ORDER

Before the Court is Defendants' Motion to Withdraw Defendants' Motion for Sanctions. (Doc. 308.) In this motion, Defendants seek to withdraw their earlier Motion for Sanctions of Disqualification (Doc. 101) and Objection to the Magistrate Judge's Oral Order of April 5, 2013 (Doc. 148) . 1.) ruling

that

disqualification was an inappropriate sanction for counsel's conduct. (Doc. 215,) Because Defendants' Motion for Sanctions of Disqualification is no longer pending, Defendants' Motion to Withdraw is DISMISSED AS MOOT. The Court notes, however, that the absence of Defendants' motion seeking sanctions does not prevent this Court from sanctioning Plaintiff's counselMr. Matthew C. Billipsfor his conduct in this case. The Court has inherent authority to regulate the conduct of attorneys who practice before it. While both the Magistrate Judge and this Court concluded that disqualification was an inappropriate sanction, both also noted that some form of sanction was likely to follow at the conclusion of this case. Indeed, the Court has already entered an order directing Mr. Billips to show cause why he should not be sanctioned for his conduct. These proceedings will continue unabated by the withdrawal of Defendants' motion. SO ORDERED this Iday of August 2013.
