SUMMARY
FAILED Leadership
Unlike years past when Governor Cuomo, Dean Skelos, and Shelly Silver exchanged high fives in the red room, this years silence spoke volumes about the quality of the 2013 session. With the advent of coalition government in the Senate, people who care about the environment entered the year with high hopes for a productive legislative session. We believed that environmental and public health protections stood a better chance of passage with Independent Democratic Conference (IDC) Senator Jeff Klein leading a so-called group of moderate Democrats alongside Republican Senator Dean Skelos conference, which has historically been difficult to move on issues ranging from climate change to protecting children from toxic chemicals. They promised to end the Senates dysfunction, and we had every reason to believe them. How wrong we were. Instead, for the second year in a row, the Senate did not deliver a single Super Bill to Governor Andrew Cuomo for his signature. On issue after issue, Senators Skelos and Klein refused to allow simple votes on legislation and stymied proposals advanced by anyone other than members of the majority coalition. Oftentimes, it appeared they were not only at political war with the mainline Democratic Conference, but each other. Worse, even good bills sponsored by members of the ruling Independent Democratic and Republican conferences died in Senator Mark Grisantis Environmental Conservation Committee the graveyard of good environmental and public health legislation.
Once again the Assembly worked hard to move good policy with Assemblyman Bob Sweeney putting our environment and health ahead of the wall of corporate money that consistently shuts down good legislation in the Senate. In all, the Assembly passed 26 good bills to just 11 passed by the Senate. As importantly, Speaker Sheldon Silver led the Assembly to shut down every bad bill passed by the Senate, including legislation to invalidate critical regulations that provide basic health, safety, and environmental protections. Three of these bills earned 3-smokestacks under Environmental Advocates rating system because their environmental impact would have been so severe; this was the highest number of 3-smokestack bills passed by the Senate in five years. While we applaud the Assembly for continuing to lead on environmental issues, they must also step up their efforts to ensure their initiatives make it through both houses and are signed into law by the Governor.
Senate GRAVEYARD
We saw two forms of gridlock during the session: failure to lead and failure to negotiate. Failed leadership was seen in two bills that died in the Senate despite having more cosponsors than were needed for passage. Senator Philip Boyle worked tirelessly on behalf of the Child Safe Products Act garnering co-sponsorship from an incredible 37 senators, including three members of the IDC and seven republicans. Legislation requires just 32 votes to pass. The bill went nowhere. Unrelenting public pressure brought 34 cosponsors, including the IDC and several Republicans, onto a bill that would close a gaping loophole in existing regulations and require drilling companies to properly dispose of their hazardous waste. The bill went nowhere.
A failure to compromise sunk Governor Cuomos plan to make our state a leader in the development of clean, renewable energy and in the process create thousands of jobs and lessen climate-altering emissions by placing the NY-Sun Initiative in statute for 10 years. Both houses passed versions of the bill, but they were unable to reconcile their differences, so when the final gavel fell New Yorkers were left with nothing. It is now on Governor Cuomos shoulders to take action.
Despite promises of reform, the Senate failed to pass any campaign finance plan that would finally break the legislative logjam that stalls common-sense solutions to real world problems. It seems to have been lost on Senators Skelos and Klein that New Yorks environmental dangers are real. When climate change delivers a steady rain of devastating and unpredictable storms, there are consequences. When manufacturers are allowed to load up childrens products with deadly chemicals, there are consequences. And when a legislative body fails to deliver on any of its promises, there will be consequences.
When Senator Klein (D-Bronx) arranged his ascension to his Chambers co-presidency, he promised to end the dysfunction that has consumed the Senate for years. Instead, he: prevented common-sense legislation from making its way through the legislative process; refused to use his leadership position to prevent the roll back of hard-fought environmental protections from coming to the floor; voted for several bad bills which could kill protections that Senator Klein and his colleagues voted in favor of in previous years. We had high hopes going in to 2013 that bipartisan leadership would finally break the legislative logjam that has stalled so many initiatives in the past. Unfortunately, the 2013 legislative session ended with one of the most dismal environmental records in history. Senator Klein recieves the 2013 Oil Slick Award due to his lack of commitment to public health and environmental protection. The Senator seems more interested in power and press releases, than sound public policy. We hope that in 2014 he will act as the leader he promised to be.

Establishes a limit on greenhouse gas emissions from all sources in New York and requires that the limit not be greater than statewide emissions for the year 1990. Statewide limit is to be reduced until emissions are 80% below 1990 levels by 2050. A.6327 (Sweeney, et al.) passed Assembly. Similar bill S.735 (Avella, et al.) died in Senate Environmental Conservation Committee.
Identifies chemicals of concern, prioritizes them based on the likelihood for exposure, and requires disclosure by childrens product manufacturers as to whether their products contain priority chemicals. Phases out the use of certain toxic chemicals in childrens products starting January 1, 2018. Authorizes the Interstate Chemicals Clearinghouse to collect, manage, and publish the data collected from manufacturers. A.6328 (Sweeney, et al.)/S.4614 (Boyle, et al.) passed Assembly; died in Senate Environmental Conservation Committee.

Prohibits the sale of new residential furniture containing ineffective and toxic chemical flame retardants beginning July 1, 2014 and requires New York to develop an open flame flammability standard which will be periodically reviewed. A.6557 (Sweeney, et al.)/S.4780 (Grisanti, et al.) passed Assembly; died in Senate Finance Committee.
Incorporates environmental justice principles into state agency decision-making. Establishes a permanent Environmental Justice Advisory Group within the Department of Environmental Conservation and Environmental Justice Interagency Coordinating Council to report on the effectiveness of policies. Requires organizations that receive funds for capital improvements from the New York State Dormitory Authority and/or the Urban Development Corporation to use the funds to purchase Energy Star equipment and appliances when available. Requires the Department of Environmental Conservation to issue biennial reports listing areas most adversely affected by existing environmental hazards, providing a useful tool to address environmental injustices in New York. Provides a sales tax exemption for certain energy efficient appliances beginning on April 1, 2014 and continuing for five years.
