AFFIDAVIT I, Carlo Martin R.

Alcala, 42, single, Filipino holding office at Branch 3, Municipal Trial Court in Cities, 3rd Floor, Hall of Justice, Sta. Barbara, Zamboanga City, after being sworn in accordance with law, hereby depose: 1. Sometime middle of August 2013, I received OCA Circular 89-2013 on the 15th National Convention of the Metropolitan Trial Court Judges Association (MeTCJAP) in Roxas City. 2. On 29 August 2013, I purchased Cebu Pacific ticket1 for flight to Manila2 tonight at 8:15p.m. 3. On 9 Monday, elements of the MNLF lay siege on Zamboanga City, particularly affecting Sta. Barbara. As a consequence, flights to and from the City on that day were cancelled. 4. Through television public service announcements, I learned that cancellation of flights might last until Wednesday, 11 September. 5. On Thursday, DILG Sec. Mar Roxas held a press conference wherein he said, among others, that government/military C113 planes would transport ticket-bearing passengers by Friday and Saturday; i.e., 9:00 a.m. and 1:00 p.m. for CebuPac and PAL passengers, respectively. 6. Roxas issued a caveat, however, that only those attending the pilgrimage in Mecca (hajj) may be included or at least prioritized pursuant to a special arrangement reached upon request to him by an official of the Office for Muslim Affairs. 7. True enough, other passengers both Muslims and Christians who went to the airport as early as 4:00 a.m.3 waited in vain to be accommodated to the flights, because only the hajj-pilgrims, who arrived by around 2:00 p.m. already, were entertained and listed in the manifest. 8. These excluded passengers,4 like myself,5 were whisked or cordoned away from the airport vicinity by the AFP/PNP guards and made to stand in the hot sun for hours, until about 5:00 p.m. when we were told that there is no hope for any room to accommodate us in the planes. 9. I and my fellow passengers sounded-off our complaints to those who cared to approach us in the cordon/ribbon, such as of shabby treatment and the fact that three scions of reportedly prominent officials were allowed to furtively slip through all security checks without question, and they even overtook the hajj-passengers. 10. On one occasion, a DILG-undersecretary approached to make a token explanation of how things work, but I perceived that it was more to appease me because I howled the most persistent protest against our discrimination,6 citing the unlawfulness, if not immorality, of the process,

per my memory of a certain provision in the Anti-Graft and Corrupt Practices Act, thus:
Section 3. Corrupt practices of public officers. In addition to acts or omissions of public officers already penalized by existing law, the following shall constitute corrupt practices of any public officer and are hereby declared to be unlawful: xxx xxx (e) Causing any undue injury to any party, including the Government, or giving any private party any unwarranted benefits, advantage or preference in the discharge of his official administrative or judicial functions through manifest partiality, evident bad faith or gross inexcusable negligence. This provision shall apply to officers and employees of offices or government corporations charged with the grant of licenses or permits or other concessions.

11.I can only surmise that favoring the hajj-passengers would be politicallyexpedient for the respondent, but feel disappointed at how integrity and values against palakasan may be lacking in the high-official whom I have heretofore respected. 12.I execute this affidavit to attest to the truth of the foregoing, among other legitimate intents and purposes.
