CONTSTITUTION AND BY-LAWS OF THE MARINDUQUE STATE COLLEGE SCHOOL OF ALLIED MEDICIN STUDENT ORGANIZATION

PREAMBLE We, the officers and members of the School of Allied Medicine Student Organization of Marinduque State College, School of Allied Medicine imploring the aid of our Almighty God, in order to establish a, democratic, autonomous and representative student organization that shall carry out the needs, ideals and goals of SAM studentry, to protect and promote student right and welfare, leadership and unity, and foster closer relationship among SAM students and Faculty for the effective participation in the advancement of allied health education, do hereby ordain and promulgate this constitution.

Article 1 NAME AND NATURE OF THE ORGANIZATION Section 1: Name The organization shall be known as School of Allied Medicine Student Organization (SAMSO). Section 2: Domicile The office of the School of Allied Medicine Student Organization SAMSO shall be located at Marinduque State College School of Allied Medicine.

Article 2 DUTIES AND RESPONSIBILITIES OF SAMSO Section 1: The organization shall be responsible for the planning, organizing, financing and conduction each own activities and shall itself supply money, manpower and creative imagination except in the case of joint projects or activities undertaken in cooperation with other organization, such responsibility shall be shared with such organization. Section 2: Provide development program for each member. Section 3: Shall conduct meetings. Section 4: Initiate programs designed to enhance the social, political, economic, cultural, intellectual, moral, spiritual, and physical development.

Section 5: Shall attend and participate in all college activities, seminars, workshops, conference and assemblies. Section 6: Acts expeditiously as much as possible on problems requiring action and decision. Section 7: Promote the SAM mission and vision and the College as well.

Article 3 MEMBERSHIP Section 1: All bonafide and enrolled college students of MSC-SAM. Section 2: Members of SAMSO shall pay a membership fee of P 100.00 payable upon enrolment and P 100.00 semestral dues every semester. Section 3: The paid membership fee and semestral dues shall not be refundable unless the students officially withdraw his/her enrolment one week after opening classes upon prior notice to the office of SAMSO.

Article 4 DUTIES AND RESPONSIBILITIES AOF THE MEMBERS Section 1: Each member shall have the following duties and responsibilities A. B. C. D. E. F. To uphold and obey the policies of the organization. To abide by the policies and programs which shall be adopted by the SAMSO. Actively participate in all activities of the organization. To conduct oneself as student of MSC-Sam and as a member of SAMSO. Regularly pay membership fee and other dues. All members shall perform such duties and responsibilities that promulgated by the organization.

Section 2: Every member shall cooperate with the faculty staff of SAM, officers of SAMSO in the implementation of the existing rules promulgated by the both offices. Section 3: Every member shall elect their respective classroom officers.

Article 5 COMPOSITION OF SAMSO OFFICERS Section 1: The organization shall be composed of: elected president, vice president, treasurer, auditor, two PIOs, business manager, two sergeant at arms; appointed secretary; and all class presidents and treasurers as representatives.

Article 6 QUALIFICATION OF THE SAMSO OFFICERS Section 1: The officers of the organization shall meet the following requirments: A. A duly bonafide and enrolled students of MSC-SAM B. With no pending cases or charges instituted against him for violation of school laws, rules and regulations. C. With no failing subjects in any subjects enrolled in MSC-SAM. D. Have paid all necessary dues and other accounts to the organization. E. For major positions (President and Vice President), candidates shall not be freshmen. F. For minor positions, all SAM students are free to run for a position desired provided that they met the standard qualification above.

Article 7 DUTIES AND RESPONSIBILITIES OF THE SAMSO OFFICERS Section 1: President A. Be the executive officer of the organization who shall be accountable to the studentry of SAM. B. Represents the organization to the MSC Supreme Student Council. C. Presides over all meetings of the organization. D. Create committees as deemed necessary to ensure success of the activities of the organization. E. Carry out policies, rules and regulations promulgated by the constitution and bylaws. F. Be a signatory on the disbursement of funds and other documents (bank accounts). Contracts/agreements made and entered into by and between other organizations and higher officers, provide however that such contract or agreement has been ratified of otherwise concurred by a majority vote of all the officers of the organization. G. Be a signatory in the students clearance.

H. Designate an Officer in Charge in case he/she is out or absent. Section 2: Vice President: A. The vice president shall succeed to the office of the President in the event of vacancy of the latter to whatever purpose. B. Represents the organization to the MSC Supreme Student Council. C. In the case of emergency or unexpected circumstances, he/she shall immediately be appointed and take charge of the duties and responsibilities of the President through majority vote by members of the organization. D. Perform other functions that may be delegated by the president of the organization. Section 3: Secretary A. The secretary shall keep all the records of the organization. B. He/She shall prepare and keep the minutes of all the meetings of the SAMSO and provide copies of such the authorities concerned when the need arises. C. Prepare and send letters, notice of meetings and other communication to the officers and members of the organization. D. Perform other functions that may be delegated by the President of the organization. Section 4: Treasurer A. Take custody of all SAMSO properties and funds, maintaining all necessary records and depositing all such funds in the bank approved by the SAMSO officers. B. Shall collect and receive all contribution, membership fees, materials and other resources intended to SAMSO. C. Report the SAMSO financial status and make it open to any members when asked or inspected. D. Disburse funds in accordance with the approved budget of the SAMSO. E. Certify the availability of fund necessary. F. Be a signatory on the disbursement and deposit of funds in SAMSO bank accounts and student clearance. G. Perform other functions that may be delegated by the President of the organization. Section 5: Auditor A. The auditor shall audit and examine all transactions entered by the organization B. Perform other functions that may be delegated by the President of the organization. Section 6: Public Information Officer A. The PIO shall be responsible for the dissemination of information approved by the SAMSO. B. Shall disseminate information prior to the scheduled date in case of special sessions, emergency meetings and activities C. Perform other functions that may be delegated by the President of the organization.

Section 7: Business Manager A. Shall exercise supervision over affairs, activities, plans and project transactions that will be implemented by the organization. B. Perform other functions that may be delegated by the President of the organization. Section 8: Representative A. They shall act as representative of their classes in organization meetings. B. Report the conditions and problems of their respective classes. C. Perform other functions that may be delegated by the President of the organization.

Article 8 WITHDRAWAL, SUSPENSION, EXPULSION AND TERMINATION OF OFFICERS AND MEMBERS

Section 1: Any officer and/or member shall be removed from office on the grounds specified herein A. B. C. D. E. F. G. H. Wilful violation of the Constitution. Gross negligence of duty Incompetence Bribery Graft and Corruption Malversation of Funds Betrayal of Student trust Immorality

Section 2: Removal office shall determine by the officers upon proper investigation of the case and submission of written evidence. Section 3: In case of voluntary resignation of the officers of SAMSO, resignation letter should be passed to the office of the Dean and SAMSO.

Article 9 DATE AND MANNER OF ELLECTION Section 1: Date The election of SAMSO officers will be held ten days after opening of regular classes. Section 2: Manner

A. Elected classroom officers shall serve as representative of each class to elect from themselves the officers of the organization. The former president or any officer in charge (in case of absence of the former president) of the organization shall provide and lead the election. There is an open nomination for any position provided that the candidate met the necessary qualifications, the candidate shall provide a short message before the election. Candidates shall be elected by simply raising the hand of the member favor of.

Article 10 MEETING Section 1: The first meeting of the organization shall be called by the President within 5 days after the assumption to the office to plan its programs and activities. Section 2: Regular meetings shall be on the last week of the month and emergency meeting shall be called upon by the President anytime. Section 3: There shall be a general assembly meeting at least once every semester. Section 4: The time and venue of the meeting will be decided by the President.

Article 11 AMMENDMENTS Section 1: This constitution and by-laws may be amended, replaced or altered in whole or in part at the regular or special meeting called upon the organization. Section 2: This constitution and by-laws maybe amended after four (4) years.

Article 12 EFFECTIVITY CLAUSE Section 1: This constitution and by-laws shall take effect after the ratification by simple major vote of the members through a referendum called for the purpose.
