Additionally, advisory opinions also support the necessity for independent counsel. The Prosecutor's Office has not previously represented a quasi-governmental agency in a lawsuit against a Judge prior to him/her assuming office, nor vigorously pursued lawsuits, against her/him, once s/he has taken office, to avoid the legal outcomes that resulted from his/her prevailment. Obviously, there are unusual circumstances that create a conflict, that otherwise would not be present. All of your conduct, including deliberately compromising my case and breaching attorney-client privilege in a public forum, is indicative of your office's inability and unwillingness to effectively represent me in my official capacity as an elected official and judicial officer. It is clear that, based on your continued actions, deliberately calculated to harm me in my judicial capacity, you have absolutely no regard for the Ohio Rules of Professional Conduct as it pertains to the representation of clients.

Therefore, I am again requesting that your office immediately recuse itself so that I may seek independent, impartial counsel. Thank you for making application today with the First District Court of Appeals for me to obtain new counsel, as your delayed actions in this matter are harming the Court. It is about the Court of Common Pleas as an institution which is exposed to significant public policy issues and the potential obligation, through the Board of County Commissioners, to pay significant attorney fees and costs should the petitioners be successful. The Prosecuting Attorney represents the Court of Common Pleas when it or one of its Judges are sued in an official capacity action. It is the Prosecuting Attorney who by exclusive statutory and case law authority prepares pleadings, establishes and executes trial strategies and is solely responsible for trial management. It is the duty of the office holder or employee in an official capacity action to provide records, facts and other matters requested by the Prosecuting Attorney. In practice it has been my experience that a collaborative model in which a public official and the Prosecuting Attorney recognize their roles and work together to achieve the best result for the governmental agency is the best model. Private Counsel has no role in an official capacity action.

Ms. Baker, placing my name on a document is a separate criminal matter that extends beyond the scope of any civil litigation. Therefore, in requesting prosecution for a separate criminal matter, I was not authorizing you to discuss information that is clearly confidential in nature. I request that you immediately recuse your office and authorize the appointment of new counsel, based on this egregious breach of my attorney client privilege. Thank you.

Coincidently, on April 19, 2013, Scripts Media dba WCPO-TV filed a Petition and Complaint for Writ of Prohibition C-1300241 against you. I have not seen a return of service on you nor have you made reference to this filing. We will provide you with a copy of this document if you wish. Of importance is the affidavit of Jana Soete, WCPO s managing editor, stating that various applications signed by her on behalf of WCPO were altered by an unknown party who signed (typewritten) the applications indicating WCPO as the applicant. Once again the transcript is needed for a proper investigation and also for your general defense. We are concerned that multiple parties are alleging improprieties in the record. We cannot rule out the possibility at this time that an unknown third party may be the cause of these claims. Certainly the integrity of the Court s records is at issue. Mr. Schaefer will be responding to the issues raised in your most recent E-Mails.

I am requesting that Prosecutor Joseph Deters immediately prosecute Ms. Baker to the fullest extent of the law. The documents were faxed to Juvenile Court on 3-12-2013. Interestingly, the documents in question were not attached to Ms. Baker's extensive affidavit. The forged documents are in cases 12-7304; 12-7366 and 12-7307. Respectfully,
