___ INSTITUTIONALIZING AND REGULATING THE CONDUCT OF TRADE FAIRS, FOOD BAZAARS, FLEA MARKETS OR BARATILLOS HELD IN THE STREETS OF DAGUPAN CITY DURING CHRISTMAS FESTIVITIES AND BANGUS FESTIVAL IN DAGUPAN CITY WHEREAS, trade fairs, food bazaars, flea markets or baratillos, are being held in the streets of Dagupan City as fund sources to support during Christmans Festivities and the Bangus Festival ; WHEREAS, Section 21 (d) of the Local Government Code allows the said activities to be held in local streets, to wit: Any city, municipality, or barangay may, by a duly enacted ordinance, temporarily close and regulate the use of any local street, road, thoroughfare, or any other public place where shopping malls, Sunday, flea or night markets, or shopping areas may be established and where goods, merchandise, foodstuffs, commodities, or articles of commerce may be sold and dispensed to the general public. WHEREAS, it has been the practice of the City of Dagupan to conduct trade fairs, food bazaars and flea markets or baratillos along Galvan Street, Jovellanos steet and/or a portion of Zamora Street (corner AB Fernandez Avenue to Rivera St) during the Christmas Season and Bangus Festival WHEREAS, there is a need to institutionalize and regulate the same for transparency and accountability purposes; NOW THEREFORE, upon motion of Councilor _________ duly seconded by _____________, the following ordinance is hereby enacted:

INSTITUTIONALIZING AND REGULATING THE CONDUCT OF TRADE FAIRS, FOOD BAZAARS, FLEA MARKETS OR BARATILLOS, HELD IN THE STREETS OF DAGUPAN CITY DURING THE CHRISTMAS FESTIVITIES AND BANGUS FESTIVAL

Section 1. Purpose. This ordinance aims to institutionalize and regulate the conduct of food bazaars, trade fairs, flea markets or baratillos, held in the streets of Dagupan City during Christmas festivities and the Bangus Festival. This ordinance further aims to promote transparency and credibility in the conduct of such activities and thus increase the income derived therefrom. Section 2. Definition of terms. The following are defined for purposes of this ordinance. A) Bangus Festival A citywide fanfare annual event that starts in April and end on the first week of May to promote its main product milkfish or Bangus; B) Christmas Festivities refer to the several events and activities in observance of the Christmas Season which begin on the first week of December and end on the first week of January, of the succeeding year; C) Trade Fairs - an exhibition wherein companies and individuals, in a specific industry or various industrious can showcase and demonstrate their products, service, study activities of rivals and examine market trends and opportunities. D) Baratillos- local term for Flea market E) Food Bazaar Market for food, usually those readily served for eating; Section 3. Authority to Temporarily Close Selected Streets. The City Mayor is hereby authorized to temporarily close either one, two or all of the following streets for trade fairs, food bazaars, and flea market or baratillos, during the Christmas Festivities and Bangus Festival: 1) The whole stretch or portion of Galvan Street; 2) Portion of Zamora Street (corner AB Fernandez Avenue and Rivera St); and/or 3) Jovellanos Street.

Section 4. Duration. The Trade fairs, Food Bazaars, and Flea Markets or Baratillos, should not last for more than fortyfive days from the time of their commencement;

Section 5. Selection of Event Organizer. The selection of event organizer of the Trade Fairs, Food Bazaars, and Flea Markets or Baratillos held in each street or all of the streets mentioned in section 3 hereof, shall be through bidding.

Section 6. Creation of Festival Appraisal Committee. A Festival Appraisal Committee is hereby created composed of the following: City Mayor as Chair; City Administrator as Vice- Chair; City Treasurer as member City Accountant as member City Engineer as member Chair, Committee on Market, Trade and Industry Sangguniang Panlungsod; Representative of the Federation of Senior Citizens in Dagupan City; This committee shall be responsible for the selection of the event organizer/s of the trade fairs, food bazaars, and flea market or baratillos during the Bnagus Gestival or Christmas festivities. The minimum bid for each event held in each street shall be determined by the Festival Appraisal Committee depending on the conditions of the market and demand and the demand of the festivities. The Festival Appraisal Committee shall require the selected event organizer the prioritization of Dagupan City residents in the allocation of space and stalls for exhibitors or traders in a trade fair, food bazaar, baratillo or flea market along the identified streets. The City Mayor is hereby authorized to sign the contract with the selected event organizers. Section 7. Limitations. No trade fair, food bazaar, flea market or baratillo shall be held on a Holy Thursday, Good Friday and Black Saturday.

Section 8. Fees. The payment of by the selected event organizer/s shall be to the One-Stop Business Center wherein the said event organizer/s will be issued official receipts.

Section 10. Separability Clause. If any section or provision of this ordinance is held unconstitutional or invalid, the other Sections or provisions shall not be affected.

Section 12. Effectivity This act shall take effect fifteen (15) days from the date of its complete publication in a newspapers of general circulation.
