Dear Hon. Judge Beesley, NVB et al,
I apologize in advance if it is poor form to email this, but given the
particulars of this situation, I am unsure how else to proceed.
I attempted to file the attached Motion on August 20th, 2012 via the NVB
em/ecf system and was under the belief that I sent this email at that time
when I was unable to submit such a filing. At that time, it appeared the
only thing I was able to do on the em/ecf system was submit a proposed
Order, and I did so, though the Propsed Order, as I recall, essentially
consisted of the attached document. At that time, however, I was under the
belief that I had also email in this document to the NVB, my then client,
and opposing counsel, and the Trustee. Hopefully the em/ecf system has
maintained some record that I attempted to submit the attached document,
even if as a proposed Order, on August 20th, 2012.
I called the EM/ECF system today and was informed that I would need to
paper filed such a Motion to Wtihdraw. I attended the hearing today and
Judge Beesley indicated he would grant my withdraw. I am submitting this
now just for further proof that I did attempt to withdraw (hopefully the
em/ecg system will have record of this, as I did submit this document as a
"Proposed Order" given I did not know what else to do and time was of the
essence.
Given the Order/indication Judge Beesley made in Court today, ie, that he
would or was granting my Withdrawal from the Case, much of the content of
the attached attempted filing is, of course, irrelevant now, but I am
submitting it at this time to guard against any appearance that I was
attempting to continue to practice law while my Nevada law license is
temporarily suspended, though the content of the attached attempted filing
does set forthe the state of American jurisprudence as to the
permissibility of just that situation.
Apparently, I was mistaken in thing I sent this via email, as I found this
email (minus these recent notes) in my drafts, folder... Upon further
review, I note that the caption on this document is in error, but the
document title underneath the caption is correct.
please find attached a Motion to Withdraw as Mr. Keller's Attorney of
Record that I was unable to get accepted for filing on the cm/ecf system.
