Attached is the Commission's equipment recording policy. Recording equipment


is generally not permitted in classified areas. DO NOT ASSUME that that the
Commission policy supercedes that of your host agency.

You are advised to present a copy of this policy to your respective agency POCs
so that they can "grease the skids" with their respective security
organizations.

Recording Equipment Use

SCOPE
The National Commission on Terrorist Attacks Upon the United States (the
"Commission") is chartered by statute (Public Law 107-306) to investigate the facts and
circumstances surrounding the September 11, 2001 terrorist attacks, including the
nation's preparedness for, and immediate response to, those attacks, as well as to evaluate
the lessons learned from those attacks and to make recommendations for preventing
future attacks. The legislation authorizes the Commission, for purposes of its
investigation, to secure information "directly" from any executive department, bureau or
agency, and the statute also provides the Commission with subpoena power for witnesses
and documents.

REQUIREMENT TO USE

The practice of recording depositions/interviews shall be necessary to maintain interview


integrity. These recordings may be transcribed into written text under strict security
classification control.

EQUIPMENT

All recording equipment shall be purchased via established Commission purchasing


procedures and shall be immediately delivered to the Commission security or his
representative immediately upon receipt. Equipment used will meet current recording
standards. Purchase of recording equipment and recording media is the property of the
Commission and will not be used for other than Commission related work.

USE OF EQUIPMENT

All Commission recording equipment shall be accountability property and shall be signed
for using established Commission accountability property receipts. These receipts shall
be maintained with the recording equipment and delivered to the host agency upon
request.

EQUIPMENT STORAGE

Recording equipment is on the list of items prohibited from classified areas. Provisions
are available to permit use of such equipment in the furtherance of official government
business.
RECORDING MEDIA

All recording media shall be purchased via established Commission purchasing


procedures and shall be immediately delivered to the Commission security or his
representative upon receipt. All recording media shall have classification markings
affixed prior to beginning any recording.

TRANSPORT OF RECORDING EQUIPMENT


All Commission recording equipment shall be transported via locked bag, or other secure
means, and must be maintained under constant control at all times.

TRANSPORT OF RECORDING MEDIA

The transport of recorded classified media shall be via secure courier channels. Only in
extreme circumstances, and only with the express consent of the Commission Executive
Director, Deputy Executive Director, or the Security Officer, may recorded classified
media be transported via locked bag. At those times the media shall be transported from
its secure location to the Commission secure area and delivered to the Document Control
Manager or the Security Officer for receipt and secure storage.

STORAGE

Classified recording shall be stored in accordance with the requirements of the


classification of the media.

HOST AGENCIES

Responsibility for coordinating use of Commission recording equipment shall be with the
individual using the recording equipment. The Commission staff using the recording
equipment shall insure compliance with all host agency regulations and procedures.
