Sub: Govt of Maharashtra wants Mahamumbai SEZ another Nandigram? Ref: 1.Response recd from GOI of 6 March 2007 2. Response of Commerce Secretary, GOI of 22 Jan 2007 3. Letter to Govt of Maharashtra of 6 March 2007 etc Once again Government of India informed me that they had asked Govt of Maharashtra to reduce the size of Mahamumbai SEZ. Please find enclosed one more response of 6 March 2007 from Govt. of India on Mahamumbai SEZ. I am also enclosing previous response from Commerce Ministry, GOI of 22 Jan 2007 (which you already have). Nandigram SEZ has cost 11 innocent lives yesterday. Hope at least now Govt of Maharashtra shall understand the cost of accommodating a private corporate to create Mega SEZ by forcefully acquiring land from farmers. Mahamumbai-Navi Mumbai are such Mega SEZs in Maharashtra. Mahamumbai is of 120,00,00,000 square feet. BJP supports SEZ but have reservations about using Govt machinery & forceful acquisition. Notification under Sec 4 of 1894 Land Acquisition Act is nothing but Creating Monopoly, Forceful-Compulsory Acquisition. It must be used rarely, with due care, for Govt projects. To use in absurd manner for Real Estate Business needs re-thinking. Ideally SEZ with Private Land be developed. No force is used. Interaction must. BJP is strongly opposed to creation of such Nandigrams in Maharashtra. No forceful acquisition at the cost of farmers lives. The Shetkari Atmahatyas is enough to handle. Both Central & State govt. have failed miserably to handle the same.

BJP also demands explanation from State Govt why they have rejected Union Govt recommendation of downsizing the Mahamumbai SEZ. We are sorry that Govt of Maharastra is not much concerned about the national debate, consensus, happening. Whole of the country is concerned & worried about abuse of 2 Compulsory, forceful land acquisition under 1894 Land Acquisition Act for Mega SEZ. The country is concerned about making available such land to 3-4 Private Corporates-Builders for Real Estate business. Only ONE in Maharashtra. Let me once again put facts before you 1. 2. Mahamumbai SEZ land acquisition going to affect 1,09,006 persons directly as replied by The Raigad Collector Original, Actual approval given to Mahamumbai SEZ on condtion that they shall purchase the land directly from farmers. No question Govt of Maharashtra forcefully acquiring land under 1894 Act. Original sanction given to Shri Nikhil Gandhi Reliance acquired/purchased The SEZ from Shri Nikhil Gandhi Than why in November 2005 or so Maharashtra Govt changed, amended the original proposal in the approval & issued notification under 1894 land acquisition act ? Why & What ground, terms, conditions regarding land purchase (now acquisition) were changed by Govt of Maharashtra ? Maharashtra Govt informed me that this is the most developed/developable urban areas. Part of Mumbai-Navi Mumbai-MMRDA. Surrounded by the best infrastructure, Express Way, High Way, JNPT, Trans Harbor Link Road, Airport. It is going to be another Mumbai. All these infrastructures developed by governments. Farmers, activists are questioning why such huge Mega SEZ is not developed away from Metro City? Farmers, Activists are questioning why NEW JAMINDAR is developed by Maharashtra Govt by snatching away land from farmers? Activists says anybody can purchase land in private transactions in democracy (as done now forcefully he can not develop or sale to anybody else). Understood Reliance could got/purchase only 200 acres of land before Nov 2005 i.e. Before issuing of Notification Under 1894 Land Acquisition Act

Notification means freezing of all development plans, private sale, private or govt development etc. Only Reliance can do such thing. Every body shall have to sale their land only to Reliance To accommodate a Private Corporate to Develop Real Estate? In the most developed Urban Area-Periphery? 3

Govt of Maharashtra has informed me that Mahamumbai & Navi Mumbai both SEZ are of 16,600 hectares size i.e. 41,000 acres i.e. 166,00,00,000 square feets of land ( 166 Crores lacs square feet). Farmers are questioning why govts are going so much out of the way for only one SEZ Developer? In Maharashtra the State Govt has issued such notification only for one private SEZ i.e. Mahamumbai. Out of 19000 hectares land being acquired 12000 hectares are for Mahamumbai

The debate about acquisition of land for SEZ needs serious considerations. Important factors Using govt machinery to acquire land for private developer Land price, compensation Rehab package Farmers response Size & location of SEZ-land Background, intention & abuse of Real Estate Business

We once again demand re-thinking, reconsideration of any forceful, compulsory, monopolistic acquisition. You may be aware that CPM & West Bengal Govt also now reconsidering the Size of Mega SEZ. It should not be more than 2000 hectares. Gujarat Govt also avoiding any such forceful land acquisition. There is a need to study the impact of such Mega SEZ, Mega land acquisition. All such acquisition is put on hold. Govt system be not allowed to create New Zamindars. Thanking You Yours Sincerely
