
general election. Without the
list, the plaintiffs were unable
to verify the eligibility of del-
egates and their entitlement
to vote.
“We submit that as the
defendant did not earlier
provide the General Council

He said he was sceptical
about Najib’s assurance that
the country would do better in
the third quarter.
“If we don’t recover in the
first and second quarters, will

taken by the government.”
Mahfuz said opposition
parties were ready to discuss
with the government possible
solutions to the crisis.
“We’re ready to give our
input. The problem is that the
government doesn’t listen to
the views of others. If they did,
I believe we wouldn’t be at this
critical stage.”
On another matter, Mahfuz
also called on the Education
Ministry to explain its decision
to reduce the number of core

to four.
Announcing the decision
last week, the ministry however
with the delegates list, the
plaintiffs were not in a posi-
tion to verify the list and ob-
ject to the ineligibility of any
delegate prior to the TDC.
“Furthermore, the ineli-
gibility of the delegates was
apparent only after the elec-
tion had taken place. This
situation was wholly due to
the actions of the defendant
himself in not earlier provid-
ing the delegates list.”
Sivarasa submitted that
the defects were substantive
and had a substantial effect
on the outcome of the elec-
tion.
“This is obvious as the
defendant won by a slim
majority of four votes and
the plaintiffs have demon-
strated that there were six
ineligible delegates who had
participated in the election
unlawfully.”
Counsel D. Kalai who
represented Rajasekaran,
however, contended that
all delegates who had par-
ticipated in the election were
qualified to do so.
“If there were irregulari-
ties in respect of unqualified
participants, it is curable
through Rule 6 (6),” he said,
adding that objections to
unqualified participants could
be made during or before the
proceedings but not after.

rently must take six core sub-
jects – Bahasa Melayu, English,
Science, History, Mathematics,
Islamic or Moral Studies.
“Most likely, they might take
away History and Islamic or
Moral Studies as the other sub-
jects cater to the job market.
But that is not good as students
will lose out and they won’t
know their history, religious and
moral values,” Mahfuz, who is
the Pokok Sena MP, said.
He said the plan to cap the
number of subjects for the SPM
to 10 would pose a problem to
students who are in religious,
Chinese or Tamil schools as
they study more than 10 sub-
jects.
Last week, Education Min-
ister Tan Sri Muhyiddin Yassin
noted that fewer than 10% of
the 500,000 SPM students sat
for more than 10 subjects.
Mahfuz said that as the
percentage was small, there
was no real reason to limit the
number of subjects.
“How many people get

shows the government doesn’t
appreciate these geniuses.”
