For A Better Fiji - The 2013 Constitution Unveiled


The 98-page constitutional document in English has also, for the first time, been translated into the two main vernacular languages - iTaukei and contemporary Hindi. In the 15 days before His Excellency the President gives his assent on September 6th, members of the public are invited to read the vernacular versions and provide feedback on their accuracy. Some of the legal terms and phraseology in the English language do not have equivalent words in the vernacular and therefore may be open to interpretation. The Constitution provides for a single chamber 50-member Parliament up from 45 in the Draft document- which will be the countrys supreme authority and be elected on the basis of one person, one vote, one value. Elections are to be held every four years and every Fijian over the age of 18 is entitled to vote. In another alteration to the Draft document, individual regional constituencies are abolished. There will be one national constituency covering the whole of Fiji, as in The Netherlands and Israel. And every voter will get one vote, choosing the candidate who they believe best serves their interests under a proportional representation system. A Prime Minister who commands the party with the most seats in Parliament will head the elected Government and, in line with current practice, a President will be the Head of State and

Fiji's fourth Constitution that will underpin the first genuine democracy in the country history has been released to the public. His Excellency the President will give his assent to the document on September 6th. The document will be the supreme law of the country and pave the way for elections by September 30th, 2014 conducted, for the first time, on the basis of equal votes of equal value. It is in line with the constitutions of some of the worlds most liberal democracies and provides a framework for the development of a modern, progressive state. As previously flagged by the Prime Minister, Commodore Voreqe Bainimarama, the final version differs from the Draft Constitution by containing specific provisions that guarantee and strengthen the protection of communally-owned iTaukei, Rotuman and Banaban lands. During the consultation process that followed the release of the Draft in March, a large number of submissions were received calling for explicit protection clauses. These have been accepted and incorporated into the final document. They provide greater protection and security for ITaukei, Rotuman and Banaban land than ever before. In addition, for the first time, an extra provision gives any landowner the right to a fair share of royalties derived from the exploitation of resources beneath the surface.

The release of the Constitution follows a community consultation process during which the Attorney General, Aiyaz Sayed-Khaiyum and his team conducted 19 public meetings in urban, rural and maritime areas throughout Fiji, including Vanua Levu, Taveuni, Kadavu, the Mamanucas and the Yasawas. Submissions were also sought and 1,093 written submissions were received.

Acting Australian High Commissioner Glen Miles said they would focus on ensuring enhanced training options for students recognised as higher quality nationally. "The $490,000 partnership will mean that more Fiji citizens can gain valued professional and technical qualifications and a pathway to higher learning with APTC or other institutes that provide international standard qualifications," he said. "It is estimated that for every 100 children entering primary school in the Pacific region, only three enter a university and another three enter other post-secondary training."

Govt Receives Budget Submissions


Members of various community organisations and business groups presented their submissions to Government as part of the lead-up to the 2014 budget in November. A talanoa session for the various stakeholders in the economy was conducted at Fiji Revenue and Customs Authority (FRCA) headquarters in Suva on Wednesday hosted by the Finance Ministry and chaired by the Attorney-General, Aiyaz SayedKhaiyum. It also included the Governor of the Reserve Bank, Barry Whiteside, the CEO of FRCA, Jitoko Tikolevu, and Permanent Secretaries from Finance and National Planning. As well as airing their views on the direction the next budget should take, the gathering also provided the opportunity for the various organisations to hear each others views. They ranged from civil society groups such as the Citizens Constitutional Forum, Mareqeti Viti (Nature Fiji), the Peoples Community Network and the Fiji Council of Social Services to the Fiji Sports Council and mainstream employer organizations such as the Fiji Chamber of Commerce, the Fiji Manufacturers Association and the Fiji Employers Federation.

DESPITE the spillover of tensions and fighting from the conflict in Syria into the area of operations in the Golan Heights, Fijian peacekeepers continue to conduct their duties in a professional manner in challenging conditions. Andr-Michel Essoungou, of the Department of Peacekeeping Operations and Field Support, says the presence of the Fijian troop in continuously monitoring and reporting helps to ensure that the UNDOF mission could continue its critical role in the maintenance of the ceasefire between Israel and Syria. He said UN secretary-general Ban Kimoon had established a UN Mission to investigate allegations of the use of chemical weapons in Syria. At a press conference at the UN headquarters in New York on Monday, Mr Ban Ki-moon said the mission began its work this week. Mr Essoungou said the areas under investigation by the mission did not include UNDOF's area of operations. Meanwhile, Mr Ban said after five months of effort, he was pleased to report that the mission would investigate allegations of the use of chemical weapons in Syria. "As agreed with the government, the team will conduct its activities in the country for up to 14 days," Mr Essoungou said. Mr Ban said in order to credibly establish the facts, the mission must have full access to the sites of the alleged incidents.

National Housing Expo At The Hibiscus


The public visiting the Hibiscus festival this week will now be able to meet with housing providers and consult their housing needs at the National Housing Expo marquee at the 2013 Hibiscus Festival. The Ministry of Local Government, Urban Development, Housing and Environment as part of its awareness program to promote Affordable and Decent Housing, opened the expo this week. The Ministrys acting permanent secretary Mr Saverio Baleikanacea said the expo is in line with the Governments National Housing Policy Implementation Action Plan as well as Governments commitment to provide accessible as well as affordable land and housing opportunities to improve living standards in the communities. The Acting PS said Government has carried out policy initiatives to improve the access of affordable and decent homes by establishing a land bank to make land more accessible in response to the needs of the housing sector. The Acting PS urged housing stakeholders to work together and formulate strategies during this years National Housing Expo and work to improving the efficiency and performance of the housing sector.

Seminar Focuses On Market Success


SUCCESS in the share market involves the right combination of strategies and advice to ensure investors participate in the market confidently while minimising risks. This, according to South Pacific Stock Exchange CEO Jinita Prasad, was one of many issues to be discussed at their organised one-hour lunch seminar this week. The seminar aims to provide awareness on the general concept of saving, budgeting and investing to meet financial goals. "The presence of stockbrokers and the investment advisers during this informative session will ensure that you receive proper advice and get access to all relevant information before buying shares," she said. "Investors who have recently received shares under the Fiji National Provident Fund share investment scheme are urged to attend this session as they will also get a chance to interact with the stockbrokers who can help them decide whether they should hold, buy more or sell their shares." Ms Prasad said the free-of-charge event at DeVos on the Park in Suva would include a brief introduction by the exchange followed by a presentation outlining general investing tips, evaluating risks and returns and other fundamentals of share market investing. "The presentation will also have a question and answer session and attendees will be given a change to interact with the licensed stockbrokers present, and even place orders to purchase shares in securities most suited to their financial objectives. In the pursuit of using local natural resources as a source of employment for women, Government has engaged the services of a renowned local bamboo craft expert to develop bamboo craft programs. Mr Sukulu Soko, the assistant trainer at Sunnyville Bamboo Development this week signed off a service agreement with the Ministry of Women. Sunnyville which was established in 2004, is based at Wainibuku, Nasinu in Suva. Mr Soko received his bamboo training from the INBAR (International Network for Bamboo and Rattan Association). INBAR is an intergovernmental organization based in China that has helped thousands of rural producers to make a living from bamboo. Bamboo is known as green gold because it is a good source of income for rural communities. There are resource owners who are more into timber and logging, as a bamboo specialist I always advise them there is a need to look at alternative like bamboo or otherwise all natives of

New British High Commissioner Presents Credentials

The new resident British High Commissioner to Fiji, His Excellency Mr Roderick Ian Drummond presented his credentials to the President, His Excellency Ratu Epeli Nailatikau. His Excellency Ratu Epeli welcomed the new high commissioner to the country as he presented his credentials to the President. Mr Drummond completed a Master of Arts with Honours in History from the Edinburgh University in United Kingdom in 1985. Mr Drummond joined the FCO (Foreign and Commonwealth Office) in 1985 and has worked on Middle East affairs in Algeria, Jordan, Syria, Qatar

and Saudi Arabia, where he had been Deputy Head of Mission since 2009. He has also served in South Africa where he focused on trade and investment promotion, and worked on EU affairs in Brussels, including the development of the EU Common Security and Defence Policy. Mr Drummond also has keen interest in rugby, camping, trekking, tennis, golf, scuba diving, history and cooking. Mr Drummond is married to Mrs Yasmin Kamal with three children. The British High Commission in Suva is also accredited to Kiribati, Nauru, Tonga and Tuvalu, Micronesia and the Marshall Islands.

The newly re-opened Malolo Island Fiji Resort has plans to have a fullyorganic vegetable garden. Newly appointed executive chef,Yngve Muldal, who joined the resort from Etihad Airways, said they were going to ensure that all their herbs and vegetables are fresh from their garden. Cyclone Evan, which passed directly over the island resort in December, completely damaged the resorts vegetation and gardens. Chef Muldal said the $1-million kitchen which the resort management invested in, was a chefs dream. In Fiji, one of the problems that we have seen is obesity and NCDs (non-communicable diseases), and to counter that, it is important that we cook right, he said. At the resort, within the next two

The effect of kava consumption is taking its toll on the education of some of our students, says the Ministry of Educations National Substance Abuse Council. Kava consumption among students is on the rise, says the council, and is among the list of drugs and substances abused by students. The latest is kava consumption and it is increasing, council health education officer Josua Naisele said. Kava is a drug and students had been found abusing it within the school compound and during school functions and trips. The effect is noted in the classroom because their performance had dropped. Project To Reduce Rice Imports


Farmers in Lautoka will have more opportunities in developing their skills with a pilot project for rice farming set to start soon. This will be through the Indonesian Governments assistance to Fiji in their attempt of helping us reduce rise imports. Spearheading this effort is Indonesian Ambassador to Fiji, Aidil Salim. Mr Salim said: Sharing our expertise in rice farming together with seeds which can be harvested three times in a year will give hope of reducing rice imports in Fiji. Fiji spends almost $40 million for rice imports each year which is a very big amount. We will provide a wide variety of rice seeds which can be planted on wet or dry land and best suited for various farmers. These seeds can yield almost six tonnes per hectare giving us a total of 18 tonnes of rice per year. Land for project The Lautoka Chamber of Commerce and Industry administrator Salim Mohammed says the chamber is thankful to the Government of Indonesia. The six acre land for rice farming has been given by Raben Bhan Singh, a Lautoka businessman who also helps with many of the chambers initiatives, he said. This is a pilot project and we are optimistic of pulling it through and expanding on a larger scale. Development should not only be strived from business but from farming as well which has been the source of income for thousands around Fiji. Mr Mohammed indicated the Indonesian Government will provide expertise which will help farmers in this pilot project. Mr Buksh said in the racket, what happened was that the suspect would travel to Fiji for only a short duration, usually for two to six days and stay in upmarket hotels. "These young females had similar profiles, either they were unemployed or were students. The above indicators together with FIU's networking, it is highly suspected that the suspect was conducting financial remittance transactions from Australia to Fiji as payments to the young females involved in prostitution. "The suspect was a frequent traveller to Fiji and during the initial stages of analysis conducted by the FIU, it was revealed that there was no apparent relationship between the suspect and the young female." Mr Buksh said additional profiling of the suspect using FIU's data mining system revealed that the suspect was also sending money to other individuals to facilitate payment for prostitution services. "The case is still under investigation and it is early to determine if the suspect is engaged in other organised criminal activities."

A NEW prostitution racket has been discovered in Fiji, some involving female tertiary students from Suva. The racket involves large sums of money being sent to some young girls as well as school students from a group of males overseas for common prostitution. The prostitution racket was uncovered recently by the Fiji Financial Intelligence Unit through their intelligence system. Confirming this in an interview, FIU director Razim Buksh said several remittances from Australia, all of which were low value transactions that were consistent with the value of payments for common prostitution service. "The transactions ranged from $50 to $500," Mr Buksh said. He said his office was investigating the case of an Australian national who frequently remitted funds from Australia to young females in Fiji. "The funds were being sent to Fiji through foreign exchange dealers." He revealed that a portion of the money being transferred was to a young female studying at a tertiary institute in Suva.

A-G Urges Voter Registration At Hibiscus Festival

People attending the carnival have been given a chance to register at the Elections Booth at the Hibiscus Festival for the 2014 elections. Attorney-General Aiyaz SayedKhaiyum said Fijians continued to register, which clearly demonstrated how enthusiastic they were to take part in the elections next year. We have about 530,000 people who have registered for the upcoming elections, Mr Sayed-Khaiyum said. He has urged all Fijians over the age of 18 that have not yet registered, to do so. Fijis registrar of political parties Mohammed Saneem, said this was a

great opportunity for Fijians to register themselves at the Hibiscus Festival. The three electronic voter registration centers will operate from 10am to 10pm, Mr Saneem said. Hibiscus King contestant Krishneel Nand said it was important to register for the upcoming elections. This is an opportunity to make our vote count for the 2014 elections, he said. The three voter registration centers are at the main centre in the park next to the National Fire Authority booth; another is in the VIP section and the third is in the foyer of Government Buildings facing the park.

THE Health Ministry is working with the Ministry of Education to ensure that school canteens around the country are providing nutritional food and snacks to students. Health minister Doctor Neil Sharma said the purpose of the school canteen guidelines is to promote healthy lifestyles as early amongst young children. We need to produce and provide food that are nutritional and reduce high calorie drinks that has high sugar content and that has no nutritional value to it, Dr Sharma said. With the school health program already in place, we are working with the Ministry of Agriculture and the Ministry of Youths and Sports so that children exercise in schools and to be taught to plant locally grown root crops

Fiji's fourth Constitution that will underpin the first genuine democracy in the country history has been released to the public. His Excellency the President will give his assent to the document on September 6th. The document will be the supreme law of the country and pave the way for elections by September 30th, 2014 conducted, for the first time, on the basis of equal votes of equal value. It is in line with the constitutions of some of the worlds most liberal democracies and provides a framework for the development of a modern, progressive state. As previously flagged by the Prime Minister, Commodore Voreqe Bainimarama, the final version differs from the Draft Constitution by containing specific provisions that guarantee and strengthen the protection of communally-owned iTaukei, Rotuman and Banaban lands. During the consultation process that followed the release of the Draft in March, a large number of submissions were received calling for explicit protection clauses. These have been accepted and incorporated into the final document. They provide greater protection and security for ITaukei, Rotuman and Banaban land than ever before. In addition, for the first time, an extra provision gives any landowner the right to a fair share of royalties derived from the exploitation of resources beneath the surface. The 98-page constitutional document in English has also, for the first time, been translated into the two main vernacular languages - iTaukei and contemporary Hindi. In the 15 days before His Excellency the President gives his assent on September 6th, members of the public are invited to read the vernacular versions and provide feedback on their accuracy. Some of the legal terms and phraseology in the English language do not have equivalent words in the vernacular and therefore may be open to interpretation. The Constitution provides for a single chamber 50-member Parliament up from 45 in the Draft document- which will be the countrys supreme authority and be elected on the basis of one person, one vote, one value. The release of the Constitution follows a community consultation process during which the Attorney General, Aiyaz Sayed-Khaiyum and his team conducted 19 public meetings in urban, rural and maritime areas throughout Fiji, including Vanua Levu, Taveuni, Kadavu, the Mamanucas and the Yasawas. Submissions were also sought and 1,093 written submissions were received.

Congress Aims To Explore World Dalo Size And Weight Demand A Of Opportunities Worry
A NUMBER of farmers on Taveuni have raised their concern regarding the dalo size and weight preference of certain buyers on the island. Delaivuna farmer James Naicker said some buyers were now demanding certain grades of dalo from farmers. "Some buyers expect farmers to give them dalo that weigh two kilograms and of a reasonable size so that they can be exported," he said. "We have been told that in order for our dalo to be exported, we needed to fulfill these recommendations with the dalo we produce.

"It is sad because we cannot accurately control the yield of crops from our farms because it is out of our reach." Vione farmer Takayawa Temo said buyers were demanding at times. Principal agricultural officer North John Cox said they were not aware of these demands. "We have been contacting our officers at our Taveuni office and we do not know of any such incident where demands are being made by buyers on the size and weight of dalo they will buy from farmers," Mr Cox said. "I cannot comment on the issue but we will surely look into it."

TWO fugitives wanted for a fraud case in China were nabbed at the Nadi International Airport last weekend. Following investigations by police officers from China, the two fugitives were escorted out of Fiji on Monday morning. According to Chinese media reports, one of the fugitives fled China with 500 million yuan or about $150 million in Fijian currency. She is reported to have been the controller of Shanghai Fanxin Insurance Agency Company. Police spokeswoman Ana Naisoro said the two fugitives were off-loaded from a flight bound for Vanuatu at 7:30am last Saturday. A COMMERCIAL bank opened its first banking kiosk in the Capital City. BRED Bank Fiji's first banking kiosk at TappooCity is located on Level 4 and was set up to make it easy for customers to access their service. CEO Satish Deb said the idea came to mind when they first started the bank in Fiji. He said the kiosk was just as important as setting up a big branch. However, Mr Deb said they needed to be at the right place and TappooCity was a good choice for the bank. "As you can see, it has a lot of food traffic and setting up a kiosk like this provides convenience to the public. They come in and eat, and when they have time they can open an account or apply for loans this is what the kiosk is all about." He said they were looking at other sites to establish a similar banking service. "If we happen to find good sites, there will be a lot of kiosks opening," he said. While opening the kiosk, Reserve Bank of Fiji governor Barry Whiteside said the set up was an excellent arrangement especially its location in the middle of a busy area. He said BRED Bank established their mark in November last year and needed to extend their footprint to the people as they were a very small player in the market. Meanwhile, Mr Deb said they had good deposit products with one of the highest deposit rates as well as home loans products.

A WOMAN who obtained about $9000 from a man to arrange for his skill migration to Australia has been fined $1000 and discharged without a conviction. Shobna Mishra, 32, pleaded guilty in the Lautoka Magistrate's Court to a charge of obtaining financial advantage by deception. Divisional prosecuting officer Western, Assistant Superintendent of Police Anil Prasad told the court that between August 25 and November 25, 2011, Ms Mishra obtained $9426 from Rikil Kritesh Chand. Mr Chand, 28, a plumber, gave Ms Mishra the money to arrange for his skill migration to Australia but she failed to do so and instead used the money. ASP Prasad said Mr Chand went to Ms Mishra after six months to check for his visa and he was told by her that it was under process. When Mr Chand later phoned Ms Mishra to enquire about the visa, she did not answer her mobile phone and calls were later diverted. Mr Chand then reported the matter to police and Ms Mishra confessed to taking the money from him. While sentencing her, magistrate Lakmini Girihagama told Ms Mishra the court observed that her behaviour involved a great breach of trust and betrayal of confidence. She took into consideration that Ms Mishra had repaid the full amount to Mr Chand and showed genuine remorse. Ms Mishra was ordered to pay a $1000 fine, failing which she would be jailed for 45 days. The matter will be reviewed next month.

The mother of two was conscious when she arrived at the Monash Medical Centre, but later went into full cardiac arrest. Dr Wally Ahmar started treatment using a defibrillator. "[I used] multiple shocks, multiple medications just to resuscitate her," he said. Cruise Abruptly Cancelled Stranding Thousands Of Australians In Singapore

The holiday plans of about 2000 Australians have been thrown into disarray after their cruise, which was scheduled to depart from Singapore was cancelled at the last minute. Cruise Company, Princess Cruises, says it had no choice but to cancel the 14-day journey from Singapore to Fremantle because of a power failure. In a statement, Princess Cruises says the switchboard has limited power affecting the ability to run the ship's operations. It says it regrets this led to its decision to cancel the cruise but repairs need to

be carried out. They are offering a full refund, the cost of flights and other expenses, as well as credit towards another cruise. Passenger Eric Black says they were only told about the cancellation when they arrived at the dock. "Disappointed that they never told people earlier in the piece," he said. "While we were there, we'd been there for an hour, people were still turning up in taxis, getting there bags expecting to go on a cruise." The ship had just undergone an extensive drydock in Singapore.

Police have charged a second person over the death of businessman Shyam 'Sam' Dhody on Queensland's Gold Coast. Mr Dhody's 27-year-old partner was charged with his murder. Police confirmed a 32-year-old Varsity Lakes man was also charged with murder and attempted murder, and faced a bedside hearing in Brisbane's Prince Charles Hospital. Detective Superintendent David Hutchinson says the man is being treated for a heart condition. "He'll remain under guard in hospital until he is able to be transferred to a secure section," he said. "It's been a fairly intense investigation. "We've had a large taskforce of police working on the job, and it's really been the culmination of all the information gleaned over the last six weeks." Indian-born Mr Dhody, 37, was shot dead on July 5. Superintendent Hutchinson says his family in India have been kept up to date on developments in the investigation. "She's in a very bad state," he said. "We are going to do our best to proceed with an application to the Supreme Court for her bail as soon as is possible. "She absolutely denies any involvement whatsoever in either of the alleged offences." The woman is expected to appear in court.

Mexican Drug Cartel Queen Sandra Avila Beltran Deported From US

The United States has deported a Mexican drug smuggler, known as the "Queen of the Pacific", after she served out a jail term, and have handed her over to Mexican authorities to face separate money-laundering charges. Sandra Avila Beltran, 52, was originally arrested in Mexico in 2007 and allegedly helped build the Sinaloa cartel in the 1990s with Joaquin "Shorty" Guzman - Mexico's mostwanted drug boss. She was extradited to the US in August 2012. Avila Beltran is the niece of Miguel Angel Felix Gallardo, known as the godfather of the Mexican drug trade, who is serving a 40-year sentence in a Mexican prison for the murder of a US drug-enforcement agent. Avila Beltran won her nickname for developing smuggling routes along Mexico's Pacific Coast into California. A Florida judge sentenced her to 70 months in prison after she admitted to providing money to a former Colombian drug lord to help him avoid arrest. After serving her sentence in prisons in both Mexico and the US, she was deported to Mexico City, where she was immediately taken into custody on the money-laundering charges.

Her detention came just days after the US voiced outrage at Mexico's release of drug kingpin Rafael Caro Quintero, who was freed after serving nearly three decades of a 40-year sentence for ordering the 1985 murder of undercover Drug Enforcement Administration agent Enrique Camarena. The ruling was a blow to the DEA and the US has asked Mexico to detain Caro Quintero, whose whereabouts are unknown, to face justice on US soil. Caro Quintero's lawyer is seeking the release of Ernesto Fonseca Carrillo, who ran the Guadalajara cartel with Caro Quintero, and was convicted and imprisoned for planning the abduction and murder of Camarena, the DEA agent, with Gallardo. Gallardo's lawyers are expected to follow a similar legal course to try to secure his release, in a potential headache for Mexican president Enrique Pena Nieto's dealings with his northern neighbour. Avila Beltran was among 129 detainees turned over by US Immigration and Customs Enforcement to authorities in Mexico, the US agency said. A judge in the Mexican state of Jalisco wants Avila Beltran to face moneylaundering charges, said a spokesman for Mexico's attorney-general's office.

A man who was left alone with his partner's toddler beat the boy to death and lied about how he received his injuries, prosecutors have told South Australia's Supreme Court. Brock Michael Powell, 24, is standing trial charged with the murder of twoyear-old B.J. Williams, who died in January 2012. Powell has elected for his case to be heard by a judge without a jury. Prosecutor Sandi McDonald said the toddler died from head trauma and also sustained bruising to his face, body and genitals. Ms McDonald told the court Powell was alone with the toddler at a granny flat at Melrose Park in Adelaide's south where he lived with the boy's mother. She said Powell was in a relationship with the toddler's mother and the pair had argued shortly before the boy was injured. The court heard Powell was agitated and the toddler's mother left the granny flat to go into her own mother's house on the same property. "At some stage after that she was awoken by the accused. He told her something was wrong and BJ wasn't breathing," Ms McDonald said. The court heard the toddler's mother ran to the granny flat and saw Powell attempt to give the boy CPR. An emergency call was made but the pair decided to take the boy to the nearby Flinders Medical Centre. "Staff immediately observed bruising to his head and face," Ms McDonald said. "They managed to stabilise his condition and he was transferred to the Women's and Children's Hospital

intensive care unit, but nothing could be done and life support was turned off the following day." Ms McDonald said Powell had told hospital staff, the toddler's family and police that the boy had suffered a fall in bed and had become wedged between the base of the bed and a wardrobe. "It's the prosecution case that the accused did not and has not told the truth about what had happened to BJ," she said. She said the nature and number of the toddler's injuries were inconsistent with Powell's story. The court heard the toddler suffered blunt force trauma to his head and had extensive bruising on his scalp, eye socket, cheeks, ears and jaw. His torso, elbow and genitals were also badly bruised. "It's the prosecution case that these injuries didn't come about by a fall of about 30 centimetres onto a carpet floor. This child had taken a beating and it was the accused who did that," Ms McDonald said. "It could not have happened the way the accused had described to so many people. The only other logical inference based on the evidence is that he beat this little boy to death." The court heard the toddler's mother will be called as a prosecution witness and there will also be expert evidence about the child's injuries as observed by a paediatrician at the Women's and Children's Hospital and the forensic pathologist who conducted the autopsy. A video of a police interview with Powell, conducted at the hospital, will also be played to the court. The trial is being heard by Justice Timothy Anderson.

Man Found Shot Dead At Olivia Newton-John's Home


A man has been found shot dead at the Florida home of singer and actress Olivia Newton-John. The dead man is believed to be a 42-year-old contractor who was working on the multi-million-dollar house owned by Newton-John and her husband John Easterling in West Palm Beach in South Florida. Police are investigating the circumstances of the death but say the couple were out of town and not staying at the house. Initial media reports suggested the gunshot wound was self-inflicted, but that has not been officially confirmed by police. The man was neither a resident nor a member of the family. The nearly 2,300-square-metre house, located on 35 acres by the coast, was built in 1975 and was bought by the couple in 2009 for $4.1 million. Newton-John is famous for her role as Sandy in the 1978 movie Grease, based on the Broadway hit musical. She is also a four-time Grammy winner.

New Zealand Passes Bill Allowing Adelaide Mother Spared Jail Over Domestic Spying Malnutrition Manslaughter Of Disabled Daughter
An Adelaide mother who pleaded guilty to killing her severely disabled daughter through neglect has been spared jail after the sentencing judge said she was a devoted mother who had led a difficult life. Kyla Puhle, 27, weighed just 12 kilograms when she died in her family's North Brighton home in March 2011 from malnutrition and a lung infection. Her parents Harry and Angela Puhle were originally charged with murder. Both were highly respected school teachers and Angela Puhle was a school principal at the time of her daughter's death. Harry Puhle died shortly after his arrest and Angela Puhle later pleaded guilty to a downgraded charge of manslaughter. Justice John Sulan said he accepted Angela Puhle had been a devoted and loving mother to her three children, and had become emotionally detached in the months leading up her daughter's death. He said it was clear Puhle was experiencing psychological denial as a result of her abusive husband, her devotion to caring for her daughter and her efforts in her job. "I am satisfied you were a loving and devoted mother to your daughter and you did all you could over the years to ensure she could live as happy a life as possible for a person with severe disabilities that she suffered from," he said. The court heard Kyla Puhle was unable to walk or talk, was incontinent and was totally dependent in every respect. She also had epilepsy and suffered from pressure sores. Justice Sulan said Angela Puhle stopped taking her daughter to daytime care about six months before she died and instead left her on a beanbag in her house when she went to work. He said she would sometimes come home to feed her in her lunchbreak but at other times left her unattended all day. "By your plea you accept that you failed to recognise and address the fact that Kyla was severely malnourished, and failed to take her for medical treatment in the final week of her life," he said. "It is not disputed that you were a loving and caring mother who provided permanent care for your daughter for 27 years. I accept you did not recognise that Kyla was ill and that she had lost a considerable amount of weight. It was only after you saw photos of your daughter after she had died that you realised she had become chronically thin." Justice Sulan said Puhle had become increasingly isolated and did not have many friends because of her husband's difficult personality. He said Puhle had adopted an emotional survival strategy. "The explanation for you failing to observe this and your failure to seek appropriate treatment at an early stage can be viewed in your approach and attitude to life over a number of years," he said. "Your way of coping with your difficult life was to minimise the seriousness of your situation." Permanent care denied The court heard in 2004 Harry and Angela Puhle had applied to have their daughter placed in permanent care, but there was never a spot available for her because her disabilities were not classified as a priority case. Justice Sulan said temporary respite accommodation was available to them for 52 nights a year, which they sometimes used, but said it was sad that the family did not take up other forms of care they were entitled to. Justice Sulan said Puhle was regarded by her colleagues as an excellent educator and a devoted mother. He said she had been suspended from her employment and would be unlikely to work as a teacher again because of her conviction. "It is unfortunate that someone of your talent and ability may not be able to continue to provide your talents to students and staff who would benefit from working with you," he said. Justice Sulan said it was rare for people convicted of manslaughter to get suspended sentences, but he described the circumstances of the case as tragic. He set a head sentence of five-years jail with a non-parole period of two and a half years which he suspended. He placed Puhle on a three year good behaviour bond. "For all but a few months of Kyla's 27 years you devoted your time, love and energy to her welfare. Even at the time when you objectively did not do so you believed you were acting in her best interests," he said. Puhle cried and declined to comment as she left court.

New Zealand has passed legislation allowing its main intelligence agency to spy on residents and citizens, despite opposition from rights groups, international technology giants and the legal fraternity. The bill to expand the power of the Government Communications Security Bureau (GCSB) passed by 61 votes to 59 after impassioned debate, with Prime Minister John Key acknowledging the move had left some people "agitated and alarmed". "This is not, and never will be, about wholesale spying on New Zealanders," Mr Key told parliament. "There are threats our government needs to protect New Zealanders from, those threats are real and ever-present and we underestimate them at our peril." The push to change the law came after it emerged last year that the GCSB illegally spied on Internet tycoon Kim Dotcom before armed police raided his Auckland mansion as part of a US-led probe into online piracy. At the time Mr Key publicly apologised to Mr Dotcom, who is a New Zealand resident and should have been offlimits to the GCSB under legislation preventing it from snooping on locals. However, an official report found that Mr Dotcom's case was only one of dozens in which the GCSB had overstepped its bounds. Mr Key then moved to change the law to let the GCSB spy on New Zealanders, arguing it needed to cooperate more closely with agencies such as the police and military in an increasingly complex cyber-security environment. Mr Dotcom has been one of the strongest opponents of the bill, saying it gives government spies legal access to New Zealanders' electronic communications, including mobile phone calls.

"This will be the birth of a surveillance state in New Zealand," he told a protest meeting in Auckland last weekend. After Wednesday night's vote, Mr Dotcom predicted a backlash against Mr Key at next year's general election. "The #GCSB bill just passed in Parliament against the will of most Kiwis. RIP Privacy. Payback at the 2014 election," he tweeted.

Global opposition

Tech giants such as Google, Facebook and Microsoft have also voiced concern about expanding the GCSB's surveillance powers. "Blanket rules requiring data retention and accessibility are blunt tools, which have the potential to infringe on civil liberties and constrain economic growth," Facebook said in a submission to a parliamentary committee reviewing the bill. New Zealand's Law Society, Human Rights Commission and Privacy Commission all made submissions raising concerns about the bill and calling for significant changes. An opinion poll published in the Dominion Post newspaper on Wednesday found 75 per cent of respondents were concerned about the changes. Mr Key dismissed such reservations, saying conspiracy theorists and his political opponents had whipped up an alarmist frenzy. "I have rarely seen so much misinformation and conspiracy as has been perpetrated about this bill," he said. "That has some citizens agitated and alarmed, which I regret. But my regret would be nothing compared to the threat if this legislation was not passed and New Zealanders were harmed because of a gap that currently exists in our security arrangements."

Surrey Man One Of Three To Drown In Okanagan Lakes

Mcdonald's Customer Alleges Language Discrimination


A B.C. woman is claiming she was refused service at a Richmond McDonald's because staff said they couldn't understand her English. Hai Xia Sun ordered a hot chocolate at the McDonald's on Number 3 Road in Richmond last week, but said staff gave her a coffee by mistake. She said she asked that her order be fixed, but alleges the manager refused and told her to get out of the store instead. "She said, 'You don't know English,' and then she returned my order. She said, 'We are very busy, don't stay here,'" Hai Xia Sun told CBC News. Sun called the incident discrimination. "This is my second language right. And this is discrimination. Yes maybe I speak not very good English but she can't not service to us." Restaurant blames 'language barrier' But a McDonald's spokesperson says it was an isolated incident caused by a "language barrier," not discrimination or poor service. "We regret that this customer was offended during her recent restaurant visit. We have since been in communication with her son who has expressed appreciation for our efforts

BC Coroners Service has identified a Surrey man as one of three people who drowned in Okanagan lakes last weekend. Mitesh Krishnil Gounder spent the afternoon on Okanagan Lake with a friend on Aug. 16. Around 6:45 p.m., he went for a swim and was seen to be in trouble in the water shortly after. No one was able to rescue him and emergency services responded. He was spotted from an RCMP helicopter the next morning and his body was recovered. The other victims - 66-year-old Mervyn Kenneth Reinson of Langley and 73-year-old Randolph Peter Lundblad of Kaslo - died in separate incidents on Okanagan Lake and Mirror Lake. Two drowning incidents this past weekend have left one man dead and while another who was taken to Kelowna General Hospital last Friday has died. Early Sunday evening, a 24-year-old Surrey man drowned after getting into trouble while swimming out to his boat from the Okanagan Lake shore near a private beach access at Watt Road in the Mission. His girlfriend, also in her 20s, was in the boat and tried to help her boyfriend, who police said encountered difficulty staying afloat. She jumped into the water to help him but to no avail. She also placed herself in danger as well. A lakefront resident had reportedly seen the incident unfold from his home and rushed out to help the couple on

his Sea-doo. But by the time the woman was rescued, her boyfriend had disappeared below the waters surface. Police were called to the scene at 7 p.m. Sunday night, with search and rescue teams from Kelowna and Vernon, along with the Kelowna Fire Department dive team, to help find the body. That effort came to a heartbreaking conclusion at about noon Monday when the Surrey swimmer was found near where he had disappeared in about 10 feet of water. The young couple had rented the 20foot Bayliner boat and were about 150 yards from shore when the incident occurred. Neither were wearing a life jacket. Police have not released the identities of the couple. Emergency personnel were comforting the drowning victims girlfriend on the beach as she waited for some sign of her boyfriend from the search and rescue effort. This summer has proven one of the more deadly summers in B.C. in terms of the number of people who have drowned. In addition to the death of a father who jumped into Wood Lake to save his two boys, the Okanagan has already seen another man die in a snorkeling incident in Peachland. The embattled Saskatchewan senator and former Conservative caucus member was informed Wednesday that she'll have to reimburse the Senate a grand total of $138,970 for ineligible travel expense claims. Wallin was already on the hook for $121,348 after an independent audit of her travel expenses, released last week. The auditors advised another $21,000 in questionable claims should be reviewed by the Senate's internal economy committee. Those claims involved travel to what the self-described "activist senator" deemed "networking events" and other special events, including speeches. The committee concluded Wednesday that Wallin should pay back most of those additional claims, worth $17,622. The decision comes as no surprise. Last week's audit report noted that the internal economy committee's steering committee had already reviewed Wallin's travel claims for so-called networking events and had concluded that "while occasional exceptional occurrences for special events might be acceptable, the volume and pattern of the events listed (by Wallin) would not qualify them as Senate business." The audit report, which looked at Wallin's claims dating back to 2009, listed 13 networking events, which Wallin had described as primarily lunch or dinner meetings with unidentified representatives of the business, arts and charitable communities. Among them, were meetings with: "Chair of a media corporation, regarding media issues." "Artist, performer, university lecturer and member of Arts Council, to discuss the federal government's policy regarding culture." "An executive of Canada Post to discuss the business and technological challenges facing Canada Post." "Leading Canadian businessman and investor ... A new study has found that high cholesterol is riskier for middle-aged men compared to women when it comes to having a first heart attack. The study of more than 40,000 Norwegian men and women, shows that being a middle-aged male and having high cholesterol levels results in a negative synergistic effect that the researchers did not observe in women. However, current clinical guidelines for treating high cholesterol levels do not differentiate between men and women. Erik Madssen from the Norwegian University of Science and Technology's (NTNU) Department of Circulation and Medical Imaging, who was first author of the paper with Lars Erik Laugsand, also from NTNU, said that their results suggest that in middle age, high cholesterol levels are much more detrimental for men than women, so that prevention efforts in this age group will have a greater potential to reduce the occurrence of a first heart attack in men. The researchers used data from the

In the end, the researchers had information from 23,525 women and 20,725 men who fit this category. During the nearly 12 years of follow-up on the participants who were younger than 60 years when the survey was conducted, there were 157 new cases of heart attacks in women and 553 in men. They also conducted a secondary analysis of participants who were 60 years old or older at the time of the survey, which gave them another 20,138 individuals for the analysis. However, there was no evidence of a negative synergistic effect in male participants in this age group.

Moorman, an assistant professor in the Department of Sociology and the Institute on Aging at Boston College, who will present the study at the 108th Annual Meeting of the American Sociological Association, said that they found that an emotionally close grandparent-adult grandchild relationship was associated with fewer symptoms of depression for both generations. She said that the greater emotional support grandparents and adult grandchildren received from one another, the better their psychological health. The study also revealed that giving tangible support to or receiving it from their grandchildren affected the psychological well-being of grandparents but not grandchildren. A new study has revealed that smoke from burning biomass, such as wood, animal dung and waste from agricultural crops leads to cardiovascular problems, including an increase in arteryclogging plaques, artery thickness and higher blood pressure. "In these homes, you can hardly see your hand in front of your face when families are cooking or burning fuel for heat," Washington University cardiologist Victor Davila-Roman, MD, professor of medicine, said. "Everyone in the household is affected, but women in particular take the brunt of it because they are home much of the day and do the cooking." The researchers, including the study's first author, Matthew Scott Painschab, MD, a School of Medicine graduate who did this work as a National Institutes of Health (NIH) Fogarty Scholar, studied 266 men and women in Puno, Peru, and the surrounding rural communities. People in the city, which has a population of about 100,000, primarily use cleaner fuels including liquid propane gas, kerosene and electricity to cook. In contrast, people in the surrounding communities use open-fire stoves. Reporting their results recently in the journal Heart, the investigators found that indoor particulate matter measured 20 times higher in the rural homes. Comparing the two groups, they also found significantly thicker carotid arteries - the vessels that feed blood to the brain - in the rural study participants, even after adjusting for age, gender, cholesterol levels, body mass index and other factors known to affect cardiovascular health. The rural residents also had more plaque buildup in the carotid arteries and higher blood pressure than their city-dwelling counterparts. Such factors are known to increase the risk of heart attack and stroke. 2014 Sanatan International Convention


By Ram Rajendra, National Governor for Canada Sanatan On Sanatan Convention Board of Governors (formerly known as Sanatan World Cup Soccer) Sanatan World Cup Soccer Tournament was started in 2004 by Sanatan World Cup Soccer Association of NSW, Australia using the top-down governance structure with President from Sydney, Australia and Vice Presidents (VPs) representing the participating countries. Australia, New Zealand, USA and Fiji participated in 2004. Canada joined with two teams in the Premier Division in 2006 when New Zealand hosted the tournament. Canada is the only country that has regularly fielded two Premier teams since joining. The Masters Division was introduced in 2010 in Fiji. The umbrella body folded in 2008, however, the first round of the tournaments continued under the same governance structure. Each VP of the participating country organized the tournaments in their respective countries. In Canada, the 2012 event was by Shalendra Kumar and the board members of BC Sanatan in Langley, British Columbia., As the VP for Canada Sanatan, I pushed to flatten the governance structure to recognize the leadership role of the VPs in hosting this international event. With the consensus of all VPs, I drafted a Memorandum of Understanding (MOU). It was reviewed, revised and approved by all VPs in 2012 when Canada hosted the tournament. The MOU is a unique affiliation document that helps Indo-Fijian Sanatanis of participating countries reconnect with their roots and showcase their talents. The new, flat governing body is Sanatan International Board of Governors (BOG) where the hosting countrys Governor automatically becomes the Boards chairman, thereby taking the politics out of the game. With expanded scope, the event was renamed to Sanatan International Convention. The five National Governors on the BOG are: Ram Rajendra for Canada Sanatan; Suresh Prakash for USA Sanatan; JIten Chand for Australia Sanatan; Bobby Chand for New Zealand Sanatan; and Pt. Deepak Sharma for Fiji Sanatan. The BOG sets, revises and executes policies, programs, services, rules and strategies that enhance the outreach of and lead to excellence in programs and services for men, women, children and youths to enjoy and carry on the international heritage. The MOU also acknowledges the original founders and launchers of the tournament in 2004. Sanatan Convention is a faithbased, international event that is held every two years in different participating countries that host the event on a rotation basis. The 2014 Sanatan Convention will be held in Sydney, Australia during October 5-7 tentatively. The MOU establishes a process for accepting new teams in the tournaments. Each new team wishing to join must first discuss the matter with the provincial representative. If the request appears viable financially and talent-wise, a written request to join must be submitted by the new team with the support of the provincial representative to the Governor for Canada Sanatan who will do his own due diligence and recommend acceptance or rejection in writing to the BOG Chair. The request must state how the new team will help enhance the event. A new team may be required to put a bond to show the seriousness of its intention to join. Add the upgraded sport seats of the Titanium model and you'll find even better support than the already impressive base front seats. Whether you choose the sedan or hatchback, you get back seat accommodations that are virtually the same, with just enough legroom and headroom to fit even those over six feet. With the leather upholstery, there's no skimping on look and feel in back; you won't get mid-size comfort, but there's enough comfort back there for most six-footers. Our most significant complaint concerns the instrument panel design, which seemingly cuts into front passenger knee space especially. The 2.0-liter direct-injected fourcylinder engine that powers most of the lineup produces 160 horsepower and 146 pound-feet of torque; it's paired with either a five-speed manual gearbox or six-speed PowerShift dualclutch automatic. But what's new for 2013 is a high-performance Focus ST variant that can get to 60 mph in just 6.3 seconds and to a top speed of 155 mph. Packing a 240-hp turbocharged EcoBoost four and a six-speed manualno automaticit calls out to

serious driving enthusiasts. Performance from the Focus ST is a rush, as you might guess; but it's surprisingly well-engineered, with none of the coarse or twitchy tunercar feel that affects the likes of the Mazdaspeed3 and Mitsubishi Ralliart. As for the rest of the Focus lineup, choose the manual gearbox and you'll have one of the best-driving small cars in the segment. You have to rev the engine to get to its perky side, but it's smooth, with a nice linkage. The PowerShift dual-clutch automatic transmission in general does a good job keeping the revs up when you need itbut it can be rough at times at low speedsand there's a Sport mode or you can control shifts on your own with a little +/- button on the side of the shift knob. The Focus handles as well asor better thanthe most deft handler in the class, the Mazda3, with a suspension that doesn't crash and bang over rough transitions. Ford's electric power steering system provides nice weighting and it performs well, providing precise control but not transmitting much feel of the road. (There's also a low-volume Ford Focus Electric model offered in more than a dozen U.S. markets. It's built on the same production line as other Focus variants, but dispenses with the gasoline

engine and transmission, replacing them with a lithium-ion battery pack that runs an electric motor. The EPA rates the Focus Electric at 76 miles of range, and its price including delivery starts at $39,995. Ford appears to be only lukewarm on its most advanced Focus; throughout 2012, it sold just 685 of them nationwide. The 2013 Ford Focus Electric continues unchanged from the 2012 model.) Safety-wise, the Focus holds strong; it's one of the few compact sedans to have earned both a five-star NCAP Overall Score and IIHS Top Safety Pick status. The Focus still is offered in a costconscious $16,995 Focus S base model, but the true focus is toward those well-equipped, tech-loaded upper trims like the SEL and Titanium. With just under two years until kick off in the first match of the FIFA U-20 World Cup New Zealand 2015, FIFA and the New Zealand Football Local Organising Committee (LOC) have confirmed that seven cities will host matches during the tournament. After a robust selection process the seven successful cities to host the tournament are Auckland, Christchurch, Dunedin, Hamilton, New Plymouth, Wellington and Whangarei. Providing a wide geographic spread around New Zealand was a key part of the selection process as the LOC wanted to enable as much of the country to experience the tournament as possible. Altogether the tournament will host 24 national teams, include 52 matches, and will run for three weeks from May 30 until June 20, 2015 during the local football season, which will provide a great opportunity for the large youth playing base in the sport to be inspired by the worlds best players. With an average of three goals scored per game in the last three FIFA U-20 World Cup tournaments this will be dynamic, exciting Football at its best. The tournament will be broadcast to over 100 countries and a global television audience of more than 170 million people, providing exposure for the tournament, the host cities, and New Zealand on a massive scale. It is estimated more than 7,000 overseas fans will pour into New Zealand for the tournament and to support their teams. Auckland will host the opening match as well as a selection of pool matches,

a quarter-final, a semi-final, 3rd/4th play-off and the final. All of the nine matches to be played in Auckland will be played at North Harbour Stadium. North Harbour Stadium hosted the opening match and the final of the FIFA U-17 Womens World Cup 2008 and is the home of New Zealand Football. Christchurch will also play a significant role in the tournament hosting nine matches including six pool matches, a Round of 16 clash, a quarter-final, and the other semi-final. All of the Christchurch matches will be played at Christchurch Stadium. Both the LOC and FIFA were impressed with the stadium and are happy to be playing a small part in the Christchurch rebuild effort. Wellingtons proven love of football and sizeable fan base was a key factor in awarding nine matches to the capital. Altogether six pool matches, a Round of 16 double-header, and a quarter-final will be played at Wellington Regional Stadium. Hamilton will see eight matches including a full pool of six matches, a Round of 16 match and a quarter-final. All of the Hamilton matches will be played at Waikato Stadium. The great support shown by local businesses and the sporting community throughout the bidding process, combined with a large population catchment area, should make for some large local crowds. Otago Stadium in Dunedin will provide the only covered stadium for the tournament hosting seven matches including a Round of 16 match. A FIFA inspection team were very impressed with the stadium and see the roof as a major benefit given the winter timing of the tournament. New Plymouth also impressed the FIFA group with their strong provincial sporting and events pedigree. Six games will be played at Stadium Taranaki made up of five pool matches and a Round of 16 clash. Whangarei rounds out the list of host cities and ensures a solid geographical spread for the tournament. Four matches will be played at Northland Events Centre including three pool matches and a Round of 16 match up, ensuring that all host cities get to see knockout football.
